STIPULATION AGAINST LIENS
WHEREAS, S & A CUSTOM BUILT HOMES, INe" a Pennsylvania
corporation, ("Owner"), the Owner of the real estate described below, has or is about to
execute a Contract with STONE VALLEY CONSTRUCTION, INC" ("Contractor"),
whose principal place of business is located at '2.b3 P;I\e..Grove. Rood, Pine.~~ /l'hlls
~A- lbeb€> for excavation and site improvernents upon 311 West First Street,
Boiling Springs, South Middleton Township, Cumberland County, Pennsylvania and
more particularly bounded and described on Exhibit "A", attached hereto and made a
part hereof; and
NOW, THEREFORE, this I jJ1l\ day Of~, 2000, before any authority had
been given by Owner to Contractor to commence work on said facilities or purchase
materials for same, in consideration of making of the above-described Contract with
Owner, and in further consideration of One ($1.00) Dollar paid to Contractor by
Owner, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims
shall be fIled or maintained against the Owner's facilities and the land above-described
by the Contractor or any of his subcontractors, or by any of the materialmen or
workmen, or any other person acting through or under thern, for or on account of any
labor or materials purchased, or extra labor or materials purchased for, towards, in or
abut the erection, construction, design and irnprovement of said facilities, under said
contract or otherwise, the right to have, me and maintain such liens or claims against
the facilities and the land above-described, being hereby expressly waived by the
Contractor for himself, his subcontractors, all materialmen, or workmen and other
acting through or under thern.

EXHIBIT "A"
ALL THAT CERTAIN tract ofland situate in the Township of South Middleton,
County of Cumberland, and State of Pennsylvania, bounded and described as follows,
to wit:
BEGINNING at a post at now or formerly School House Lot and lands now or
formerly of Benjamin Bricker, thence south 14 degrees 30 minutes east 641/10
perches to a point on the south side of the York Road at lands now or formerly of
Philip Brechbill, thence by the said lands of the said Brechbill, south 81 degrees 45
minutes west 23 8/10 perches to a post on the south side of the York Road, thence
across the said road and by lands now or formerly of Samuel Throne north 16 degrees
west 19 8/10 perches to a post, thence by lands now or formerly of Samuel Throne
and George I. Throne south 80 degrees 30 minutes west 15 5/10 perches to a post,
thence by lands now or formerly of Emanuel Lackey north 13 degrees 30 minutes
west 13 9/10 perches to a stone; thence by the same south 80 degrees west 9 5/10
perches to a post, thence by lands now or formerly of Joseph Spangler, north 16
degrees 30 minutes west 23 9/10 perches to a stone; thence by lands now or formerly
of the said Benjamin Bricker north 73 degrees 15 minutes east 50 perches to a post,
the place of BEGINNING.
BEING composed of two different tracts ofland, the first comprising of five (5) acres
and sixty (60) perches and the second comprising nine (9) acres and sixty (60)
perches, having thereon erected certain improvements.
EXCEPTING THEREFROM nonetheless a tract of 36 3/10 perches conveyed to
South Middleton Township School District by deed dated November 5,1921, and
recorded in Deed Book J, Volume 9, Page 195, a tract containing 0.183 acres taken by
South Middleton Township School District by condemnation resolution dated
January 8, 1953, and recorded in Miscellaneous Book 101, Page 504, and any lands
released and quit-claimed to Paul Donald Hamilton, a/kIaPaul D. Hamilton, hy
quit-claim deed dated November 1, 1987, and recorded in Deed Book B, Volume 33,
Page 346.
BEING THE SAME PREMISES which Sally A. Kreitzer and Richard L. Kreitzer, her
husband; Keith D. Stought and Connie L. Stought, his wife; Lynn Ellen Stought,
single woman; and Diane Lee Stought, single woman, tenants in common in the
undivided portions or shares of one-third to Sally A. Kreitzer, her heirs and assigns,
one-third to Keith D. Stought, his heirs and assigns, one-sixth to Lynn Ellen
Stought, her heirs and assigns, and one-sixth to Diane Lee Stought, her heirs and
assigns, by their Deed dated May 25, 1999 and recorded June 2, 1999 in the Office of
the Recorder of Deeds in and for Cumberland County in Record Book 200, Page 887,
granted and conveyed unto S & ACustom Built Homes, Inc.
