STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~ day of il~11
between JIM MILLER CUSTO~. BUILDER, I C.,
Corporation, hereinafter referred to as Contractor,

a Pennsylvania
AND
ELLA JEAN NICHOLS AND LISA HATHCOX, Mother and Daughter,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in Cumberland County, Commonwealth of
Pennsylvania, and more fully described in Exhibit "A" which is
attached hereto and made a part hereof known as Lot #20 Walnut
Court Phase II, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Exhibit A
ALL that certain tract of land situate in the Borough of Carlisle, Cumberland
County, Pennsylvania, appearing as Lot 20 on Phase II ofthe Final Subdivision Plan
of Walnut Court, as recorded in Cumberland County Plan Book 58, page 28 and
being more particularly bounded and described in accordance with said Subdivision
Plan as foUows:
BEGINNING at a point on the southeastern corner for the dedicated rights of way
for Georgetown Circle and White Birch Lane; thence along said White Birch Lane,
North 83 degrees 45 minutes 00 seconds East, 100.15 feet to a point at the dividing
line between Lots 20 and 21 in the hereinafter mentioned Plan of Lots; thence along
said dividing line, South 06 degrees 15 minutes 00 seconds East, 123.27 feet to a
point at the dividing line between Lots 19 and 20 in the hereinafter mentioned Plan
of Lots; thence continuing North 72 degrees 57 minutes 19 seconds East, 119.95 feet
to II point at the southern side of the dedicated right of way for Georgetown Circle;
thence along the right of way of Georgetown Circle along a curve of an arc having a
radius of 270.00 feet, a distance of 65 feet to a point, thence continuing North 06
degrees 01 minute 29 seconds West, 56.43 feet to a point, thence along the curve of
an arc having a radius of 25.00 feet, a distance of 39.17 feet to a point, the place of
BEGINNING.
BEING Lot No. 20 of the Final Subdivision Plan of Walnut Court, for Lots 19, 20
and 21 as recorded in Cumberland County Plan Book 73, Page 127.
BEING the same premises which Beverly L. Kingery and Daniel V. Kingery, her
husband, granted and conveyed to EUa Jean Nichols and Lisa Hathcox, mother and
