STIPULATION AGAINST LIENS

THIS AGREEMENT made the ~ day of March, 2000, by and between NICKEL
HOMES, hereinafter referred to as Contractor, and DENVER 1. TUCKEY and GAYLE A.
. TUCKEY, husband and wife, hereinafter referred to as Owner, whereby the former undertook ~d
agreed to erect and construct a custom built home on that certain lot of ground situate at Lot No.5

of the Subdivision Plan for Ronald 1. Simons as recorded in Plan Book 78 at Page 82, also known

as Lot No. 5, Golf Court, South Middleton Township, Cumberland County, Pennsylvania, more fully
described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shallbe filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right oflien, shall be an independent covenant.

Pennsylvania, according to a subdivision plan for Ronald L.. Simons:
BEGINNING at a point on the dedicated right of way of Forge Road (L.. R. 21008, S. R. 2003), at
the dividing line between Lot No. I of Mayapple Village and Lot No.5 on the hereinafter mentioned
plan oflots; thence along said right of way, North 31 degrees 41 minutes 26 seconds West, 150.00
feet to a point at the dividing line between Lots 4 and 5 in the hereinafter mentioned Plan ofLo,ts;
thence North 58 degrees 18 minutes 34 seconds East, 236.77 feet to a point at lands now or formerly
known as Mayapple Village; thence along said lands, South 31 degrees 38 minutes 00 seconds East,
150.00 feet to a point; thence continuing along said lands, South 58 degrees 18 minutes 34 seconds
