You MUST obey the Order that is attached until it is modified or terminated by the court after notice

to a charge of indirect criminal contempt which is punishable by a fine of up to $1,000.00 and/or up to six
months injail under 23 Pa.C.S. S 6114. Violation may also subject you to prosecution and criminal penalties
under the Pennsylvania Crimes Code. Under federal law, 18 U.S.C. S 2265, this Order is enforceable
anywhere in the United States, tribal lands, U.S. Territories and the Commonwealth of Puerto Rico. If you
travel outside of the state and intentionally violate this Order, you may be subject to federal criminal
proceedings under the Violence Against Women Act, 18 U.S.C. SS 2261-2262.

[X] I. Defendant shall not abuse, harass, stalk or threaten any of the above persons in any place where they
might be found.
[X] 2. Defendant is excluded from the residence at 10 Village Road, Mechanicsburg, PA 17055 or any other
permanent or temporary residence where Plaintiff may live. Plaintiff is granted exclusive possession
of the residence. Defendant shall have no right or privilege to enter or be present on the premises.
[X] 3. Except for such contract with the minor child as may be permitted under Paragraph 5 of this Order,
Defendant is prohibited from having ANY CONTACT with Plaintiff at any location, including but not
limited to any contact at Plaintiffs school, business, or place of employment. Defendant is
specifically ordered to stay away from the following locations for the duration of this Order:
The Plaintiffs place of employment, Lowes in Mechanicsburg, PA.

Except for such contact with the minor child as may be permitted under Paragraph 5 of this Order,
Defendant shall not contact Plaintiff by telephone or by any other means, including through third
persons.
[X] 5. Pending the outcome of the final hearing in this matter, Plaintiff is awarded temporary custody of the
following minor child: Brennen X. O'Brien
Until the final hearing, all contact between Defendant and the child shall be limited to the following:
Supervised visitation approved and administered by Cumberland County Children & Youth Services
The local law enforcement agency in the jurisdiction where the child is located shall ensure that the

child is placed in the care and control of the Plaintiff in accordance with the terms of this Order.
[] 6. Defendant shall immediately relinquish the following weapons to the Sheriffs Office or a designated
local law enforcement agency for delivery to the Sheriffs office:
Defendant is prohibited from possessing, transferring or acquiring any other weapons for the duration
of this order.

UNTIL MODIFIED OR TERMINATED BY THIS COURT AFTER NOTICE AND HEARING.
NOTICE TO THE DEFENDANT
Defendant is hereby notified that violation of this Order may result in arrest for indirect criminal
contempt, which is punishable by a fine of up to $1,000.00 and/or up to six months in jail. 23 Pa.C.S S 6114.
Consent of the Plaintiff to Defendant return to the residence shall not validate this Order, which can only be
changed or modified through the filing of appropriate court papers for that purpose. 23 Pa.C.S. S 6113.
Defendant is further notified that violation of this Order may subject him/her to state charges and penalties
under the Pennsylvania Crimes Code and to federal charges and penalties under the Violence Against Women
Act, 18 U.S.C. SS 2261-2262.
NOTICE TO LAW ENFORCEMENT OFFICIALS
This Order shall be enforced by the police who have jurisdiction over the plaintiffs residence OR any
location where a violation of this order occurs OR where the defendant may be located. If defendant violates
Paragraphs I through 6 ofthis Order, defendant may be arrested on the charge of Indirect Criminal Contempt.
An arrest for violation of this Order may be made without warrant, based solely on probable cause, whether
or not the violation is committed in the presence of law enforcement.
Subsequent to an arrest, the law enforcement officer shall seize all weapons used or threatened to be
used during the violation of this Order OR during prior incidents of abuse. Weapons must forthwith be
delivered to the Sheriffs office of the county which issued this Order, which office shall maintain possession
of the weapons until further Order of this court, unless the weapon/s are evidence of a crime, in which case,
they shall remain with the law enforcement agency whose officer made the arrest.

Describe in detail what happened, including any physical or sexual abuse, threats, injury, incidents of
stalking medical treatment sought, and/or calls to law enforcement:
Defendant bit Brennen X. O'Brien twice on the arm causing bruising; Brennen X. O'Brien was taken
to the Hershey Medical Center by his paternal grandmother, Hershey Medical Center notified Children
& Youth Services and Defendant was subsequently charged by Silver Springs Township Police
Department with simple assault and harassment.

Francis X. O'Brien, Jr. and Defendant were in the midst of an argument when Defendant lost her temper and
kicked him with heavy boots in the chest and stomach areas and hit him with fists. Defendant hit him in the
lip. Injuries included bruises on his shoulder, scrape on his nose, bruise on his arm, faint bruise on his left
abdominal area at the waistline, lower abdominal pain. .
13. If the Defendant has committed prior acts of abuse against Plaintiff or the minor child, describe these
prior incidents, including any threats, injuries, or incidents of stalking, and indicate approximately when
such acts of abuse occurred: In Spring 1999, Defendant grabbed Brennen X. 0 'Brien by the throat and
told him to "Shut the Fuck Up"; witnessed by Defendant's aunt and cousin

AND NOW, this -Lf-1ay of June, 2000, upon presentation and consideration of the
attached Stipulation, and upon agreement of the parties, it is hereby ordered and decreed that
the attached Motion is made an Order of Court. The Court hereby enters the following

I. Jamie L. Danzberger's abuse claim against Francis X. O'Brien, Jr., Civil Docket No.
00-3182, is hereby dismissed.
2. Francis X. O'Brien, Jr.'s abuse claim against Jamie L. Danzberger, Civil Docket No.
00-2457, is deemed withdrawn and paragraphs 1-4 of the Court's Order of April 19,
2000 (extended by Orders of April 26, 2000, and May 15,2000) are vacated.
3. With regard to the custody count filed by Francis X. O'Brien, Jr., in his Petition for
Protection from Abuse, Docket No. 00-2457 concerning the parties' minor child,
Brennen X. O'Brien, born December 3, 1998, it is hereby directed that the parties and

STIPULATION
Francis X. O'Brien, Jr. by and through his counsel, the Family Law Clinic, and Jamie L.
Danzberger, by and through her counsel, Gregory Cutler, Esq., hereby stipulate as follows:
1. Jamie L. Danzberger withdraws her abuse claim against Francis X. O'Brien, Jr., Civil
Docket No. 00-3182, and hereby dismisses that action in its entirety.
2. Francis X. O'Brien, Jr. withdraws his abuse claim against Jamie L. Danzberger,
contained in Civil Docket No. 00-2457, and hereby dismisses the abuse count in that
action.
3. With regard to the custody count filed by Francis X. O'Brien, Jr. in his Petition for
Protection from Abuse, Docket No. 00-2457:
a. The custody dispute shall be referred to a custody conciliator.
b. The custody aspects of the Temporary Protection From Abuse Order of April 19,
2000, shall remain in effect unless and until modified by further Order of the
Court.

Conciliation Report, it is ordered and directed as follows:

1. This Court's prior Order of November 24, 1999 at Docket No. 99-6152 and any
other Custody Orders entered at the Docket Numbers referenced above are vacated.
2.
The Father, Francis X. O'Brien, Jr., and the Mother, Jamie L. Danzberger, shall
enjoy shared legal and shared physical custody of Brennen X. O'Brien, born
December 3,1998.

3. The parties shall work out an actual physical custody arrangement pursuant to an
agreement reached by the parties.
4. This Order is entered in light of the parties representations to the Custody
Conciliator that they are working at a reconciliation. In the event the parties do not
reconcile and in the event the parties are unable to reach an agreement between
themselves with respect to a permanent order of custody for the minor child at that
time, either party or their counsel may contact the Custody Conciliator directly in
writing to request that another Custody Conciliation Conference be held. At that
time, the Conciliator will recommend an interim custody order to the Court if the
parties are unable to agree at the Custody Conciliation Conference, and also
schedule the case for a hearing before the Judge.
