STIPULATION AGAINST LIENS
KNOW ALL MEN BY THESE PRESENTS, THAT:
WHEREAS, BRENNEMAN CUSTOM HOMES, INC., (hereinafter called "Contractor"),
has executed an agreement ("Contract") to erect, construct, alter or repair improvements (the
"Work") upon the property ("Property") ofDA VID L. WARLICK and SHIRLEY B. WARLICK,
(hereinafter called ("Owner") located in Lower Allen Township, Cumberland County,
Pennsylvania, (the Property being more particularly described in Exhibit "A" annexed hereto).
WHEREAS, as part of the Contract, Contractor agreed that no lien shall be filed against
the Property or any building or improvements thereon by itself or by any subcontractor or
materialman or any other person furnishing labor or materials under the Contract, and agreed to
execute and deliver a Waiver of Liens for filing.
NOW, THEREFORE, in consideration ofthe execution of the Contract, Contractor,
intending to be legally bound hereby, for Contractor, for all subcontractors of Contractor, and for
all parties acting for, through or under Contractor or any subcontractor, covenants and agrees that
no mechanics' lien or claim shall be filed or maintained by Contractor or any such subcontractor
or party, against any part of the Property or any building or improvements thereon, for or on
account of any labor or materials furnished or any work done under the Contract, or in or about
the erection, construction, installation or completion of the work; and Contractor, for Contractor,
for any and all subcontractors and for any and all parties acting for, through or under Contractor
or any subcontractor, hereby waives and relinquishes the right to have, file or maintain any
mechanics' lien or claim against any part of the Property or any building or improvements
thereon.
Contractor hereby warrants and represents that at the time of the execution hereof, no

work of any kind has been done and no labor or materials have been furnished by Contractor, or
by any subcontractor of Contractor, or by any person acting for, through or under Contractor or
any subcontractor in the performance ofthe Contract, in or about the completion ofthe
construction ofthe Work.
This Waiver is made by Contractor and intended to be filed in accordance with the
requirements ofthe (pennsylvania) Mechanics' Lien Law of 1963, as amended and
supplemented, with the Prothonotary of the Court of Common Pleas of the County in which the
Property is located.
Each of the terms, provisions, covenants and conditions of this Waiver shall, as the case
may be, be binding upon and inure to the benefit of Owner, Contractor, each subcontractor of
Contractor, and each party acting for, through or under contractor or such subcontractor, and the
respective heirs, executors, administrators, successors and assigns of each and any ofthem.
IN WITNESS WHEREOF, Contractor and Owner have duly executed this instrument as

EXHffiIT "A"
ALL that certain lot ofland situate in Lower Allen Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows, to wit:
BEGINNING at a point in the center line of Sheepford Road at comer of land now or
formerly of Melvin C. Dunlap; thence through the center line of Sheep ford Road, the following
three courses and distances: I) North eighty-two (82) degrees forty-five (45) minutes West, a
distance of one hundred ninety-five and eighteen hundredths (195.18) feet to a point; 2) North
eleven (II) degrees thirty (30) minutes West, a distance of one hundred eighty-three (183) feet;
3) South twenty-eight (28) degrees fifteen (15) minutes West, a distance of eighty-one and
twenty-eight hundredths (81.28) feet to a point at Lot No.2 on the hereinafter mentioned plan;
thence by Lot No.2 North seventy-four (74) degrees twenty-three (23) minutes East a distance of
two hundred twenty-five and seventy-four hundredths (225.74) feet to a concrete monument at
land now or formerly ofRhuell W. Smith; thence by the same and land now or formerly of
Melvin C. Dunlap, South eight (08) degrees thirty-nine (39) minutes East, a distance of three
hundred forty and twenty hundredths (340.20) feet to a point, the place of BEGINNING.
CONTAINING a total of 59, 341 square feet, or 48,361 square feet net.
BEING Lot No.3 ona final subdivision plan for Melvin C. and Patricia H. Underkoffler
made March 29,1979 by Edward F. Sanders, R.S. and recorded in Cumberland County, Plan
Book 35, page 82.
