COMPLAINT
1. Plaintiff is David Dee Kepner ("Kepner"), an adult individual residing at
329 Deerfie1d Road, Camp Hill, Cumberland County, Pennsylvania.
2. Defendant is Andrew D. Ruble ("Ruble"), an adult individual who, upon
information and belief, resides at 114 6th Avenue, Burnham, Mifflin County,
Pennsylvania.
3. In January, 1998, Ruble asked Kepner, his uncle, to help Ruble obtain a
loan to purchase an automobile. Ruble obtained the loan from the Juniata Valley Bank
and presented the loan documents to Kepner for his signature at Kepner's home in Camp
Hill, Pennsylvania. A true and correct copy of the loan documents are attached hereto
marked as Exhibit A and incorporated herein.
4. Ruble and Kepner agreed that since Kepner was not receiving any part of
the loan, and had agreed to sign the loan documents only so that Ruble would receive the
loan, that Ruble, himself, would make all the payments on the loan until the same was
paid in full.
5. Ruble secured this loan with a 1992 Geo Storm automobile registered in
his name.
6. In December, 1998, Kepner had a credit check run in an attempt to obtain
a creditcard, and for the first time learned that the loan which he and Ruble had taken
from the Juniata Valley Bank was in default.
7. Kepner contacted Juniata Valley Bank and leamed that his nephew, Ruble,
had failed to make any payments on the loan. Kepner also learned that Juniata Valley
Bank released the title to the automobile to Ruble without Kepner's knowledge, which
allowed Ruble to sell or trade-in the automobile to a third party. Ruble was supposed to
bring the title to his new automobile into Juniata Valley Bank as security for this loan, but
never did so. In addition, Kepner learned for the first time that the loan was used to
payoff some debts that Ruble had acquired, those debts being: $928.85 to Discover,
$929.64 to Ruble's insurance company, $4,950.00 to Visa, $3,292.56 to NCB and
$1,828.59 to Standard Steel Credit Union.
8. Kepner made numerous attempts to get Ruble to pay this loan, but, other
than one $200.00 payment to Kepner, Ruble failed to do so.
9. In an effort to restore his credit rating, Kepner contacted Juniata Valley
Bank and paid off the loan in full. In total, with interest and penalties, Kepner paid
Juniata Valley Bank the sum of$16,148.03.
10. Despite demand therefor, Ruble has failed and refused to pay this amount
to Kepner.

11. This amount does not exceed the maximum for submission to compulsory
arbitration.
COUNT I - BREACH OF ORAL CONTRACT
12. The averments contained in Paragraphs 1 through 11 of this Complaint are
hereby adopted by reference and incorporated herein.
13. The parties orally agreed that Ruble would be solely responsible for
repayment of the loan to Juniata Valley Bank as he is the only person who received the
benefit of the loan, and that Ruble would hold Kepner harmless from any liability on the
loan.
14. Other than a $200.00 payment to Kepner, Ruble has failed and refused to
make any payments on the loan, or to reimburse Kepner for the payment Kepner made to
satisfy the loan.
15. Kepner has satisfied all conditions precedent to Ruble's obligation to hold
Kepner harmless from any liability on the loan.
16. The full amount due and owing to Kepner by Ruble is $15,948.03.
WHEREFORE, Plaintiff, David Dee Kepner, demands judgment in his favor and
against the Defendant in the amount of $15,948.03, plus interest, costs of suit and such
other and further general relief that the Court deems appropriate.

COUNT II - UNJUST ENRICHMENT
17. The averments of Paragraphs 1 through 16 of this Complaint are hereby
adopted and incorporated herein by reference.
18. Ruble by obtaining a loan to payoff his debts, removing the collateral for
the loan and having had Kepner pay the loan in full has been unjustly emiched in the
amount of$15,948.03
WHEREFORE, Plaintiff, David Dee Kepner, demands judgment in his favor and
against the Defendant in the amount of $15,948.03, plus interest, costs of suit and such
other and further general relief that the Court deems appropriate.
