NOTICE IS HEREBY GIVEN that the foregoing action has been
commenced and is now pending in the Court of Common pleas of
Cumberland County, Pennsylvania, between the parties above,named
for seizure, arrest and forfeiture of the defendant real
properties, along with all improvements, appurtenances,
buildings and structures, with the Commonwealth of Pennsylvania
as Plaintiff. Such Notice to Answer Petition for Forfeiture and
the petition for Forfeiture have been duly filed with the Clerk
of Court of Cumberland County, Pennsylvania in Carlisle,
Pennsylvania, on April 26, 2000. Such documents are marked as

Cosmetic Act, 35 Pa.C.S.A. ~ 780-101 et seq.
2. Specifically on April 20, 2000, at approximately 1325
hours, a search warrant was executed at the residence of
Kristen L. Bitner at 32 Kenwood Avenue, Carlisle, South Middleton
Township, Cumberland County, Pennsylvania.
3. During the execution of said search warrant
approximately three ounces of powder cocaine, a schedule II
controlled substance, one ounce of crack cocaine, a schedule II
controlled substance, cutting agents, a digital scale and other
items were seized.

4. For the past twelve months, the Cumberland County Drug
Task Force has been receiving information from various
confidential sources that Kristen L. Bitner of 32 Kenwood Avenue,
South Middleton Township, Carlisle, Cumberland County,
pennsylvania was selling large quantities of cocaine in the
Carlisle area.
5. Police interviewed Kristen L. Bitner on June 25, 1999,
at which time she stated she would make trips to Philadelphia and
bring back several ounces of cocaine to her residence at 32
Kenwood Avenue, South Middleton Township, Carlisle, Cumberland
County, Pennsylvania for storage and redistribution within the
Carlisle area. .She also described herself as one of the biggest
suppliers of cocaine in the Carlisle area.
6. The owner of 32 Kenwood Avenue, South Middleton
Township, Carlisle, Cumberland County, Pennsylvania, to the best
knowledge of Petitioner is Kristen L. Bitner.
7. The record owner of 32 Kenwood Avenue, South Middleton
Township, Carlisle, Cumberland County, Pennsylvania, to the best
knowledge of petitioner is Kristen L. Bitner and John L. Peffer
and Joyce D. Peffer.
8. Respondent, Kristen L. Bitner made statements to the
police which indicated that her parents, Respondents John L. and
Joyce D. Peffer were aware that she sold drugs from the above-
captioned property and they wanted her to stop.

9. The property, 32 Kenwood Avenue, South Middleton
Township, Carlisle, South Middleton Township, Cumberland County,
Pennsylvania, was used or intended to be used to facilitate the
concealment of, possession of, processing of, and/or distribution
of the said controlled substance.
10. Said property is therefore subject to forfeiture
pursuant to 42 Pa.C.S.A. ~ 6801 (a) (6) .
WHEREFORE, the Commonwealth respectfully requests This
Honorable Court to enter an Order forfeiting the property located
at 32 Kenwood Avenue, Carlisle, South Middleton Township,
Cumberland County, Pennsylvania to the Commonwealth of
Pennsylvania through the District Attorney's Office, according to
law, unless cause to the contrary be shown.

The Commonwealth's Motion is granted.
The defendant/real properties located at 32 Kenwood Avenue,
Carlisle, South Middleton, Cumberland County, Pennsylvania, are
hereby placed under the Court's jurisdiction pursuant to the
Controlled Substances Forfeiture Act, 42 Pa.C.S.A. ~ 6802 et
seq. Kristen L. Bitner and John L. Peffer and Joyce D. Peffer
are hereby restrained for a period of ten (10) days from the
date of this Order from transferring or encumbering the title of
the above property or otherwise making the property unavailable
for forfeiture under the Controlled Substances Forfeiture Act,
42 Pa.C.S.A. ~ 6801 et seq.

in support thereof avers the following:
1. The defendant/real property is real property located at
32 Kenwood Avenue, Carlisle, South Middleton Township,
Cumberland County, Pennsylvania, and are titled in the name of
Kristen L. Bitner and John L. Peffer and Joyce D. Peffer. (A
copy of the Deed to these properties is attached as Exhibit A) .
2, On or about April 20, 2000, Kristen L. Bitner was
arrested at her residence at 32 Kenwood Avenue, Carlisle, South
Middleton Township, Cumberland County, Pennsylvania, and charged

with violation(s) The Controlled Substance, Drug, Device and
Cosmetic Act, 35 Pa.C.S.A. ~ 780-101 et seq.
3. Specifically on April 20, 2000, at approximately 1325
hours, a search warrant was executed by the Cumberland County
Drug Task Force at said residence.
4, At this time approximately three ounces of powder
cocaine, a schedule II controlled substance, one ounce of crack
cocaine, a schedule II controlled substance, cutting agents, a
digital scale and cash were seized as a result of the execution
of the search warrant at 32 Kenwood Avenue, Carlisle, South
Middleton Township, Cumberland County, Pennsylvania.
5. For the past twelve months, the Cumberland County Drug
Task Force has been receiving information from various
confidential sources that Kristen L. Bitner of 32 Kenwood
Avenue, South Middleton Township, Carlisle, Cumberland County,
Pennsylvania was selling large quantities of cocaine.
6. Police interviewed Kristen L. Bitner on June 25, 1999,
at which time she stated she would make trips to Philadelphia
and bring back several ounces of cocaine to her residence at 32
Kenwood Avenue, South Middleton Township, Carlisle, Cumberland
County, Pennsylvania for storage and redistribution within the
Carlisle area. She also described herself as one of the biggest
suppliers of cocaine in the Carlisle area. Kristen Bitner's

name has been mentioned by numerous cooperating individuals as
being a supplier of cocaine to the Carlisle area.
7. Kristen L. Bitner has made comments that she was
planning to sell her residence at 32 Kenwood Avenue, Carlisle,
South Middleton Township, Cumberland County, Pennsylvania.
8. The Temporary Restraining Order is necessary to
preserve the availability of the property for subsequent
forfeiture proceedings.
9. The Temporary Restraining Order is necessary in that
Notice of this action may jeopardize the availability of the
property in that a transfer or encumbrance could take place at
any moment.
10. The need to preserve the availability of said property
outweighs any hardship to any party in that no party shall be
displaced from the property nor disavowed any interest in the
property,
11. This property, 32 Kenwood Avenue, Carlisle, South
Middleton Township, Cumberland County, Pennsylvania, was used or
intended to be used to facilitate the growing of, concealment
of, processing center of, and distribution of the said
controlled substances.
12. This property is therefore subject to forfeiture
pursuant to 42 Pa,C.S.A. S 6801 (a) (6) and a Temporary

Restraining Order against the properties is permitted pursuant
to 42 Pa.C,S.A. ~ 6802 (g).
WHEREFORE, it is respectfully requested that a Temporary
Restraining Order be issued for the defendant/real property and
Kristen L. Bitner pursuant to the provisions of the Controlled
Substance Forfeitures Act, 42 Pa.C,S.A. ~ 6802 (g) for future
forfeiture proceedings, and that leave to file a Lis Pendens
against the defendant/real properties be granted.
