UNDER SECTION 3301(c) AND 3301(d) OF THE DIVORCE CODE
AND NOW, COMES, the above-named Plaintiff by and through his attorney
Peter J. Russo, and seeks to obtain a Decree in Divorce from the above-named
Defendant, upon the grounds hereinafter more fully set forth:
1. Plaintiff is an adult individual residing at 328 N. Mountain Road, Newville,
eumberland eounty, Pennsylvania and is a citizen of the United States.
2. Defendant is an adult individual residing at 1307 earnith Drive, Pascagoula,
Mississippi, and is a citizen of the United States.
3. Plaintiff has been a bona fide resident of the eommonwealth of
Pennsylvania for 5 years and has resided continuously therein for at least six months
prior to filing of this eomplaint.
4. Plaintiff and Defendant were married on May 17, 1968 in Philadelphia,
Pennsylvania.

5. There are no children of the parties under the age of eighteen (18).
eOUNT I - DIVORCE
6. Plaintiff hereby incorporates by reference averments 1 through 5 of this
eomplaint as if each averment were set forth fully hereunder.
7. There has been no prior action for divorce by either party against the other.
8. Neither Plaintiff nor Defendant is in the Armed Forces of the United States
or any of its allies.
9. Plaintiff avers that the marriage between the parties is irretrievably broken.
10. Plaintiff has been advised that counseling is available and that Plaintiff may
have the right to request that the court require the parties to participate in counseling, but
does not request the same.
11. Plaintiff and Defendant have property which will be subject to a property
settlement agreement addressing support issues, which will be filed herein at the
appropriate time.
WHEREFORE, Plaintiff, DONALD EUGENE WENNER, prays that a decree be
entered in favor of the Plaintiff and against Defendant as follows:
A. That a decree in divorce be entered dissolving the marriage between the
two parties.

I. The parties to the above-captioned matter were married in May of 1968.

5. Defendant's last known address was in Pascagoula, Mississippi.

has been returned as "Unable to Forward."
8. A search of public records was conducted and Plaintiff has been unable to locate the
Defendant.

as Exhibit B is the proposed notice.

I, Melissa M. Mehaffey, being duly sworn according to law, state under oath:
1. I am the paralegal assisting Peter 1. Russo Esquire, in the above-captioned matter.
2. The above-captioned divorce was filed on or about May 1, 2000.
3. On May 2, 2000, I placed the Divorce Complaint, Acknowledgment of Acceptance of
Service, Plaintiffs Affidavit, Notice of Intent to Enter Divorce, a Counter Affidavit
and a return envelope to the defendant at her last know address in Pascagoula,
Mississippi.
4. This package was sent via US Mail and was certified.
5. The package mailed on May 2, 2000, was returned and a second package was sent via
First Class mail and was also returned as "Unable to Forward."
6. A search of public records was conducted and no "Shirley Ann Wenner" or "Shirley
Ann Harkey-Wenner" were found.
7. A search of public records was conducted and the name "Shirley Harkey," the
defendant's maiden name revealed three names.

8. All three Shirley Harkeys were contacted and none claimed to ever have been married
to the Plaintiff.
9. I have confirmed with Plaintiff that the Defendant's family last resided in Pascagoula,
Mississippi.
10. I have confirmed with the Plaintiff that he has no further information about his
estranged, in fact, he does not even have a record of Defendant's social security
number.
