No.: tJ-o. :2 7.:LF" c:;;J T..L-- Central P A Rehabilitation Service, Inc, Defendant CIVIL ACTION COMPLAINT AND NOW, comes Plaintiff, by and through his counsel, and files this Complaint against Defendant, and in support thereof, avers the following: 1, Jurisdiction for this claim is asserted pursuant to the Pennsylvania Unfair Trade Practices and Consumer Protection Law, 73 P.S, 9201-3.1, particularly, the Debt Collection Practices Regulations issued under 37 Pa.Code 9303.1 et seq. 2. Defendant is a debt collectors pursuant to 37 Pa.Code 9303.2, with its principal place of business located at 75 Evelyn Drive, Millersburg, PA 17061. 3. Plaintiff is a consumer with a mailing address of 1425 Apple Drive, Mechanicsburg, PA. 4. Whereas, defendant contacted Plaintiff within one year from the date of the filing of this Action. 5. Defendant, in its collection efforts, told Plaintiff that they were going to forward his account to a local District Justice and execute a judgment against him. 6. Defendant, in its collection efforts, told Plaintiff that they were going to have a constable take his personal property. 7. These statements, made by defendant, were false and in violation of the state and federal law. 8. These statements, made by defendant, were a false threat of litigation, in violation of state ~ ...." and federal law. 9. Defendant, in its collection efforts, used false or deceptive acts and intended to oppress and harass plaintiff. WHEREFORE, plaintiff requests that this Honorable Court issue judgment on his behalf and against defendants for a statutory penalty of One Hundred ($100.00) per violation or three (3) times the actual value of his damages, whichever is greater, and reasonable attorney's fees. COUNT II - FAIR DEBT COLLECTION PRACTICES ACT 10. Plaintiff hereby incorporates the foregoing as if fully set forth herein. 11. Jurisdiction for this action is asserted pursuant to the Fair Debt Collection Practices Act, 15 V.S.C. 91692, et seq. ("FDCPA"), particularly 15 V.S.C. 9 I 692k(d) and 28 V.S.C. 91337. 12. These statements, made by defendant, were false and in violation of the FDCPA, 15 V.S.C.91692e. 13. These statements, made by defendant, were a false threat oflitigation, in violation of the FDCPA, 15 V.S.C. 91692e. 14. Defendant, in its collection efforts, violated the FDcP A, inter alia, Sections 1692, b,. c, d, e, f, g, h, i, j, andfor n. WHEREFORE, plaintiff requests that his Honorable Court enter judgment on his behalf and against defendants and issue an Order: (A) Award Plaintiff statutory damages in the amount of One Thousand Dollars ($1,000.00) for each violation ofthe FDCP A or each separate and discrete incident in which defendants have violated the FDCP A.
