Sandra Lee Blosser (Defendants), with a principal residence at 6445 Gallop Road,
Harrisburg, Pennsylvania 17111.
3, The last date on which Carpet Mart performed work for which this Claim is
made was February 14,2000,
4. This Mechanic's Lien Claim arises from a contract between Carpet Mart and
Defendant, Craig Lahar, wherein Carpet Mart agreed to furnish certain flooring and related

5. The amount claimed to be due is $22,625,36, plus interest in the amount of
1.5% per month from February 14,2000, forward,
6, The improvements and the property claimed to be subject to this lien is the real
property owned by the Defendants and all of the improvements located thereon at 200
Cumberland Parkway, Mechanicsburg, Pennsylvania 17055, Tax Map No. 42-26-0243-039, .

NOW COME the Defendants, by their attorneys, wix, wenger &

3. It is admitted that Plaintiff filed a Mechanic's Lien
Claim on May 3, 2000, however, it is denied that said lien was
properly filed or that any monies are due and owing to the
Plaintiff for the reasons set forth in Defendants' New Matter.

4. The carpeting that was installed by Plaintiff was
installed in an improper manner and was defective as was admitted
to by Plaintiff's counsel.
5. In addition to the Plaintiff improperly installing the
carpet, Plaintiff also failed to properly install the cove basing,
all of which must be replaced.

6. Plaintiff improperly installed vinyl flooring in the
recovery room.
7. Plaintiff, through either its own employees or its
subcontractor, improperly installed granite tile at the Defendants'
premises, which tile needs to be replaced because of the improper
manner in which it was installed.
8. In addition to improperly installing flooring at
Defendants' premises, Plaintiff's workmen also damaged the cabinets
in Defendant's offices.
9. The costs of correcting the Plaintiff's improper work, as
well as the damages caused to the Defendants' cabinets, far exceeds
the amount of the damages claimed by the Plaintiff.
10. The Mechanic's Lien entered by the Plaintiff was in
violation of a stipulation against liens, and therefore improperly
entered.
WHEREFORE, Defendants demand judgment against the Plaintiff
and dismissal of Plaintiff's Complaint.

PLAINTIFF'S RESPONSE TO NEW MATTER
4. Denied as stated, The vast majority of the carpeting installed in the
Defendants' medical office was free of defects and installed in the proper manner. Only a
small portion of the carpeting in the lobby of the facility suffers from a manufacturing
defect or was installed improperly. By way of further response, despite the Plaintiffs
numerous offers to replace this section of carpeting at no cost, in accordance with
warranties, and during non-business hours, the Defendants have refused to allow the
Plaintiff to make such repairs,
5. Denied. It is specifically denied that the Plaintiff improperly installed cove
basing or that all the cove basing must be replaced. To the contrary, the cove basing was
properly and professionally installed.

6. Denied, It is specifically denied that the Plaintiff improperly installed vinyl
flooring in the recovery room. To the contrary, the vinyl flooring was installed in a good
and workmanlike manner, By way of further response, other contractors, not associated
with Carpet Mart, involved in the erection of the Defendants' medical office purposefully
cut portions of the vinyl flooring in the recovery room after its installation,
7. Denied. It is specifically denied that the Plaintiff, through its own
employees or a subcontractor, installed granite tile in the Defendants' premises, To the
contrary, there was no agreement between the Plaintiff and Defendants for the purchase
or installation of the granite tile. The Plaintiff had no involvement whatsoever in the sale
or installation of the granite tile. By way of further response, after the installation of the
tile, during the curing process, other contractors related to the erection of the Defendants'
medical office erected scaffolding on the tile in order to work on or near the ceiling of the
facility, thereby causing the tile to cure unevenly,
8. Denied, After reasonable investigation, the Plaintiff is without knowledge
or information sufficient to form a belief as to the truth of the allegation set forth in
paragraph 8 of the Defendants' New Matter. Therefore, those allegations are deemed to
be denied and strict proof is demanded at trial. By way of further response, the extent of
the damage to the cabinets is limited to minor abrasions to the finish.

ANSWERS TO INTERROGATORIES
1, By letter dated October 4, 2000, the Plaintiff served Interrogatories upon
counsel for the Defendants. Copies of the transmittal letter and Interrogatories are
attached as Exhibits A and B, respectively.
2, The Plaintiff did not receive responses to its discovery requests within thirty
(30) days as mandated by the Pennsylvania Rules of Civil Procedure and by
correspondence dated November 6, 2000, requested that counsel for the Defendants
provide a date on which the responses would be forthcoming, A copy of the letter of
November 6, 2000, is attached as Exhibit C and incorporated by reference.
3, Pennsylvania Rule of Civil Procedure 4006(a)(2) mandates that answers to
interrogatories be served within thirty (30) days after service of the interrogatories,
4. To date, the Defendants have not answered the Interrogatories, Further, no
explanation for the delay has been provided.

5. Pursuant to Pennsylvania Rule of Civil Procedure 40 19(a)(1), the Court is
entitled to enter an appropriate order compelling the Defendants to prepare and serve
answers to the Plaintiff's Interrogatories.
WHEREFORE, the Plaintiff respectfully requests that this Honorable Court enter
an Order directing the Defendants to serve Answers to its Interrogatories within ten (10)
days, failing which, appropriate sanctions may be entered upon the Defendants upon
motion by the Plaintiff.

5, To date, the Defendants have not responded to the Request for Production

6, The Plaintiff has been forced to cancel the deposition of Defendant, Craig
Lahar, because his deposition cannot be adequately conducted without the opportunity
to review the documents requested.
7, The Plaintiff was also forced to file a Motion to Compel Answers to
Interrogatories issued to the Defendants on or about November 15,2000.
8. Pursuant to Pennsylvania Rule of Civil Procedure 40l9(a)(1), the Court is

Chestnut Street, Lancaster, Pennsylvania 17602 within thirty days of service hereof.
A, DEFINITIONS
Whenever the word "your" appears herein and whenever the designation of
the party served with this Request for Production of Documents appears herein and
whenever any person or entity is referred to herein such word, designation, person, or
entity shall be construed to mean not only the party served with these Requests, other
person or entity in his, her, its, or their own right but also his, her, its, or their agents,
servants, workmen, representatives, employees, or attorneys, If the party to whom these

Requests are addressed is not an individual(s) "your" includes the entire entity, its divi-
sions, its merged or acquired predecessors, its present and former officers, directors,
agents, employees, and all other persons purporting to act on behalf of it or its
predecessors,
For purposes of these Requests the word "representative" includes the attorney for
the party and any consultant, surety, indemnitor, insurer, agent, adjuster, or investigator
for the party or the party's insurer,
For purposes of these Requests the word "statement" includes a written statement
signed or otherwise adopted or approved by the person making it. It also includes a
stenographic, mechanical, electrical, or other recording or a transcription thereof which is .
a substantially verbatim recital of an oral statement by the person making it and
contemporaneously recorded,
The tenn "document" refers to writings and printed matter of every kind and
description including, but not limited to, checks, bank drafts, invoices, memoranda,
photographs and drawings, graphs, charts, telegrams, letters, contracts, diaries, notes,
minutes of any board of directors or committee thereof, and records of any event, written
or oral communication and recordings (tape, disc, or other) of events or oral communica-
tions and other data compilations in whatever form from which information may be
obtained or translated through human, mechanical, or other means into a reasonably
usable form including drafts, copies, transcripts, and summaries of any ofthe foregoing

Dear Mr. Wix:
Notwithstanding my correspondence to you of January 17,2001, a copy of which
is enclosed, I have yet to receive responses to our Request for Production of Documents.
As Dr. Lahar's deposition is scheduled for February 19,2001, I must have the requested
documents by February 12th in order to adequately prepare for the deposition. If! do not
receive the requested documents on or before February 12'h, I will have no choice but to
cancel Dr. Lahar's deposition and file a Motion to Compel with the Court.
We agreed to conduct Dr. Lahar's deposition in the evening to accommodate his
schedule. Ifwe are forced to reschedule his deposition, we will do so for a time during

the business day suitable to my client. Additionally, in light ofthe fact that we have
