Plaintiff signed an affidavit of consent on September 29,2000. 5, A Notice ofIntention to Request Entry of Annulment Decree and Counter- Affidavit was sent to the Defendant by Next Day Air Mail on October 5, 2000. 6, On October 26, 2000 a Praecipe to Transmit the Record was filed with the Cumberland County Prothonotary. 7, Defendant is a citizen and resident of Mexico and is prohibited from entering the United States by order of the INS, 8, Defendant would not be allowed into the United States to attend a hearing to grant the annulment from marriage, 9, To initiate a new complaint for divorce given Defendant's place of residence would be difficult. ~=-~="="~~"'~"'- "~ ~Q ~~ - -= '~~ I ,,6-... j ). . - 10, It is the intent of both Plaintiff and Defendant to dissolve this marriage, WHEREFORE, plaintiff respectfully requests that the Court transfer this case from a cause of action for annulment to a cause of action for divorce under S 3301(c) of the divorce code, ~/L~ Craig R.
