ON 6/8/2000, KOMI BROWN CONTACTED ME BY TELEPHONE. SHE WAS AT
THE STEVENS MENTAL HEALTH CENTER AND WAS VERY UPSET. SHE STATED
THAT HER ESTRANGED HUSBAND JAMES WILLIAM ARNOLD HAS BEEN FOLLOWI
NG HER ABOUT AND AT FIRST SHE WAS GOING TO KEEP QUIET BUT SHE
IS NOW SCARED AND AFTER TALKING WITH LEGAL SERVICES BELIEVED SHE
SHOULD REPORT THE INCIDENTS.
SHE RELATED THAT ON SUDAY, JUNE 4 AT ABOUT 1700 HRS, SHE LEFT
HER EMPLOYER THE COMFORT SUITES AND OBSERVED JAMES STANDING AT
MANDY I S ABOUT 50 FEET AWAY. HE STARED HER DOWN AND MADE NO
ATTEMPT TO "GO THE OTHER WAY" AS JUDGE GUIDO HAD ADVISED HIM.
WHEN SHE LEFT, SHE DECIDED TO CUT DOWN THE ALLEY AND NOT GO PAST
HIM AT WHICH POINT HE FOLLOWED HER. ON WEDNESDAY, HE WAS WAITIN
G ACROSS THE STREET AT THE CARLISLE TAVERN WHEN SHE EXITED THE
COMFORT SUITES AT ABOUT 2205 HRS.HE MADE NO ATTEMPT TO GO AWAY.
THE INCIDENT THAT TERRIFIED HER WAS TODAY WHEN HE WAS AGAIN AT
MANDY I S WHEN SHE WENT TO WORK. WHEN SHE WENT TO LEAVE, SHE WAS
ON HER BICYCLE AND WAS ENROUTE TO HER APPOINTMENT AT THE STEVENS
CENTER. SHE OBSERVED THAT JAMES WAS FOLLOWING HER ON HIS BICYCL
E:. SHE SLOWED DOWN IN HOPES HE WOULD PASS BUT HE WOULD STOP
AND WAIT FOR HER. SHE STATED IT WAS LIKE LEAP FROG UNTIL SHE
WENT TO THE STEVENS CENTER, SHE ARRIVED FOR HER APPOINTMENT.
ACCORDING TO STEVENS CENTER EMPLOYEES, HE DID NOT HAVE AN APPOIN
TMENT AT THAT TIME. IN FACT HE WAS OFFERED A 1300 AND 1400 HR
APPOINTMENT TODAY AND TURNED THEM DOWN BECAUSE HE HAD "TO BE
AT WORK AT 1700." HE THEN CAME INTO STEVENS CENTER ON THE PRE-
TEXT OF MAKING AN APPOINTMENT.

BASED UPON THE ABOVE EVIDENCE, HE IS BROUGHT BEFORE YOU FOR
VIOLATING THE PROTECTION FROM ABUSE ORDER DATED 18 MAY 2000
THAT CLEARLY STATES HE IS NOT TO "... . STALK, HARASS,THREATEN
PLAINTIFF IN ANY PLACE WHERE SHE MIGHT BE FOUND."

IN THE CASE OF JAMES WILLIAM ARNOLD, UNDER PAROLE FROM THE
CUMBERLAND COUNTY COURT OF COMMON PLEAS.
PETITION FOR REVOCATION OF PAROLE
To the Honorable Judges of Cumberland County Courts,
WHEREAS, James William Arnold was sentenced by Judge Edward E.
Guido on June 1, 2000, at 00-2807 Civil Term, Indirect Criminal
Contempt, to pay the costs of prosecution, and undergo
incarceration in the Cumberland County Prison for not less than 1
week nor more than 6 months. The defendant to be given credit from
May 23, 2000.. It appearing that the defendant has already served
his minimum sentence, he is paroled.effective 2:00 P.M, on June 1,
2000, on cortdition that he be .and remain on good behavior, and
comply with the instructions of his Parole Officer, which shall
include, at a minimum, the following:
1, That he participate and successfully complete Anger
Management Counseling,
3. He is not to be within 1,000 feet of his wif
2. That he have no contact whatsoever with his-cw'fe.
contact means, no contact by phone, by letter,
or in person, Any contact with his wife shall be
his counselor her counsel only,
4. He shall comply with all other directions of his
Officer.
WHEREAS, on June 2, 2000, the defendant was paroled from the
Cumberland County Prison. On June 1, 2000, the defendant read or
had read to him Conditions of Parole, and prior to signing, he was
fully aware of its contents. It is noted that one special
condition was added to the Special Condition section on June 2,
2000. The defendant's current maximum expiration date on the
Indirect Criminal Contempt at 00-2807, is November 23, 2000,

1. James William Arnold has violated the Sentencing Order
Conditions of June 1, 2000, as well as Parole Condition
#1, and the special conditions of Parole, in that on June
8, 2000, he was arrested by the Carlisle Police
Department, and charged with Indirect Criminal Contempt,
The defendant was then committed to the Cumberland
County Prison with bail set at $25,000. A Parole
Violation Detainer was lodged on June 8, 2000.
THEREFORE your petitioner prays this Honorable Court to determine
whether there has been a parole violation and if so, whether the a
parole heretofore granted should be revoked.
I verify that the facts set forth in this petition are true and
correct to the best of my knowledge or information and belief.
This verification is made subject to the penalties of section 4904

THAT HER ESTRANGED HUSBAND JAMES WILLIAM ARNOLD HAS BEEN FOLLOWI
NG HER ABOUT AND AT FIRST SHE WAS GOING TO :KEEP QOI8T BOT SHE
IS NOW SCARED AND AFTER TALKING WITH LEGAL SERVICES BELIEVED SHE
SHOULD REPORT THE INCrDJ;lr.\TS,

SHE RELATED THAT ON SUDAY, JUNE 4 AT ABOUT 1.700 HRS, SHE LEFT
HER EMPLOYER THE COMFORT SOlTES AND OBSERVED JAMES STANDING AT
MANDY'S ABOUT 50 FEET AWAY. HE STARED HER DOWN AND MADE NO
ATTEMPT TO "GO THE OTHER WAY" AS JUDGE GtTIDO HAD ADVISED HIM.
WHEN SHE LEli'T, SHE DECIDED '1'0 COT DOWN THE ALLEY AND NOT GO PAST
HJ:M AT WHICH POINT HE FOLLOWED HER. ON WEDNESDAY, HE WAS WAlTIN'
G ACROSS THE STREET AT THE CARLISLE TAVERN WHEN SHE EXITED THE
COMFORT SUITES AT ABOUT 2205 HRS. HE MADE NO ATTEMPT TO GO MIlAY"
THE INCIDENT THAT TEl'&IFIED HER WAS TODAY WHEN HE WAS AGAIN AT
MANDY'S WHEN SHE WEN'l' TO WORK, WHEN SHE WENT TO LEAVE, SHE WAS
ON HER BICYCLE AND WAS ENROUTE TO HER APPOINTMENT AT THE STEVENS
CENTER. SHE OBSERVED THAT JAMES WAS FOLLOWING HER ON HIS BIevCL
E. SHE SLOWED DOWN IN HOPES HE WOULD PASS BUT HE WOULD STOP
AND WAIT FOR HER. SHE STATEO IT WAS LIKE LEAP FROG UNTIL SHE
WENT TO THE STEVENS CENTER. BHE ARIUVED FOR HER APPOINTMENT.
ACCORDING TO STEVENS CENTER EMPLOYEES, HE DID NOT HAVE AN APPOIN
'l'MENT AT THAT TIME. IN FACT UE WAS OFFERED A 1300 AND 1400 HR
APPOINTMENT TODAY AND TURNED THEM DOWN BECAUSE HE HAD "TO BE
AT WORK AT 1.700,. HE THEN CAME INTO STmlENS CEN'I'ER ON THE PRE-
TEXT OF MAKING AN APPOINTMENT.

LIVING ARRANGEMENTS:
The defendant related that he is not sure where he will be residing upon release; possibly

EMPLOYMENT:
The defendant stated that he began washing dishes at the Garden Cave, Carlisle, P A the
beginning of May 2000. Mr. Arnold suggested that he will be able to return to this employment
upon release from the Cumberland County Prison.
HEALTHIDRUGS/ALCOHOL:
The defendant claims no major medical conditions, nor does he claim to have any drug
and alcohol difficulties.

ENFORCEMENT OFFICIALS
The police who have jurisdiction over Plainti:ff's residence OR any location where a violation
of this Order occurs OR where Defendant may be located, shall enforce this Order, An arrest for
violation of Paragraphs 1 through 7 of this Order may be without warrant, based solely on probable
cause, whether or not the violation is committed in the presence of the police. 23 Pac C.S. !l6113.

Subsequent to an arrest, the police officer shall seize all weapons used or threatened to be
used during the violation of the Protection Order or during prior incidents of abuse. The Cumberland
County Sheriff's Department shall maintain possession of the weapons until further Order of this
Court. When Defendant is placed under arrest for violation of the Order, Defendant shall be taken
to the appropriate authority or authorities before whom Defendant is to be arraigned. A "Complaint
for Indirect Criminal Contempt" shall then be completed and signed by the police officer OR
plaintiff; Plainti:ff's presence and' signature are not required to file the complaint.

Subsequent to an arrest, the police officer shall seize all weapons used or threatened to be
used during the violation of the Protection Order or during prior incidents of abuse. The Cumberland
County Sheriffs Department shall maintain possession of the weapons until further Order of this
Court. When Defendant is placed under arrest for violation of the Order, Defendant shall be taken
to the appropriate authority or authorities before whom Defendant is to be arraigned. A "Complaint
for Indirect Criminal Contempt" shall then be completed and signed by the police officer OR

YOU HAVE BEEN SUED IN COURT. If you wish to defend against the claims set forth in the

to a charge of indirect criminal contempt which is punishable by a fine of up to $1,000.00 and/or up to six

under the Pennsylvania Crimes Code. Under federal law, 18 U.S.C. ~2265, this Order is enforceable

person protected under this Order, at any location, including but not limited to any
contact at Plaintiff's school, business, or place of employment. Defendant is
specifically ordered to stay away from the following locations for the duration of
this order.

4. Defendant shall not contact Plaintiff, or any other person protected under this
Order, by telephone or by any other means, including through third persons.
5. The following additional relief is granted:
The Cumberland County Sheriff's Department shaD attempt to make service
at Plaintiff's request and without pre-payment of fees, but service may be
accomplished under any applicable Rule of Civil Procedure.
This Ordlell" shall be docketed in the office of the Prothonotary and forwarded
to the SheritTfor service. The Prothonotary shall not send a copy of this
Order to Defendant by mail.
This Ordlell" shaD remain in effect until modified or terminated by the Court
and can be extended beyond its original expiration date if the Court finds
that Defendant has committed an act of abuse or has engaged in a pattern or
practice that indicates risk of harm to Plaintiff.

Defendant is hereby notified that violation of this Order may result in arrest for
indirect criminal contempt, which is punishable by a fine of up to $1,000.00 and/or up
to six months in jail. 23 Pa.C.S. ~6114. Consent of the Plaintiff to Defendant's return
to the residence shall not invalidate this Order, which can only be changed or
modified through the filing of appropriate court papers for that purpose. 23 Pa.C.S.
~6113. Defendant is further notified that violation of this Order may subject himlber
to state charges and penalties under the Pennsylvania Crimes Code and to federal
charges and penalties under the Violence Against Women Act, 18 U.S.C. ~~2261-
2262.
NOTICE TO LAW ENFORCEMENT OFFICIALS
This Order sha11 be enforced by the police who have jurisdiction over the plaintiffs
residence OR any location where a violation of this order occurs OR where the
defendant may be located. IT defendant violates Paragraphs 1 through 4 of this Order,
defendant shall be arrested on the charge of Indirect Criminal Contempt. An arrest
for violation of this Order may be made without warrant, based solely on probable
cause, whether or not the violation is committed in the presence oflaw enforcement.
Subsequent to an arrest, the law enforcement officer shall seize all weapons used or
threatened to be used during the violation of this Order OR during prior incidents of
abuse. Weapons must forthwith be delivered to the Sherifi's office of the county
which issued this Order, which office shall maintain possession of the weapons until
further Order of this court, unless the weaponls are evidence of a crime, in which
case, they shall remain with the law enforcement agency whose officer made the
arrest.

14. The facts of the most recent incident of abuse are as follows:
On about Wednesday, May 03, 2000 at approximately 10:30PM
location: 443 First Street, Carlisle, Cumberland County, Pennsylvania
On or about May 3, 2000, at approximately 10:30 p.m., Defendant ran toward Plaintiff,
who had her back to him, grabbed her arms, shoved her onto the bed, tried to hold her
down, and attempted to kick her in the abdomen. After Plaintiff got away from
Defendant, he left the residence, and she telephoned 911 for help. The Carlisle Police
responded, charged Defendant with harassment as a result of this incident, and mailed
the citation to Defendant. Plaintiff sustained bruising on her arm as a result of this
incident.
Earlier the same day, at or about mid-afternoon, Defendant threw household items at
Plaintiff, grabbed her by the arms, and shoved her against the headboard of the bed.
15. Prior incidents of abuse that the Defendant has committed against Plaintiff or the minor
childlren, (including any threats, injuries, or incidents of stalking) are as follows:
On or about April 19,. 2000, Defendant yelled at Plaintiff, caRed her vile names, and threw
household ohjects about, causing her to fear for her safety. PlaintitT telephoned the
Carlisle Police for help, and when the police responded, they diffused the situation with
Defendant, and left. Shortly after the poliee left, Defendant yelled at PlaintitT again, caRed
her names, followed her about the apartment, and threw food ahout. When Defendant
threw a cigarette butt into the garbage can, PlaintitT feared that the cigarette might still
he lit and cause a fire, and when she picked it out of the garbage can,Defendant grabbed

and twisted Plaintiff's hand, grabbed her arms, shoved her against the pantry, slapped
her in the face, and covered her mouth with his hand. Plaintiff got away from Defendant,
threatened to telephone the police, and when she tried to call, he pushed down the
receiver button disconnecting the calL Plaintiff tried several times to leave the residence,
but Defendant used his body to block her path. When she fmaBy got out of the
apartment, Plaintiff drove to a nearhy convenience store where a police crniser was
parked, and reported the incident to the police. The police arrested and charged
Defendant with simple assault, and placed him in Cumberland County Prison. A
preliminary hearing was held before District Justice Correal on April 26, 2000; the
charges were bound over for trial (June 13, 2000), and Defendant was released on bail.
On or about March 23, 2000, Defendant yelled at Plaintiff, caned her vile names,
slammed his coffee cup down on the table, grabbed her by the arms, and after she
repeatedly told him to let go of her, he struck her in the jaw with his elbow. Defendant
grabbed a tablecloth and rnbhed it into Plaintiff's eyes, scratching the surface of one of
her eyes with the cloth, causing her discomfort and vision problems for several days
afterward as a result.
On or about March 19,2000, Defendant caBed Plaintiff vile names, and kicked her in the
hand twice while wearing heavy work boots. Plaintiff sustained bruising and soreness
about her hand as a result of this incident.
On or about March 15 or 16, 2000, Defendant asked Plaintiff to come over to where he
sat on the hed, and when she did, he picked her up off of the Door and slammed her
down, causing her knees to buckle and hit the sideboard of the bed. Defendant laughed at
Plaintiff as she cried in pain.
In or about early March 2000, Defendant grabhed Plaintiff by the arms, and as she tried
to get away from him, he grabbed her hands, bent them back toward her wrists and
squeezed her hands, causing her pain.
During a separate incident in early March 2000, Defendant poked his index finger into
PlaintiWs eye, causing her pain.
16. The police department(s) or law enforcement agencies that should be provided with a copy of
the protection order are:

NOTICE TO LAW
ENFORCEMENT OFFICIALS
The police who have jurisdiction over Plaintiff's residence OR any location where a violation
of this Order occurs OR where Defendant may be located, shall enforce this Order. An arrest for
violation of Paragraphs 1 through 7 of this Order may be without warrant, based solely on probable
cause, whether or not the violation is committed in the presence of the police. 23 Pa.C.S.~6I13.
Subsequent to an arrest, the police officer shall seize all weapons used or threatened to be
used during the violation of the Protection Order or during prior incidents of abuse. The Cumberland
County Sheri1f s Department shall maintain possession of the weapons until further Order of this
Court. When Defendant is placed under arrest for violation of the Order, Defendant shall be taken
to the appropriate authority or authorities before whom Defendant is to be arraigned. A "Complaint
for Indirect Criminal Contempt" shall then be completed and signed by the police officer OR
Plaintiff, Plaintiff's presence and signature are not required to file the complaint.
If sufficient grounds for violation of this Order are alleged, Defendant shall be arraigned,

SENTENCING
ORDER OF COURT
AND NOW, this 1st day of June, 2000, the
Defendant having presented himself for sentence with Public
Defender Ellen K. Barry, Esquire, and the Court being in receipt
of a presentence investigation report, sentence of the Court is
that the Defendant pay the costs of prosecution, and undergo
incarceration in the Cumberland County Prison for not less than
1 week nor more than 6 months. The Defendant to be given credit
from May 23rd, 2000.
It appearing to the Court that the Defendant has
already served his minimum sentence, he is paroled effective
today at 2:00 p.m. on the condition that he be and remain on
good behavior, and comply with the instructions of his parole
officer, which shall include, at a minimum, the following:
1. That he participate and successfully
complete anger management counseling.
2. That he have no contact whatsoever with his
wife. No contact means no contact, by phone, by letter, by
mail, or in person. Any contact with his wife shall be through
his counselor her counsel only.
This provision shall remain in full force and
effect unless and until it is requested by his wife that it be
changed.
3. He is not to be within 1,000 feet of his
