Whereas, EDWIN E. ST!:VENS ('Contractor) of , has entered into a
contract wUh William C. Pooler ("Owner') of forthe erection or conslruction of a SINGLE FAMI~ Y DWEL~ING upon the
lot Of ground known as 1527 Walnul Bottom Road, Penn Township, CumbMan(j County, PENNSYLVANIA described in
Exhibit "A" hereof, o(which William C. Pooler is the title holder of recora; and
Whereas, (t. is the intention of OWner and Contractor that neither sailj lot of groul'ld nor the improvements erected or to
be ereeled thereon shall be subject to a lien for debts due Owner to Contractor or by Contractor to any subcontraotorfor
labor or, materials furnished in the said erection or construction, and that the right: of anyone to claim any suoh lien be
waived hereby.
Now, This Agreement Witnesseth: That Contractor, for and in consideration of the contract aforesaia and the
considerations'mentioned thereunder, as well as the further consideration of One Dollar ($1.00) to it in hand paidby the
OWner at. or before the sealing and delivery of these presents, the receipt Of which is hereby ,acknowledged, and
intending to be legally bound hereby, does hereby covenant, promise and agree. for Contractor and any and all
subcontractors, m~terj.almen, laborers and parties acting for, throu~h or under COntractor, that no mechanics'lien or
claim or other lien or claim ()f any kind Whatsoever shall be fi\ed or maintained against the building, improvements, 101 of
ground or any part hereof; or the curtilage or ourtilagos apputtenan11hereto by anyone, and that all subcontractors,
mat~rialmen and leborers shallloo~ Ii> and hold Contractor personally liable for all subcontracts, materials (umishep and
wol'i< and labor done:
And thiS agreement, waiving 1he rtght of lien by anyone, shall be an independen1 covenant and shall operate and be
effective with respect 10 work done and materials fu'mished under any supplemental contract for extra work in the,
erection, construction and completion of the building as well as to any work. and labor done and materials fumished under
the ,qontrac;taforesaid,
And, in oraer to give the Owner full power and authortty to protect Owner and the building, improvements and 101 of
gr:ound, against any and all claims filed by Contractor or anyone acting under or through Contr'a~or in violation oft~e
foregoing covenant. Contractor. hereby Irrevocably authorizes and empowers any Momey of any Court of pommon
I:'loas of the Commonweaith of Pennsylvania to appear for Contractor in any ofthesaid Coutts orCommon Pleas as
attor~ey for,Contiactor and i,n ContrMtors name, m.erk satisfied of ,ecora a1 the COsl and expen,se of the ,contractor, or of
