A Complaint
Margaret Henry .....plaintiff
Kimberley Colton Kimberleys Bridal and Spiridoula Tsarouhis .... Defendants
Docket number 0000050 - 00
Background:
My daughter ordered a wedding dress from Kimberly's of Carlisle in December 1998.
Based on measurements done by Kimberly's, and under their guidance and
recommendation the dress was ordered in a size 12. It was extremely large and
alterations were done by Spiradoula Tsarouhis. After three fitting attempts she was
dismissed with "I can't do any more for you Elizabeth you're going to have to lose some
weight"
Liz brought the dress to me for evaluation by Mary Hurd who owns Classic Custom
Clothing in Grand Rapids and in whom she knew I had complete confidence. Mary felt
the dress was unsalvagable and did not want to attempt any readjustments of the dress.
Isabelle Lott, another expert in clothing construction and design arrived at the same
conclusions. X am including her letter here for detail.
Summary:
1 )Liz' s dress size hadn't appreciably changed in this period of time. Her bust size
measured 36 inches at time of measurement by Kimberlys and I measured her at 36
inches on the morning of the trial. I know there was little fluctuation in that time period.
(I sell ballroom gowns and routinely measure clients in my line of work)
2)Tsarouhis's testimony under oath was clearly inconsistent. She denied doing anything
to the dress above the waist. In fact it is obvious that she attempted extensive alterations
to the gown. When I showed that the sleeves had been removed and replaced in a manner
that was inconsistent with industry standards she reversed her testimony and admitted
that she had in filct removed the sleeves. She claimed that she only shortened the dress
and rebuilt the veil and took in side seams. In filet she also removed and replaced the
zipper in a clumsy and ugly manner. She raised the shoulders, making the armholes too
tight and left the sleeve seams unfinished and rough making them uncomfortable to wear.
3) Since the letter from Ms. Lott was not admissible into evidence I attempted to explain
her professional findings in lay terms in testimony. My efforts to explain under oath the
alterations and destruction of the dress per evaluation from two professionals apparently
were not persuasive at the time of trial. In spite of the findings of these two
professionals, the judge determined that the dress was indeed in compliance with industry
standards.
.c,.,",,_
__ '.1--',
,'-",
""
'-~'-~
,"'r,,-,,"'--O
,- .,," ';, ,- '-.' '~--- , . "
4) Both Ms Colton and Ms Tsarouhis admitted that the veil was unsuitable fur wear. Ms
Tsarouhis said she was unable to find a suitable matching fabric even though any fabric
store carries different shades of white mesh fabric that in my opinion should not have
been difficultto match.
I requested reimbursement for the cost of the dress ($468.49) and alterations ($270) for a
total of$738.49. My cost to replace the dress was $872.76. The judge awarded me $100
against Tsarouhis for the improper alterations to the veil. Since she admitted the veil was
unsuitable I believe she should be fully satisfied with the judge's ruling in her case.
For these reasons I am requesting that you dismiss her appeal in this case.
Thank you for your consideration.

J)"1lr Margaret,
This letter is in respor..~e to your request tha! I examine your daughter's newly bough! wedding
dress. You wanted me to give my expert opinion on the alterations made to the dress, to make it
Ii! your daughter. You may use lins letter to as!itSI: you in <lny way to resolve this matiel'.
My ius! impression regarding the dress is that the retailer reeonunended too big a size for the
bride. These arc the reasons for this conclusion:
1. The bodice waS too big inthesholilders- thesleevcs were replaced on the bodice.
2. The neck was gaping- a 'hand-stitching onthe inside of the neck edge, puns and gathers
ille neck to makeitsriugger. .
3. The zipper willlremoved3l;ldreplaced to take in the bodice.
4. 111e waist wasslin too big aflerreplacingthe zipper and a clumsy c11or! to rectify the fit
with lace cov(,'redsnaps l>ver the zipper wa.~ created, taking in the waist almost an inch.
Seeondly, the workmanship ofthe alteration.~ makes this dress unwearable lor a wedding. This is
when a woman is the C':lrter of attention and wants to look beautifUlly auireu. This is what I found
upon examining the dress:
1. The pearl trirtl around thl.l neckline, the most visually importanl part oftoc dress, has
several problems:
a.. Because the sealllStress attempted to adjust the gaping fhmlll.:cklinc, she
gathered the front neckline from inside the gannent This makes the double row of
pearls, weave up alld down at lhe frOIlt neck edge. It also cre",ics puckers althe
front neck edge;
b. W11Cll Ihe back neck zipp.,"f was replaced, the neckliulJ pearl him "t the top of
the zipper is almost an inch higher on one sidc of the 7ippcr than the oth,,'!' side.
2. 'I11is zipper ,replacement was poorly excwted and detracted {Tom the dfllss" At the back

neckline, the zipper fabric placket rolls to reveal, rather than conceal the zipper. The
stitehing IH crooked, the fabric puckered in Ii ,e stitching at the hottom.Below the zipper
the open skirt seam had not been sealed amllHose ends were hanging. This open skirt
seam also rewaled ihis zipper and ii's poor workmaruJhip beneath it This open skirt seam
should have an aesthetic closure like dress tilbrie covered buttons and loops.
3. The bodiec backlaee and ii' s ~)'IDmetry was disrupted seriously at the :tipper opening.
'Ihe seamstress did not know how to handle tltis.
,t The laee covered snaps when closed at ,,-,nter back waist, made thc zippcr roll and twi~t
owr ilself Tbis appeared to be all aU;(,'mpllo iix the l1t of the waist, when the finll attempt
failed. This causes unsigilltly bulk at the back waist. The tcnsion created by the zipper TOll,
call1les the snaps 10 open. Snaps are not buutto take t(''ilSion. When this happens, these
lace covered snap tabs, dangle or protrude out from the dress back waist. This is totally
ullaec.:ptable for a wedding dress.
3. '1"h.: skev"s were J""plaeed on the bodice and the annhole scam was nol finished nor
trimmed. The seam, especiallyl.lnder the arm, should have been trimmed down and
iilli.-;hed with ovcrcasling, This'makes the armhole more comt,)rtahle to wear, and tile
seam allowance docsn't fray and thus prevents thread end~ from dangling from very shorl
sleeVI"s. Two VCJY important factors t() lqoking good on allimjJO{'Ii'lll day! Ii is also
inconsistent with the quality ofilie workmanshiplrom the manufacturer.
4. '11Jere was evidence of puck~g invariou.~bodice fronl sealllS that had been allerea.
I would recommend lhat this dress be reiwned to the retail,,'f for a fun refund of tile dress and the
allCril!IOlliJ. H is my opinion that the retailer bear.; the responsibility t(lr the gannent :md it's state,
eV<.;lIlhough heishe subcontracted 11le alteration. II was OIl the retailer's l'ecommendalJ.oIls, that the
alterations person was selected.
1 endose my resume to this letter to attest to my qualifications to make this deei~ion.
