AND NOW, come Thomas M. Shoemaker, Jr., by and through his attorney, Karl E.
Rominger, Esquire, and avers the following:
I. Thomas M. Shoemaker, Jr., is an adult individual residing at 10 Yorwick Road,
Carlisle, Cumberland County, PA 17013.
2. Kuhns-Harnish Ford, Inc., is believed to be a Pennsylvania corporation with a
business location at 6320 Carlisle Pike, Mechanicsburg, Cumberland County, P A
17055.
3. On the 4th day of June, 1999, Plaintiff agreed to purchase an automobile from
Kuhns-Harnish Ford, Inc., in Cumberland County, PA.
4. The sticker price of the vehicle VIN # IFAFP4048XFl98839 was $18,580.
5. Later Mr. Shoemaker discovered he had paid $22,580 for the automobile.
6. Mr. Shoemaker would not have agreed to purchase the automobile and/or would
have acted to rescind the contract if he had realized that he was not paying sticker
price for the automobile.

This action is brought pursuant to 73 P.S. ~201-2 through 201-9.2 and the laws of

9. The 1999 Ford Mustang VIN # 1FAFP4048XF198839 was advertised to cost
$18,580.
10.
The conduct of Kuhns-Harnish Ford, Inc., by and through its agents was confusing
it
and misleading.
11. Kuhns-Harnish Ford, Inc., did not sell the car at the advertised purchase price.
12. Kuhns-Harnish Ford, Inc., provided a series of confusing documents for the
Plaintiff, some of which listed the car sale price the same as the sticker price.
13. The acts of Kuhns-Harnish Ford, Inc., violated 73 P.S. ~201-3.
14. Pursuant to 73 P.S. ~201-9.2, Plaintiff requests this Honorable Court to provide
him with $4,000 compensation for the difference in the price he paid for the car
versus the actual sticker price.
15. Plaintiff further has incurred attorneys fees and costs involved with this suit and
requests an award of the same.
16. Further, pursuant to 73 P.S. ~201-9.2, as a statutory punitive measure this Court
should award treble damages.
WHEREFORE, Plaintiff respectfully requests that this Court enter judgment in his favor
for $4,000 plus interest and order treble damages of$12,000 be paid along with the costs of the

suit and reasonable attorney fees.
COURT II - FRAUD
17. Previous paragraphs are hereby incorporated by reference as if fully laid out herein.
18. The plaintiff was induced into purchasing an automobile with a sticker price of$18,580.

At all times relevant, Plaintiff believed that his trade in allowance would be applied to the

sticker price.

Defendant intentionally or negligently misled Plaintiff into paying $4,000 more than he
agreed to in purchase of the car.
21. Plaintiff would nofhave signed a sales agreement or committed to purchasing the
automobile in question ifhe had known that it was not going to be sold at its sticker price.
22. As a direct and proximate result of Defendant's negligent or intentional fraud in the
inducement, Plaintiff was damaged.
23. As a result of Defendant's actions, Plaintiff incurred a debt to Harris Savings Bank $4,000
in excess ofthe amount he was assenting to.
24. Plaintiff would not have purchased this automobile had he known that the sticker price
was not the sales price.
WHEREFORE, Plaintiff respectfully demands judgment in the amount of $4,000
liquidated damages plus costs of suit and attorneys fees.

1. Plaintiffs Complaint asserts that he purchased a vehicle from the

accessible to the pleader, he may state that and set forth the substance of the writings.
5. Plaintiff has failed to attached to the Complaint, copies of the contract and
the sticker that was on the vehicle, neither has he stated that he is unable to do so and
thereafter, set forth the substance of the writings.
WHEREFORE, Defendant prays your Honorable Court issue an Order requiring
Plaintiff to comply with Pa. RC.P 1019(h).

II. FAILURE TO COMPLY WITH PA. R.C.P. 1019(b)
1. Plaintiff's Complaint asserts that he was induced into purchasing a vehicle
for an amount greater than its sticker price, "as a direct and proximate result of
Defendant's negligent or intentional fraud in the inducement..." (Complaint at 1122).
2. Pa.R.C.P. 1019(b) mandates that averments of fraud or mistake must be
averred with particularity.

Plaintiff has failed to plead the averments of fraud with particularity as he

has not alleged the specific conduct of Defendant that was fraudulent.
4. Plaintiff has generally pled that he was misled and did not understand the
terms of the purchase, which pleadings are insufficient.
WHEREFORE, Defendant prays your Honorable Court issue an Order requiring
Plaintiff to comply with Pa. R.C.P 1019(b).
III. MOTION FOR A MORE SPECIFIC PLEADING
1. Plaintiff avers that the acts of the Defendant violated 73 P.S. 9 201-3, a
section of the Unfair Trade Practices and Consumer Protection Law.
2. Plaintiff does not aver with any specificity the manner in which Defendant
violated the aforementioned law.
3. The referenced section of law does not contain specific methods of doing
business that must be complied with. (A true and correct copy of the law is attached
hereto as Exhibit "A")
4. Defendant cannot respond to the Complaint without an understanding of

IV. DEMURRER - FAILURE TO STATE A CAUSE OF ACTION
1. Plaintiff avers that he purchased a vehicle from the Defendant and paid
more than the sticker price.
2. Plaintiff avers that had he realized he was paying more than the sticker
price, he would have not purchased the vehicle.
3. Plaintiff avers that Defendant was unjustly enriched because Plaintiff paid
more than the sticker price for the vehicle.
4. Pennsylvania law does not provide a cause of action based upon the
allegation that a buyer paid more than the sticker price for a vehicle.
WHEREFORE, Defendant prays your Honorable Court dismiss Plaintiffs
Complaint.

AND NOW, comes Thomas M. Shoemaker, Jr., by and through his attorney, Karl E,
Rominger, Esquire, and avers the following:
1. Thomas M. Shoemaker, Jr., is an adult individual residing at 10 Yorwick Road,
Carlisle, Cumberland County, PA 17013.
2, Kuhns-Hamish Ford, Inc., is believed to be a Pennsylvania corporation with a
business location at 6320 Carlisle Pike, Mechanicsburg, Cumberland County, PA
17055,
3, On the June 4, 1999, Plaintiff agreed to purchase an automobile from Kuhns-Harnish
Ford, Inc" in Cumberland County; PA
4. The sticker price of the vehicle VIN # 1FAFP4048XF198839 was $18580. Exhibit
A.
5. Later Mr, Shoemaker discovered he had paid $22,580 for the automobile, Exhibit B.

6. Mr. Shoemaker would not have agreed to purchase the automobile and/or would have
acted to rescind the contract if he had realized that he was not paying sticker price for
the automobile.

9, The 1999 Ford Mustang VIN # 1FAFP4048XF198839 was advertised to cost
$18,580,
10. The conduct of Kuhns-Harnish Ford, Inc" by and through its agents was confusing
and misleading as evidenced by the difference between the total cash price on the
contract and the sticker price and it thereby violated 73 P,S. ~ 201-2(4)(xxi).
11. Kuhns-Harnish Ford, Inc" did not sell the car at the advertised price and thereby
violated 73 P.S. ~ 201-2(4)(ix).
12. Kuhns-Harnish Ford Inc" provided a series of confusing documents for the Plaintiff,
some of which listed the car sale price the same as the sticker price,
13. The acts of Kuhns-Harnish Ford, Inc" violated 73 P,S. ~201-3.
14. Pursuant to 73 P.S, ~201-9.2, Plaintiff requests this Honorable Court to provide him
with $4,000 compensation for the 'difference in the price he paid for the car verses the
actual sticker price,

15. Plaintiff further has incurred attorneys fees and costs involved with this suit and
requests an award ofthe same.
16, Further, pursuant to 73 P.S. ~201-9.2, as a statutory punitive measure this Court
should award treble damages,
WHEREFORE, Plaintiff respectfully requests that this Court enter judgment in his favor
for $4,000 I?lus interest and order treble damages of $12,000 be paid along with the costs
of the suit and reasonable attorney fees.

19. At all times relevant, Plaintiff believed that his trade in allowance would be applied to

26, Plaintiff overpaid for his Ford Mustang in the amount of$4,000,
27. This $4,000 overpayment increased Plaintiff's debt on the automobile by $4,000,

PRELIMINARY OBJECTIONS TO PLAINTIFF'S AMENDED COMPLAINT
I. DEMURRER - FAILURE TO STATE A CAUSE OF ACTION
1. Plaintiff avers that in June of 1999, he purchased a vehicle from the
Defendant and paid more than the sticker price.
2. Plaintiff avers that had he realized at the time that he was paying more
than the sticker price, he would have not purchased the vehicle.
3. Plaintiff avers that Defendant was unjustly enriched because Plaintiff paid
more than the sticker price for the vehicle.
4. Pennsylvania law does not provide a cause of action based upon the
allegation that a buyer paid more than the sticker price for a vehicle.
5. Pennsylvania law does not provide a cause of action for unjust enrichment
based upon the premise that a buyer paid more for the vehicle than the sticker price.
6. A review of Plaintiffs Exhibit "B", which he signed, evidences that as a
matter of law, the document signed by Defendant did not create the likelihood of
confusion or misunderstanding nor was it fraudulent upon its face.
7. A review of Plaintiffs Exhibit "B", which he signed, evidences that as a
matter of law, the document is clear on its face.

WHEREFORE, Defendant prays your Honorable Court dismiss Plaintiffs
Complaint for failure to state a cause of action under the Consumer Protection Law, in
fraud or unjust enrichment.
II. FAILURE TO COMPLY WITH PA. R.C.P. 1019(b\
1. Plaintiffs Complaint asserts that the window sticker on the Ford Mustang
Coupe he purchased, displayed the MSRP price of $18,580. (Plaintiffs Exhibit "A").
2. Plaintiffs Complaint asserts that he paid $22,080 for the vehicle.
(Plaintiffs Exhibit "8").
3. Plaintiff asserts that "Defendant intentionally or negligently misled Plaintiff
into paying $4,000 more than he agreed to in purchase of the car through means within
the exclusive knowledge of the Defendant. (Complaint at 11 20)
4. Plaintiff asserts that he was induced into purchasing a vehicle for an
amount greater than its sticker price, "as a direct and proximate result of Defendant's
negligent or intentional fraud in the inducement..." (Complaint at 11 22).
5. Pa.R.C.P. 1019(b) mandates that averments of fraud or mistake must be
averred with particularity.
6. Plaintiff has failed to plead the averments of fraud with particularity as he
has not alleged the specific conduct of Defendant that was fraudulent. Rather, he
asserts that the means of the fraud was "within the exclusive knowledge of the
Defendant." (Complaint at 11 20)

7. Plaintiff has generally pled that he was misled and did not understand the
terms of the purchase, which pleadings are insufficient to satisfy a claim for fraud, under
the Rule.
WHEREFORE, Defendant prays your Honorable Court issue an Order requiring
Plaintiff to comply with Pa. R.C.P 1 019(b), by specifically stating the conduct of the
Defendant which was fraudulent.
III. MOTION FOR A MORE SPECIFIC PLEADING
1. Plaintiff avers that the acts of the Defendant violated 73 P .s. 9 201-
2(4)(xxi), a section of the Unfair Trade Practices and Consumer Protection Law.
2. The referenced section states:
Engaging in any other fraudulent or deceptive conduct which creates a
likelihood of confusion or of misunderstanding.
3. Plaintiff does not aver with any specificity the manner in which Defendant
caused confusion or misunderstanding, especially as Exhibit "8", which Defendant
signed, is clear on its face.
3. Defendant cannot respond to the Complaint without an understanding of
the conduct which created a likelihood of confusion or misunderstanding, in light of the
fact that Plaintiff's Exhibit "8" is does not do so.
