THIS AGREEMENT made this \+n-\- day of ~

C&C Construction, of 5745 Spring Road, Shermans Dale, Pennsylvania, hereinafter referred to as
Contractor, and Leonard R. Griffiths and Kara K. Griffiths, husband and wife, of 424 C Street,
Carlisle, Pennsylvania, hereinafter referred to as Owners, whereby the former undertook and agreed
to erect and construct a single dwelling house on that certain lot of ground situate in the Township
of West Pennsboro, County of Cumberland, Commonwealth of Pennsylvania, a description of
which is attached hereto.
NOW THEREFORE, THIS AGREEMENT WTINESSETH; that the said Contractor, for
and in consideration of the sum of One ($1.00) Dollar to C&C Construction, Contractor, in hand
paid by Owners, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in this Agreement aforesaid for themselves and their subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or
maintained by them or any of them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished by them or any of them under

buildings on the lot above described, and the said Contractor, for themselves, their subcontractors
and others under them hereby expressly waive and relinquish the right to have, file and maintain
any mechanic's lien or claims against the said buildings or any of them, and agree that this
instrument, waiving the right oflien, shall be an independent covenant.

bormded and described in accordance with a Plan prepared by Rodney Lee Decker, R.P.L.S., dated August 2,
1994 and recorded in the Office of the Recorder of Deeds for Cumberland Cormty in Plan Book 72, Page 60.
BEGINNING at a point in western right of way line of Watson Drive, at comer of Lot No. 7, of Cross
Road School Road Estates; thence along Lot No.7, North 86 degrees 09 minutes 00 seconds East 455.76 feet to
a point at lands now or formerly oflrvin H. Piper; thence along lands now or formerly oflrvin H. Piper, North
58 degrees 03 minutes 50 seconds West 405.00 feet to a point; thence along lands now or formerly ofKimba,
Inc. and Harmon Graves Company North 60 degrees 41 minutes 15 seconds East 456.07 feet to a point at Lot
No.5 of Cross Road School Road Estates; thence along Lot No.5 of Cross Road School Road Estates South 57
degrees 05 minutes 25 seconds East 479.33 feet to a point in western right of way line of Watson Drive, thence
along western right of way line of Watson Drive by a curve to the left having a radius of200.00 feet and an arc
distance of 150.00 feet (erroneously described in prior deed as 146.51 feet) to a point, the place of

BEING the same premises which Harmon Graves Company, a Pennsylvania Corporation and KlMBA,
Inc., a Pennsylvania Corporation, by Deed dated April 28, 1997, which Deed is recorded in the Office of the
Recorder of Deeds in and for Cumberland Cormty in Deed Book 157, Page 154, granted and conveyed to Derek
D. Jardine and Jane T. Jardine, husband and wife.
