COMPLAINT
AND NOW, comes Plaintiff, Mellon Bank, N, A, by and through its attorneys, SAlOIS, SHUFF &
MASLAND, and files this Complaint, alleging in support thereof the following:
1, Plaintiff. Mellon Bank. N, A, is a national banking association organized and existing under the banking
laws of the United States of America with a principle regional office located at Two Mellon Center,
Pittsburgh, Pennsylvania 17259,
2, The Defendant(s), Judy V, Windish is/are adult individual whose last known address is 95 Deerfield
Road, Camp Hill, PA 17011.
3. On or about June 12, 1997 defendant borrowed from and agreed to repay to the Bank the sum of
seventeen thousand eighty-six and 88/100 ($17,086.88) dollars ("Loan"), As security for the Loan,
Defendant executed and delivered to the Bank a mortgage ("Mortgage") on that tract of land together
with the buildings and improvements erected thereon located in Cumberland County, Pennsylvania,
known and numbered as 95 Deerfield Road, Camp Hill, PA 17011, At all times relevant hereto, defendant
remains the record and sole owner of the properly. A description of the properly is attached hereto and
made a part hereof and marked Exhibit "A"
4. On June 13, 1997 Mortgage was recorded in the Office of the Recorder of Deeds in York County in Book
1387, Page number 661. A copy of the Mortgage is attached hereto and made a part hereof and marked
Exhibit "B."
5, The Mortgage was never Assigned by the Bank and is still held by it as a valid and subsisting obligation
of Defendant
6, Under the terms and conditions of the Note ("Note"), Defendant agreed to make monthly payments to the
Bank in the amount of two hundred eighty-four and 97/100 ($284,97) dollars beginning on the fifteenth

day of July, 1997 and continuing on the fifteenth day of each month thereafter. A copy of the Note,
evidencing the Loan is attached hereto and made a part hereof and marked Exhibit "C."
7, Defendant has breached the terms and conditions of the Mortgage and Note and are in default under
such terms and conditions because he/she has failed to make the payments required in accordance with
the terms thereof.
8, Defendant is presently indebted to the Bank, as of April 28, 2000 in the amount of sixteen thousand
thirty-eight and 75/100 ($16.038,75) dollars itemized as follows:

9. Defendant also agreed under the terms of the Mortgage that in the event of default thereunder he/she
would pay, in addition to the charges listed in paragraph 8 above, costs incurred by the Bank as a result
of the institution of these legal proceedings,
10. The obligation owed by the Defendant to the Bank continues to accrue interest thereon at the rate of
three and 86/100 ($3,86) dollars per day, through the date of payment, including on and after the entry of
judgment on this Complaint, and continues to accrue late charges, and attorney's fees.
11. In accordance with the Homeowners' emergency Mortgage Assistance Act, Combined Act 91 /6 Notice,
Act of December 23, 1993, PL 385 No. 91, 35 P.S, ~ 1680A01c et seq., a notice of Intent to Foreclose
and of defendant's rights under said Act. Pursuant to the Act of January 30, 1974, P L 13, No.6, 41 P .S.
~ 101 et seq., and in particular section 403 thereof, Bank gave written notice to Defendant of its intent to
foreclose by a letter dated December 151h, 1999 addressed to Defendant, by United States mail, first
class, postage pre-paid and certified mail, return receipt requested. A copy of said Notice is attached
hereto and made part hereof and marked as Exhibit "D."

12, Copies of the mailing receipts, postal form 3811, evidencing receipt of said Notices are attached hereto
and made part hereof and marked Exhibit "E,"
13, As set forth above, Bank has made demand upon Defendant herein to cure the default under the
aforesaid Mortgage and Note, However, Defendant has refused and failed and continues to refuse and
fail to cure this default.
WHEREFORE, Plaintiff, Mellon Bank, N, A, demands judgment against Judy V, Windish, Defendant,
in the amount of sixteen thousand thirty-eight and 75/100 ($16.038,75) dollars plus interest at the rate of
three and 86/100 ($3,86) dollars per day through the date of payment, including on and after the date of entry
of Judgment on this Complaint, and costs, and for foreclosure and sale of the mortgaged property,

application to the Pennsylvania Housing Finance Agency, Your application MUST be filed or postmarked
