Smith, of Cumberland County, Pennsylvania, is about to execute contemporaneously herewith, a contract with Michael Manning and Associates, a Pennsylvania General Partnership of Cumberland County, Pennsylvania, for the erection of a dwelling upon a lot ofland situate as follows: ALL THAT CERTAIN piece or parcel ofland situate in the Township of East Pennsboro, Cumberland County, Commonwealth of Pennsylvania, being more fully described as follows: BEGINNING at a point on the dedicated right-of-way line of Sullivan Street at the dividing line of Lot No. 25 and Lot No. 26, Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143; thence by said dividing line North 39 degrees 11 minutes 22 seconds West, a distance of 149.83 feet to a point at the dividing line of Lot No. 29 and lands herein described; thence by said dividing line and beyond by Lot No. 28 and Lot No. 27, North 50 degrees 28 minutes 29 seconds East a distance of 180.95 feet to a point on the dedicated right-of-way line of Sullivan Street; thence by said right-of-way line the following three courses and distances: 1) South 03 degrees 48 minutes 20 seconds East, a distance of79.84 feet to a point; 2) By a curve to the right having a radius of 125.00 feet and an arc distance of 58.96 feet to a point; 3) South 23 degrees 13 minutes 15 seconds West, a distance of 102.33 feet to a point, the place of BEGINNING. BEING Lot No. 26 as shown on Final Subdivision Plan of Hickory Ridge, Phase I, recorded in Plan Book 77, Page 143, and being subject to all easements of record. CONTAINING 16,790.19 square feet. Page 194. UNDER AND SUBJECT TO restrictions recorded in Miscellaneous Book 608, ... NOW, the ~ \ S.t day of October, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Pamela S. Smith, to the said Michael Manning and Associates, a Pennsylvania General Partnership to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Michael Manning and Associates, a Pennsylvania General Partnership and the further consideration of One Dollar, to Michael Manning and Associates, a Pennsylvania General Partnership paid by Pamela S. Smith, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
