1. Plaintiff, Mid Penn Bank, is a banking corporation authorized to do business
in the Commonwealth of Pennsylvania, doing business as Mid Penn Bank Leasing Services, with
offices located at 5500 Allentown Boulevard, Harrisburg, PA 17112.
2. Defendant, Crider Excavating, Inc., is a Pennsylvania corporation with its
principal place of business at 555 Bosler Avenue, Lemoyne, Cumberland County, Pennsylvania
17043.
3. Defendants, Richard D. Crider and Donna M. Crider, husband and wife, are
adult individuals residing at 47 Fleisher Road, Marysville, Perry County, Pennsylvania 17053.
4. On May 16, 2005, Richard D. Crider, President of Crider Excavating, Inc.,
Defendant, and Mid Penn Bank Leasing Services, Plaintiff, entered into a Lease Agreement for
a stone trench roller TR34R, a Hamn roller #3412 and a Halla excavator #HE220C, for the term
of 60 months, with rent to be paid by Defendant to Plaintiff in the amount of $4,206. 18 per month
plus $252.37 sales/use tax. for a total monthly rental of$4,458.55, commencing on May 16,2005.
A true and correct copy of the Lease Agreement is attached hereto as Exhibit "A" and
incorporated herein by reference.
5. On or about May 17,2005, Defendants, Richard D. Crider and Donna M.
Crider, husband and wife, executed a Guaranty of Lease in favor of Mid Penn Bank Leasing

Services to guarantee payment of the aforesaid Lease Agreement. A true and correct copy of the
Guaranty of Lease is attached hereto as Exhibit "B" and incorporated herein by reference.
6. Defendants have failed to make the following rental payments when due for a
total of $16,951.30:

November 25, 2006
December 25, 2006

7. The Defendants are in default of the provisions of the Lease Agreement for
failure to make payments when due.
8. The Lease Agreement contains confession of judgment provisions which permit
Plaintiff to enter judgment against Defendants after default on the Lease Agreement, without
advance notice or an opportunity to defend against the entry of judgment.
9. Pursuant to paragraph 5 of the Lease Agreement, upon the occurrence of an
event of default, Plaintiff may declare immediately due and payable all sums due and to become
due under the Lease Agreement for the full term.
10. In accordance with paragraph 5 of the Lease Agreement, Plaintiff declares the
entire principal, interest, late charges and fees of the Lease Agreement now due and payable in
full together with attorneys' fees and costs of suit.

11. The following is the computation of the balance of principal and interest due

12. Judgment is not being entered by confession against a natural person in
connection with a consumer credit transaction.
13. Judgment has not been entered against Defendants in any jurisdiction for their
failure to make the required payments on the Lease Agreement.
WHEREFORE, Plaintiff demands judgment against Defendants in the sum of
$223,733.78 plus interest until paid in full at the rate of 18% per annum together with attorneys'
fee and all appropriate costs of suit.
