Pending the outcome of the final hearing in this matter, Plaintiff is awarded temporary custody of the following minor child/ren: 1. RYAN CHARLES WERNER 2. KELLY MICHELLE WERNER 3. CHRISTOPHER MICHAEL WERNER Until the final hearing, all contact between Defendant and the child/ren shall be limited to the following: Defendant may arrange for periods of partial custody with the children through attorneys for Plaintiff pending further Order of Court after the hearing scheduled in this matter. Defendant shall not use alcohol and/or illegal drugs prior to or during his periods of partial custody with the children. The local law enforcement agency in the jurisdiction where the child/ren are located shall ensure that the child/ren are placed in the care and control of the Plaintiff in accordance with the terms of this Order. 6. The following additional relief is granted: Require Defendant to provide Plaiutiff and the minor childreu with other suitable housing. Defendant is enjoined from damagiug or destroying any property owned jointly by the parties or owned solely by Plaiutiff. Defendant is to refrain from harassing Plaintiff's relatives audior the parties' minor children. The facts of the most recent incident of abuse are as follows: ~" - " - .),; -...' ~.' ~-~'";--,,; On about Monday, May 15,2000 location: 105 Frederick Avenne, Carlisle, P A, the marital residence On or about May 15, 2000, Defendant called Pl.aintiff viles names, stood in close proximity to her, raised his tist in a tbreatening manner as if to hit her, and threatened toshnther np no matter what it took. When Defendant saw Plaintiff telephone 911, be calmed down and left the room. Plaintiff hung up the telephone after Defendant left the room, but the 911 dispatcher called back, JUldafter Plaintiff described the incident, the dispatcher requested to speak with Defendant, who told the dispatcher that he had no problems. The Carlisle Police responded to the residence,J>laietiff reported the incident to them, and was advised to contact Legal Services, IDe. for a protection order. 19. Prior incidents of abuse that the Defendant has committed against Plaintiff or the minor childlren, (including any threats, injuries, or incidents of stalking) are as follows: Since approximately October 1999 through April 2000, two to three times a week, Defendant bas abused Plaintiff in waysinclnding, bnt not limited to, grabbing Plaintiff by her hair, raising his fISt at her in a threatening manner causing her to fear that he is going to hit her, blocking doorways by holding his arm across the door, and threatening that he wiD shut her up no matter what it takes. In or aoout 1993, Defendant raised his fist in a tbreatening manner causing Plaintiff to fear that be was going to hit her, and instead, grabbed her by the neek and shoved her. Plaintiff reported the incident to the police, Defendant was arrested, charged with simple assault, convicted, and was placed on probation in Dauphin County for 6 months. From approximately 1987 through 1993, Defendaut abused Plaintiff in ways including, but not limited to, shoving her about; grabbing the front of her clothing, shoving her down onto the bed, and pushing her against the mattress while holding his I'm over her in a menacing fashion, causing her to fear that he was going to hit her; throwing and breaking objects about the house, such as electronic equipment, and on one occassion, throwing a mailbox at Plaintiff from across the road as she stood with her back to him, grazing tile back of her leg with it. During another incident, Defendant struck the windshie1dof Plaintifi's ear and broke it. Defendant intimidated Plaintiff when he punched walls next to where she stood, and drew his rlSt back in a threatening manner, cansing her to fear that he was going to hit her. Defendant called PlaintitTnames; attempted to control her by isolating her from her friends, and told her she eould not go out with her friends unless he accompanied her. 20. The police department(s) or law enforcement agencies that should be provided with a copy of the protection order are: Carlisle Police Department 21. There is an immediate and present danger of further abuse from the Defendant. 22. The Defendant owes a duty of support to Plaintiff and/or minor child/ren. 24. FOR THE REASONS SET FORTH ABOVE, I REQUEST THAT THE COURT ENTER A TEMPORARY ORDER, and AFTER HEARING, A FINAL ORDER THAT WOULD DO TIlE FOLLOWING: a. Restrain Defendant from abusing, threatening, harassing, or stalking Plaintiff and/or minor child/ren in any place where Plaintiff may be found. b. A "Complaint for Indirect Criminal Contempt" shall then be completed and signed by the police officer OR the plaintiff. Plaintiff's presence and signature are not required to file the complaint.
