THIS AGREEMENT made the /CJ1'h day of May, 20 0, by and Iletween
KENNETH HOLTRY, adult individual, of h) ,
hereinafter referred to as Contractor, and RODNEY G. FINK a tI JENNI R R. ETTER,
single persons, of 115 Kline Road, Shippensburg, Pennsylvania, hereinafter referred to
as Owner, whereby the former undertakes and agrees -to erect and construct a single
family dwelling on:
All THAT CERTAIN tract of land situate in Southampton Township, Cumberland
County, Pennsylvania, bounded and described as follows:
BEGINNING at a set iron pin at the eastern corner of lot NO.4 on the hereinafter
described Plan of lots; thence along lands now or formerly of Robert W. Trimmer, Jr.,
South 37 degrees 30 minutes 29 seconds West, a distance of 131.80 feet to an existing
iron pin at the corner of lands now or formerly of James H. Staver, III and Stacy R. Staver;
thence along same, South 54 degrees 41 minutes 33 seconds West, a distance of 109.00
feet to an iron pin at the corner of Lot No. 1 on the hereinafter described Plan of Lots;
thence along the dividing line between Lots 1 and 4 on the hereinafter described Plan of
Lots, North 34 degrees 45 minutes 09 seconds West, a distance of 104.85 feet to a point
at the edge of a cul-de-sac at the western terminal of a 50-foot private right-of-way;
thence along a CUNe to the left with a delta angle of 65 degrees 25 minutes 46 seconds,
which CUNe has a radius of 60.00 feet, an arc of 68,52 feet, a tangent of 38.54 feet along
the edge of said 50-foot private right-of-way on a chord bearing North 33 degrees 01
minute 50 seconds East a chord length of 64.85 feet to a point; thence along same on a
CUNe to the right with a delta angle of 53 degrees 58 minutes 05 seconds, a radius of
25,00 feet, an arc of 23,55 feet, a tangent of 12.73 feet along a chord bearing North 27
degrees 18 minutes 00 seconds East a chord distance of 22.69 feet to a point; thence on
a CUNe to the right along same on a delta angle of 46 degrees 58 minutes 40 seconds, a
radius of 133.83 feet, an ar<: of 109.73 feet, a tangent of 58.16 feet, alona a chord bearing
North 77 degrees 46 minutes 22 seconds East a chord distance of 106:'68 feet to a point;
thence along the southern line of said 50-foot private right-of-way South 78 degrees 44
minutes 18 seconds East, a distance of 80.50 feet to an iron pin, the Place of
BEGINNIING.
BEING Lot No.4 on the Final Subdivision Plan for Robert L. Fink, prepared
by Eric L. Diffenbaugh, Professional Land SUNeyor, dated July 25, 1997 and recorded in
the Office of the Recorder of Deeds of Cumberland County in Plan Book -.11., Page

BEING the same premises which Robert L. Fink and Mary Ann Fink,
husband and wife, by their Deed dated May 4, 2000 and recorded May 9, 2000 in the
Office of. the Recorder of Deeds in and for Cumberland County, in Deed Book a~ 0 ,
Page .970 , granted and conveyed unto Rodney G. Fink and Jennifer R. Etter,
Owners herein.

NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One and 00/100 ($1.00) Dollar to him in
hand paid by Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for himself and his subcontractors,
and all parties acting through or under him, covenant and agree that no mechanic's liens
or claims thereto for or on account of any work done or materials furnished by him or any
of them under said COntract or otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described, and the said Contractor, for
himself, his subcontractors and others under him hereby expressly waive and relinquish
the right to have, file and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be
an independent covenant.
