The Plaintiff is Leesa E. Baker, residing at 608 Linwood Street, New Cumberland, Pennsylvania 17070. 2. The Defendant is James C. Black, Ill, residing at 210 Lambs Gap Road, Marysville, Pennsylvania 17053. 3. The Plaintiff seeks custody of the following children: JASON M. BAKER, 608 Linwood Street, New Cumberland, Pennsylvania 17070, Age 9. KELSEE A BAKER, 608 Linwood Street, New Cumberland, Pennsylvania 17070, Age 3. The children were born out of wedlock. The children are presently in the custody of the mother, who resides at 608 Linwood Street, New Cumberland, Pennsylvania 17070. The mother of the children is Leesa E. Baker, currently residing at 608 Linwood Street, New Cumberland, Pennsylvania 17070. She is single. The father of the children is James c. Black, lll, currently residing at 210 Lambs Gap Road, Marysville, Pennsylvania 17053. He is single. 4. The relationship of Plaintiff to the children is mother. The Plaintiff currently resides alone, with her children, Jason and Kelsee. 5. The relationship of the Defendant to the children is father. The Defendant currently resides alone. 6. The Plaintiff has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the minor children in this or another CQurt. According to the Mother, she filed this Petition to obtain a Court Order confirming the existing custody arrangements because the Father recently contacted her and threatened to take the Children from school. Initial report was in regard to Asia being exposed to domestic violence in January 2005 in Devils Lake with it being noted that Asia had been exposed to DV several times when the family lived in Pennsvlvania. FaCtz Second report identified that when Asia was 2 years old she was fondled by her uncle.'s girlfriend's brother Glenn Soahr. This haooened in Pennsvlvania. Asia is now dlsplavino sexualized behaviors. Fact 3 The sexual abuse case was referred to the Fargo Police Department. The case was ultimately assigned te Det LeDoux; however this worker had already received and provided information to Sgt. Skuza on 2-4-05 that this had been investigated in Cumberland County, Pa according to Asia's mother. . Please refer to E- mail dated 2-4-05 that can be found in the file. The Offender had also abused another child at the same time and was convicted and sent to prison for the abuse to second child. Asia was too young to provide information to prosecute her case according to her mother. Tracea thought that the offender was now residing in MN and is a registered sex offender; however in contacting MN, they are not allowed to provide this information to anyone but law enforcement. unless he would be considered a Level 3 sex offender. Worker did not find Glenn Spahr on the Level 3 sexual offender list. '. , Fael'! In regard to the domestic violence, Tracea. Asia's mother reported to worker that in January 2005, she attempted to reconcile with her boyfriend of 7 years. This took piace in Devils Lake where they were staying with Tracea's father. She said Daniel told Asia toga get the gun out of the closet so he could shoot her mom. Asia started to cry and Tracea told Asia to go down stairs. Dan then passed out. Tracea says that hef mother called the cops 3 days later when Daniel at let for PA. Worker contacted Law enforcement and Social Services in the Devils Lake area and no record could be found. See transcribed voice message from Ronda AJlery, Ramsey County Social SerVices. Tr<icea described that they did not leave that day because Daniel took a part from her jeep and wrecked her cell phone. She dais that her dad had him removed ftom the home, but this could not be verified by law enforcement, though law enforcement did pick up Daniel along the road by the grandfathers house after receiving a call that his friend a had kicked him out of the car. - Fact ,,- Tracea reported that her mother had the name of the officer that came out to the house and told them that if Dan ever returned to ND, he would be charged with domestic threats. She was asked to get the name of the officer to this worker and this worker never received this information. They had an appointment scheduled at the time of this workers last contact with Tracea. She described that Asia's sexualized behavior had stopped and she was no longer as concerned about Asia being depressed. Asia did say that she missed her siblinqs. FacU2 Tracea described that she went to Dr. Jacobson at the West Fargo Merit care and they put her on depression medication, Lexapro. In workers last contact with her, she had been on the medication for one month and said that she could tell a positive difference. Fact 13 Tracea said that Asia has now made friends and her behavior is much better, but she will have to go to summer school. The male perp . was charged with perpetration toward another child. Child is now displaying some sexual behavior toward adult males and peers. Mother has sought support through Rape and Abuse. The issue of OV occurred in Ramsey Co. Mother reported that this was addressed there. Worker was unable to verify this. The male is now back in Pennsylvania. Mother reports no plans to reunite. She is not aware where he is at. He has custody of two of her children. the noted that she has split and reunited with him on 15-20 occasions. She reports charges have been filed in the past. Child's abili to rotect or care for self: Asia is 7 years old and continues to need adult care and protection. She has not identified limitations. School staff generally notes that Asia is happy at school and loves to learn. Asia presented to this worker smiling and inquisitive. Asia has 2 half siblings. Jr. who is 4 years old and Brenley who is 1 year old. They are in the custody of Dan according to Tracea. Tracea said that it is a temporary order, but is afraid that because of the distance, she will have a difficult time ettin to the court hearin s. She has not mone to travel or et an attorne . L 2. Child's mental health: Tracea was concerned about Asia being depressed. As things have settled done referring to Asia staying in the same school and the family having a permanent residence vs. living with relatives, Tracea's concerns have lessened. Tracea stated that Asia talks about being sad because she is [lot able to be with her siblings or to even talk to them. L 3. Child's behavior:. Tracea did not identify any behavior problems regarding day to day activities; however concerns were raised due to sexualized behaviors specifically around her cousins and adult men. Asia is always supervised when la in with her cousins or an other cnildren and at this time is not allowed to 0 on an slee over. H Severit and/or fre uenc of abuse: Concerns of sexual abuse and exposure to domestic violence where reported. The sexual abuse case was referred to the Fargo Police Department, however it was untimely determined that the abuse took place in Cumberland County, PA when Asia was 2 years old and was investigated at that time according to Tracea. In regard to the exposure to the domestic violence, Tracea and Asia both confirmed the reported incident of Dan asking either Asia or Tracea to get the gun out of the closet so he could shoot Tracea. Tracea described years of physical abuse by Dan most of which occurred in PA She said that there were multiple police reported and protections orders and she left Dan 15 to 20 times but always went back because he would hold the children her head. The children were exposed to many of the incidences.. Asia described that Dan "fighted a lot with mom'" describing the police coming out because Dan was choking her mother, that he swore and yelled and pushed and htt her. She described that Oan threw a hammer at her mom and threw a chair at her mom. She did not she it but asked her mom why there was a dent in her door. She also said that he smacked her and Jr. on the butt with a belt, spoon or hand. She said mostly it was toward her, but sometimes Jr. was hit and it did leave red marks. L ne lect at Asia was not in school. Two situations were identified. Asia's did not re urn 0 sc 00 or v weeks following the Christmas vacation with no word from Tracea about the absence. They were also concerned that she missed a week because of strep. Tracea described that Asia has had chronic strep and gets very sick and was out of school for a week. She is scheduled for surgery on June 26, 2005 to have her tonsils and adenoids out. ".' -<, ('.' -'. L 7. Condition of home: When the case was initially reported, the family was living with Tracea's sister. Tracea ieft Asia with her sister for the month of November and returned to PA in an attempt to get her other children. Tracea is now residing 522 Countryside Trlr Court In Fargo. Because I am currently residing in the state of North Dakota, with my oldest daughter Asia, and my two younger children are temporarily residing with there father some where in Cumberland County, I write this letter in hopes that you can help me with some serious concerns I have for my children. To date, there father is not releasing his address of residency, nor is he returning my numerous phone calls, that would allow me to talk to my children. Although the temporary order states that we have shared legal and physical custody, and that I am permitted weekly visitation and then some with my children. He seems to be totally ignoring the temporary order. To start with, we moved to North Dakota as a family on December 20th. 2004 in which the court hearing was scheduled for January 13th, 2005 in which neither one of us appeared due to the fact that I was here and I believe he was too, but for whatever reason is was continued until to be rescheduled at the request of either party if no settlement is reached in this matter. The father apparently is not going forward with this matter so to seek full custody of my children, I have hired legal counsel to proceed to court with this. It js my understanding that the father Daniel Eugene Seibert Sr., is currently receiving unemployment and even though my children are currently attending daycare at Small Steps Daycare located at 125 Wolfs Bridge Road, Carlisle Pa. 17013 (717) 243-3002. I am not sure why they are there beings he is not employed and I am unsure of the hours that they are there due to the fact that the director will only tell me that they are there between the hours of9am and 5pm. I have been informed also that my son Daniel has been registered into the Big Spring School District for 2005/2006 school year. My son has a problem as his father has stated to me that he is still wetting the bed at the age of 5years. I tend to blame this on the continued domestic abuse and the disciplinary actions of his father, as he has a serious alcohol problem and controlled substance problem. I know that he is behind in his shots and he need them now if not before the school year begins. I have researched his doctors visits and he was last seen at Children's and Teen Center 2645 North 3'd Street, Harrisburg Pa 17110 (717)782-4650 on August 2nd 2003, and to my recollection, that is the last time 1 took him, there for a check-up. I also took him to the Shippensburg Family Practice 46 Walnut Bottom Road Shippensburg Pa 17257 (717)530-5117 (Walk-in Clinic) on November 5th 2004, because his father called me and told me that he was at the daycare sick. At that time he was diagnosed with Sinusitis Infection (Sinus Infection). They treated him with an antibiotic called Zithromax, he remained with me for the duration of the medication treatment as he was not allowed to be at the daycare and his father did not want to take time off work to care for him. On March 3151 , 2005, his father called me for help to fill out some paper work supposable for school. At that time his father informed me that he made an appointment for my son's physical for school at Carlisle Pediatrics 804 Belvadere Street Carlisle, Pa 17013 (717)243-1943, I informed him of the three shots my son needed before school started. He told me the appointment was scheduled for June 10th, 2005, On April 12th , 2005 I called the doctor's office which his father had told he had made the appointment only to find they had no record of that appointment and she could not verify any other future appointments for my son. His father stated to me also on March 3151, 2005, that my children do not need to go to unless they are sick and cannot be treated by over the counter medication. I have suspicioned my son to have ADD/ADHD/ODD. I have concerns about his mental health as well because of all the Domestic Violence he has seen in his life between his father and I....... I was very much abused physical, mentally and emotionally. The last known dentist visit was at Sadler Health Corporation 100 North Hanover Street Carlisle, Pa 17013(717)218-6670 on May 24th 2004. He was to return in 6 months which would have been November 2004 for a cleaning, that was never done to my knowledge. His father has stated to me several times that my son does not need routine checkups. My daughter has several medical condition that are being neglected. At the age of three months Brinley was taken to Carlisle Pediatrics on July "fh, 2003 because she was experiencing excess coughing, vomiting and not eating. She was losing weight. At that time they diagnosed her with a vira1 flu. I did not agree with the diagnoses and wanted a second opinion, I took her to Carlisle Hospital; they also diagnosed her with viral flu on Tuesday July 8th, 2003. On July 9th, 2003 I took her back to Carlisle Pediatrics because she had signs of dehydration. Again they told me nothing was wrong. On Thursday, July 10th ,2003, I gave Brinley a bath and laid her down to dress her, she turned coughed until she could not get air and turned blue. I called 911 and the ambulance transported her to Carlisle Hospital repeatedly said nothing was wrong and wanted her to stay over night for observation. I stayed with Brinley, and two times she turned blue on two occasions during the night, and had to be suctioned. On Friday July 11 II>, 2003 the doctors this time had diagnosed her with severe asthma. Some thing inside of me told me to have her transferred from Carlisle Hospital to Hershey or Harrisburg. They transferred her to Harrisburg, by ambulance she was there from Friday, July 11 th ,2003 to Tuesday, July 15th , 2003. She needed several medications, two monitors, and IV's for her dehydration. Within three hours she was diagnosed with a heart murmur (Bicuspid Aortic Valve- She has two leaflets instead of three.) This is a heart condition that needs to be monitored and that she will never grow out of, At any given time she can start having problems with no signs. That is why it is so important, I can't stress the importance of having our daughter keep her checkup appointments '-h &/f1iiA 'W with the heart doctors. This is something that cannot be set aside. Our daughter is also suppose to have 2 flu shots because she is very prone to pneumonia and other respiratory infection because of the RSV. She was also diagnosed with a right lung deformity. Her father was not at the hospital at any time to speak with the doctors about his daughters conditions or diagnoses. I stayed day and night at the hospital, and only went out side for short in intervals. I fear that not having this knowledge of his daughters condition could result in serious complications or even death, and this scares me to think that he doesn't think that our children do not need medical checkups. Dan has never and I say never been to any of our daughters medical appointment so there for he has no idea of the signs to watch for. When he left North Dakota he was more concerned to take all my pictures of my children yet leave her nebulizer that she very much needs, in the event that our daughter begins any signs of respiratory infections or wheezing even from a common cold. He is unaware of what to do should our daughter need any dental treatment including cleaning. The last doctor appointment, that I am aware of at Franklin County Pediatrics 175 South Cold Brook Road Chambersburg Pa 17201 (717)263-0550 on October 12111, 2004. She was diagnosed with double ear infection after being with her father for one month. They placed her on Antibiotic and a different nebulizer medication., I kept her with me following that appointment until court order became in effect on October 22nd, 2004 at which time when her father took she was well when she left my care. On one occasion her father had made arrangements for his sister to take our daughter to an appointment on November 21",2003, due to me being in surgery with my oldest daughter. His sister left with out having our daughter seen by her doctor, when asked why she did this she stated it took to long. Her father had made these arrangement because he didn't feel it was necessary to take time off work. I spoke with a her nurse on Apri112'h, 2005 and she stated to me that is has been a year since our daughters last appointment. She also informed me that the appointment made for October 20th, 2004 was not kept either. I am sure ifI was closer and would be able to visit my children on a weekly basics, I would be able to document other health issues/or abuse and neglect with my children. I know there father has not stopped drinking nor his drug habits. I was also made aware of his most recent "F-k" partner as there father puts it, also has a drug habit. I do not agree with her being around my children because I have no idea what drugs she is taking and what effects they have on her. He claims he doesn't even know her last name, which is pretty scarey in it self. I do not know if she care for my children when there father is not around and that raises concerns with me. What would happen per say if she went thru a withdrawal, bad high, Having to go with out drugs, the stress of my children, because apparently she has none of her own. ???? Their father uses drug in front of my children and my son refers to it as a "stinky" cigarette. There father deals drugs to know individuals. He will sell drug by going and visiting for one to two hours with our children being there. He "weighs" and "wraps" joints in front of our children. My oldest daughter that resides with me is quite knowledgeable and can confirm this as well. Like I have said previously he is a drinker and starts drinking around 4:30-5:00pm every day. There has been times when he has left the keys in the door, went in and passed out. Now you tell me how safe that for my children? He drinks and drives with my children, I might add with a suspended license. So how can he be insured??? How can my children be insured??? His -.;>-" ,~~ . .' He also served time in Cumberland Country Prison for a prior DUI convection. This could have happened when my children were in the car, but thank God it hasn't so far. One night while drinking he hit a pole and didn't even remember hitting it ..... he then suggested that I load the kids up and take them and him to his mothers so if the police came he would not be there. He passed out directly after that. Our children and I remained at the house...... How safe is that for my children??? He allows then to beer and alcohol, even giving them there own drinking cup. Great future for them to look forward to!!! There father is a drunk and he is teaching them how to become one.... How legal is this? My daughter was a year old and could pick out her fathers kind of beer (Bud Light) out of the recycle bin among other similar looking cans like Pepsi, Bush and Natural Ice. Her father would just laugh and say his child was very smart. I don't believe its all intelligence, I believe that she could do it cause she saw him with so many. Both of my children have been left unattended sleeping in the car while their father is in the house doing unknown things. The last known date of this was on March 2Jh, 2005 as I was on the phone with their Dad. On one occasion, I lived at 27 Chestnut Street in Mt. Holly Spgs. Pa. In Aug 2003, I had went over to Dan's which lived at 20 East Street, Mt. Holly Spgs. Pa . That is .86 of a mile. He had the children for the night, I went over to talk to drop Brinley off and he wanted to reconcile our relationship, and during that visit, I found a girls phone number and went home. Daniel came approximately two minutes later here comes Daniel without the children, yes they were .86 mile away in a home all by themselves. He started to argue and I told him to get back home to them children and not argue with me, after three times of me telling him that he finally left, I called the police and he was there before the police got there. On several occasions he wi1l1eave the kids in the car and run into a bar and get some beer. The bars had no windows so he could not see the kids while he was inside the bar and he leaves the car mnning. Now with all the children disappearing these days and being raped and killed, CAN you imagine getting a call such as that because of neglecting to watch my children??? That would be horrific. My children are not being safely supervised. My children are being left with 12, 13 year olds. The last known incident was on April 1 0'1>, 2005. Brinley was being watched by their father's sister's children which is about 9 or 10. I am unsure of the age but know all these children still remain in elementary school except for one. What father would let their daughter stay with children with no CPR training knowing that their daughter has had previous medical conditions to the point oftuming blue from that lack of oxygen??? When I ask Dan on AprillO'h,2005 what they would do if Brinley started coughing and tuning blue?..He replied, "probably run out the door screaming" now what good would that do??? Her condition can be verified by medical records that I have had sent to me from her medical physicians. MENTAL AND PHYSICAL ABUSE TO BOrn MYSELF AND MY CHILDREN My children have been exposed to a lot of domestic violence. They have been very unstable due to the fact that every time I left he would tell me that he would never do these things to me again and I would believe him and go back so that I could be together with the children but it would '!" ' . . not last very long and he would start the abuse again. I have had hammers thrown at me, milk poured over my head, been told not to come out of the bedroom, I was not allowed to talk to my family on the phone. If I did he would pulled the cord out of the wall or cut the cord. My family has called the police on him from North Dakota and when the police came he made me stay in the bedroom and not come out. If! called the cops on him given the chance he would tell me that ifhe gets arrested, it would be three times worst when he got out. My mother often told me that I would probably end up like Terri Shaivo ifl stay there. My family feared what he might do to me. My oldest daughter came to stay with Gramma for a visit and my mother said that she told her horrible things that Daniel did to her and to her Mommy. I don't regret moving to North Dakota to be near my family because I knew that they would not tolerate the abuse and that my children would be in a better enviromnent. It was getting to where I feared for my life. I was diagnosed with a severe case of depression. My sister older sister had Christmas at her house this year and Daniel and myself and my children were there. Right away they were upset that he was driving with the children in the car but being Christmas Eve, she didn't want to make a big deal out of it. And then she saw Dan pick our son up by his neck to discipline him for something she said was really nothing much. By this time she was furious and was not her jovial self at Christmas because of Dan. We did not stay very long. We went back to my father's house. . Lastly, on January 3rd, 2005 Daniel was drinking again, and started in on me again, I was upstairs with my children and he started arguing with me I sent the children downstairs and kept telling Dan to just go to bed. At that time he told my oldest daughter "to get the gun out of the closet, he was gonna kill her momma" My daughter was so scared. I left and went to call my mother cause I feared that he might kill me. My mother said that your Dad is there and he will not let anything happen to your kids and for her to come to her house and stay away from him. She was so scared she too was crying pleading with me to get away. Daniel would take wires off my vehicle so that I could not use it unless he was in it, he broke my cell phone and cut wires on my computer. He basically destroy all communication devices that I had. I didn't want to leave my children there but I knew that my Dad would keep them safe. Dan called the Sheriff's office and told them he had to leave the house. When the Sheriff arrived, he took Dan to the Red Cross so my mother was told, put him up for the night, but she was not sure. She did explain however to the Sheriff what Dan did to her granddaughter but by the time she finally did get a hold of the Sheriff that went out there that night, Dan was already on his way back to Pa. So she made the report but there was no arrest made. If Daniel comes back to North Dakota I am assuming that he will be arrested for terroristic threats as far as what the Sheriff told my mother. Christmas presents and new clothing for my daughter. He packed up unimportant things like pictures, tools, stereo, and he failed to take our daughter's nebulizer her medication andChristmas presents and new clothing for my daughter and son. After him leaving N.D. I have tried to call my children on several occasions and in failed attempts get no information on them. I have left several messages on their father's phone wanting them to call me so that I could talk to them. (Have phone bills to verify this facts) but he would not return my calls. ',~.,- , .. . " Then all of a sudden about a month ago he started calling, and still have not taken the children to the doctors and is still using drugs and alcohol and then going to a party for wrestle mania where there was gonna be drugs and alcohol and then he took the children to this party, at least our son, unsure if Brinley was there or at a sitters house. After knowing all these facts, I don't think this is in the best interest of my children nor when he tells me to call after 9:00 at night maybe he would let me talk to my children cause it cost money. Well what are the children doing up as late as 11 :00 when I have called because I could not get a hold ofhim any earlier? I have explained that our son should be put on a schedule cause he will be going to school soon and he will not being able to stay up late like he does and he said "he goes to bed when he wants to and I guess that he will find that out when he falls asleep in school. I have been reported to your office on numerous occasions and said that if! needed help caring for my children I would inform them, so this is the attempt to get that help. He was never investigated or drug tested when you office was contacted for investigation on me. I know that he will not do a drug test for you and he knows that he don't have to so that may be impossible for me to prove to you. It seems that if it came to keeping the children verses taking a drug test. . I have been also investigated by Cass County Social Services in Fargo, ND due to a request by me. They also interviewed my daughter, they could be of more assistance on what they've obtained and what they learned from their investigation and verify the report they took from my daughter that resides with me while she was school I want to hope that you will give this your immediate attention where my children are concerned and I hope that you don't let him pull the wool over your eyes like he has done to others so many times and walks away. I would never forgive myself if I didn't speak out about all this and I would never forgive your office if something should happen to my children after you have receive this letter as my cry for help I would also like to know who, from your office, will be investigating these reported allegations. Mommy has been looking for a job and a house for me and Asia to live in. Asia has been busy with school work and after school activities. Asia get a lot of homework to do after school. Mommy hopes real good, but I don't know cause you haven't called. Asia and I are doing good. I work a lot and Asia goes to school.. She get a lot of homework to do though. Asia will soon be out of school for the year and then it's off to all the vacations spots she wants to go. She is ready for school to be over. I never thought I wo~ld say this but so is mom ready for it to be over. I can't wait till she is out. She is getting lots better at reading and hopefully she will be able to read you a book when you come to mommy's. She is also getting a lot better at spelling here words. She got 100% on her test last week. She earned a trip to the steak house. We went last night and she enjoyed it. If she gets 100% again she will go to either Apple B's or Red Lobster it is really up to her. She will get to pick. Mommy was really proud of her though. She is getting really close to the day she is going in for surgery they changed it to June 6th, 2005 so she wouldn't be laid up during the middle of summer. Mommy is trying to see if you two can come down for the summer. I haven't got any answers yet but I am sure I will be hearing something real soon. I hope I hear some thing by the end of May. I hope you two come because Asia and I have lots of things planned. She is really excited about going to the water slide park but wants you both to be there two. We are going to see the underground aquarium at Mall of America in the Cities. I think that will be lots of fun. Mommy will let you know what's going on when I know. Brinley! How are you doing?
