DEARDORF, Defendant COMPLAINT AND NOW, comes the Plaintiff, DriveKore, Inc., by and through its' attorney Charles Rector, Esquire, and avers in support of its Complaint against Defendant, John E. Deardorf, as follows: 1. Plaintiff, DriveKore, Inc., is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, with a principal place of business located at 36 West Allen Street, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Defendant, John E. Deardorf is an adult individual residing at 465 Red Mill Road, Etters, York County, Pennsylvania, 17319. 3. On or about August 20, 1999, Plaintiff provided Defendant with repair services including labor and parts on a piece of equipment known as a Spectra 945 SIN 3296, Tag No. 63827. A true and correct copy of the Invoice for this labor and materials is attached hereto, incorporate herein and marked as Exhibit "A." 4. Despite repeated demands for payment, Defendant has failed, and or refused, to pay the total principal balance owing of $560.45, or any part thereof. c_ " ~ ..~- .. 5. Pursuant to the terms of the invoice, eighteen (18%) percent interest is to be charged annually to all invoices not paid within thirty (30) days of the date of the invoice. No payment has been received by Plaintiff from Defendant. Therefore, in addition to the principal amount, interest at eighteen (18%) percent is due. WHEREFORE, Plaintiff, DriveKore, Inc., demands judgment in its favor and against Defendant, John E. DEARDORF, Defendant CIVIL ACTION - LAW ANSWER TO DEFENDANT'S NEW MA TTER AND NOW, comes the Plaintiff, DriveKore, Inc, by and through its' attorney Charles Rector, Esquire, and avers the following in response to Defendant's Answer to Plaintiff's Complaint, which Answer shall be treated as a New Matter: 1. Admitted in part and denied in part. It is admitted that the work was not completed in one or two days. It is denied that it was promised that work could be completed in one or two days and strict proof thereof is demanded. By way of further answer, Plaintiff determined that the "speed control" was broken, which problem would cost approximately $500.00 to repair, plus an additional fee for calibration. Defendant then advised Plaintiff to not repair the "speed control" problem but rather requested that the unit be calibrated on or before July 5, 1999. 2. Admitted. It is standard practice and procedure in the construction industry for bills of this nature to not itemize specific hours for specific services. Such an itemization as never before requested by Defendant. To the extent that any further answer is required, upon examination of the laser on June 23, 1999, Plaintiff determined that additional parts were broken, a washer missing, and that the speed switch had "dead spots" and that the gimbal screw was cross-threaded. Defendant was again contacted by Plaintiff, advised of these facts, and further advised that re-tapping of the =,J <~ _ e . . .," > gimbal (re-threading) be attempted and if successful would save Defendant approximately $200.00 in parts. This was accomplished by the Plaintiff. In addition, Defendant was contemporaneously notified that due to these additional problems, work could not be completed on the calibration by July 5, 1999. 3. Denied. It is denied that the rotor on the equipment will not operate in a counterclockwise direction and further denied that it is not as variable in a clockwise direction as before and strict proof thereof is demanded. By way of further answer, Plaintiff advised Defendant, on or about June 21, 1999, that because Defendant's laser was approximately twenty (20) years old, it may not be worth fixing due to the costs involved. Defendant nonetheless advised Plaintiff to proceed. 4. Denied. It is denied that the laser is out of level Y:z inch and 300 feet and strict proof thereof is demanded. By way of further answer, the instrument was properly calibrated when it left Plaintiff's possession. 5. Denied. Defendant has at no time questioned the accuracy of the bill and it is specifically denied that the mark-up for materials is excessive. By way of further answer, work was completed on July 22, 1999, after numerous requests that Defendant pick up his laser, it was finally delivered to him on August 19, 1999, by Plaintiff. During October of 1999, Plaintiff contacted Defendant twice and sent to letters. In November, 1999, Defendant was contacted again by telephone. In December, 1999, Defendant was contacted by telephone and letter by Plaintiff. Finally, in February 2000, Plaintiff left a message with Defendant about his account and received no response from him regarding work performed or accuracy of the bill. --.. -~- WHEREFORE, Plaintiff demands that Defendant's Answer to Complaint, which is treated herein as New Matter, be dismissed with prejudiced.
