CORNMAN I, , hereinafter referred to as Owner, whereby thtJ former undertook and agreed to erect and construct a Dwe 11 i ng on that certain lot of ground situale in I , :1 Upper Frankford Township, Cumberland County, pennsylvania, more particularly described as follows: BEGINNING ata point in the public road leading from Carlisle to Doubling Gap Sulphur Springs and on line of land now or fonnerly of Mathias COInrey; thence by the same, South ten and one-half (I 0 1/2) degrees East, thirty-three and five tenths (33.5) perches to a walnut; thence by land noW ot formerly of David Mitten, North eighty-one (81) degrees West, thirteen and four'tenths (13.4) perches to a post; thence South sixty-five arid one-half (65 1/2) degrees West, eight and nine-tenths (8.9) perches to a post; thence by land now or formerly of Christy " Failor, North, ten ana one-half (1 0 1/2)'degrees West, forty-five and four tenths (45.4) perches to a stone in the center of said road; thence along said road, South si1{ty-six and one-half (66 1/2) degrees East, twenty-five and two-tenths (25.2) perches to the place of BEGINNING. CQNT AINING 5 <teres 20 perches. BEING PART OF THE SAME PREMISES an undivided one-half (1/2) interest in which was conveyed by Joanne Ross, Lee A. Clouse and 1. Edward Clouse, Executors of the Estate of Beulah M. Clouse, by deed dated October 27, 1998 and recorded in the office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Cumberland County Deed Book 187, Page 1053, unto Lee A. Clouse and Patricia A. qouse, husband and Wife, and Galen R. Clouse and Wanda L. Clouse, husband and wife, the Grantors herein (and being all of Parcel B of Tract 3 of that deed. And also the remaining undivided one-half (1/2) interest was vested in the Grantors by virtue of the following deeds: 1. Deed of Lee A. Clouse, 1. Edward Clouse, and Joanne Ross, Executors of the Estate of John H. Clouse, of Cumberland County, Pennsylvania, and Beulah M. Clouse, of Newville, Cumberland County, Pennsylvania, dated March 26, 1984, recorded in Deed Book "R", Volume 30, Page 242 (which deed was re-recorded in Deed Book "D", Volume 31, Page 1 081.); and 2. Deed of Charles L. And Joanne D. Clouse dated March 30, 1990 and recorded in Cumberland County Deed Book "M", Volume 34, Page 275. NOW THEREFORE, THIS AGREEMENT WITNESSETH, That the said Contractor, for and in consideration of the sum of One ($1.00 t Dollar to in hand paid by Owner, the receipt whereof is hereby QC:~ knowledged, and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all partjes acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or mainlained by them or any of them against the said buildings and the lot of ground appurtenant therelo for or on account 'bf any work done or materioh furnished by them or any of them under said contracl or otherwise, for, towards, in, or about the erection and construclion of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to hove, file, and maintain any mechanic's liens or claims againsl the said buildings or any of them, and ogree that this instrument, waiving the right of lien, sholl be an inclepertdent covenant.
