MECHANICS' LIEN CLAIM
Claimant, McCoy Brothers, Inc. ("McCoy Brothers"), through its counsel Rhoads &
Sinon LLP, files this claim against the improvements and property at Empire Global Cuisine,
149 North Hanover Street, Carlisle, Pennsylvania 17013 ("Property"), for payment of a debt due
to McCoy Brothers as a contractor for labor and materials furnished by McCoy Brothers in the
alteration and repair of the restaurant located thereon. In support of the claim, McCoy Brothers
makes the following statement:
1. The record owners of the Property are Jerry H. Bogar, II and Caroline M. Bogar
who reside at 432 Franklin Street, Carlisle, Pennsylvania 17013.

2. The improvements and the Property which are the subject of this claim are the
renovations to the Empire Global Cuisine Restaurant located at 149 North Hanover Street,
Carlisle, Pennsylvania 17013. The subject property is more fully described in Deed Book
Volume 176, Page 248, 249, 250, and 251 recorded in the Recorder of Deeds' office in
Cumberland County, Peunsylvania. A true and correct copy of the pages from the Deed
containing the legal description of said Property is attached as Exhibit "A."
3. The labor and materials for which this debt is due were furnished pursuant to a
written contract with Cup of Joe, Inc. dated May I, 1998, a copy of which is attached hereto as
Exhibit "B."
4. Jerry H. Bogar, II is the President/CEO of Cup of Joe.
5. The labor and materials for which this debt is due were for the renovations to the
dining and kitchen areas of the restaurant and for renovating the front of the building, all in
compliance with the contract attached hereto as Exhibit "B."
6. McCoy Brothers last worked at the property on April 6, 2000, which is less than
four (4) months before the filing of this claim.

7. McCoy Brothers has been paid $193,995 toward the debt due it for the stated
labor and materials, and there is a due and owing balance of $20,171 for which claim is being
made of$20,171.

Demolilion of existing plumbing fixtures at both localions, disconnection of gas
equipment, cap waler. drain. gas lines as needed, removal of commercial hot water
healer and grease trap 10 new location.
Demolilion of concrete for rough in of underground plumbing and gas piping in the
kitchen area. ( This includes demo of concrete and removal from site. replace dirt in Ihe
trenChing as needed.)

chimney.)
Rough in for new sinks as per plnns, PVC drain, waste Bnd venl piping

Scope Of Work:
Provide a complete and iunc:tional elecbical system as per the plan numbered PEl
dated 1.9.98 by Harle Architects and the following additional specifications and
clarifications which take precedent over all other plans or specifications whether
written or implied.
1. New electrical service shall be single phase. 400 amp. overhead.
2. Cooking equipment shall be gas except for convection oven.
3. Price includes wiring for ~ 'J'and rear exterior fIXtures but excludes
furnishing these fIXtures since no type was specified.
4. Price includes wiring of 1- 5 ton and 1- 3.5 ton roof top HV AC units. 1- gas
furnace and 1- electronic air deaner as specified by F M Berkheimer
5. Price excludes any phone or computer wiring.

Claimant, McCoy Brothers, Inc. ("McCoy Brothers"), through its counsel Rhoads &
Sinon LLP, files this claim against the improvements and property at Empire Global Cuisine,
149 North Hanover Street, Carlisle, Pennsylvania 17013 ("Property"), for payment of a debt due
to McCoy Brothers as a contractor for labor and materials furnished by McCoy Brothers in the
alteration and repair of the restaurant located thereon. In support of the claim, McCoy Brothers
makes the following statement:
1. The record owners of the Property are Jerry H. Bogar, IT and Caroline M. Bogar
who reside at 432 Franklin Street, Carlisle, Pennsylvania 17013.

2. The improvements and the Property which are the subject of this claim are the
renovations to the Empire Global Cuisine Restaurant located at 149 North Hanover Street,
Carlisle, Pennsylvania 17013. The subject property is more fully described in Deed Book
Volume 176, Page 248, 249, 250, and 251 recorded in the Recorder of Deeds' office in
Cumberland County, Pennsylvania. A true and correct copy of the pages from the Deed
containing the legal description of said Property is attached as Exhibit "A."
3. The labor and materials for which this debt is due were furnished pursuant to a
written contract with Cup of Joe, Inc. dated May I, 1998, a copy of which is attached hereto as
Exhibit "B."
4. Jerry H. Bogar, II is the President/CEO of Cup of Joe.
5. The labor and materials for which this debt is due were for the renovations to the
dining and kitchen areas of the restaurant and for renovating the front of the building, all in
compliance with the contract attached hereto as Exhibit "B."
6. McCoy Brothers last worked at the property on April 6, 2000, which is less than
four (4) months before the filing of this claim.

7. McCoy Brothers has been paid $193,995 toward the debt due it for the stated
labor and materials, and there is a due and owing balance of $20,171 for which claim is being
made of$20,171.

Provide a complete and functional electrical system as per the plan numbered PEl
dated 1.9.98 by Harle Architects and the following' additional specifications and
clarifications which take precedent over all other plans or specifications whether
written or implied.
1. New electrical service shall be single phase. 400 amp. overhead.
2. Cooking equipment shall be gas except for convection oven.
3. Price indudes wiring for ~ 'J' and rear exterior fixtures but excludes
furnishing these fIXtures since no type was specified.
4. Price includes wiring of 1- 5 tpn and 1- 3.5 ton rooftop HVAC units. 1- gas
furnace and 1- electronic air deBner 5 specified by F M Berkheimer
5. Price excludes any phone or computer wiring.
6. Price does not include any work fer second floor apartment service.
7. Oemorrtion in this proposal includes only de-energizing all existing wiring tp .be
