Zulli, Esquire, and hereby files this STATUTQRY APPEAL FROM DRIVER LICENSE SUSPENSION, for the following reasons: 1. Petitioner is a resident of Cumberland County, residing at 6245 Stanford Court, Mechanicsburg, PA 17055. 2. Petitioner possesses a valid Pennsylvania driver's license, number 24113721. 3. By official notice dated and mailed May 15, 2000, petitioner's operating privilege was suspended for an indefinite period due to a failure to take a special driver's examination. A copy of the notice of suspension is attached as Exhibit A. 4. On March 17, 2000, Petitioner's daughter was cited for speeding, a violation of Section 3362 of the Vehicle Code. -'lliIt ...~, 5. Petitioner's daughter told the police officer that she was Barbara Courtney. 6. The police officer obtained Petitioner's driver's license by asking for it through the police radio, and wrote a citation to Petitioner for traveling 80 mph in a 45 mph speed zone. 7. The police officer handed the citation to Petitioner's daughter, and petitioner's daughter promptly paid the citation at the District Justice's office. 8. When the District Justice reported the paid citation as a conviction to the Department of Transportation, PennDOT assigned points to Petitioner's driving record which resulted in Petitioner being notified by PennDOT that she had to take a special driver's examination. 9. After Petitioner received this notice, Petitioner's daughter, who resides with Petitioner, then told Petitioner what she, the daughter had done about misrepresenting her identity to the police officer. 10. Petitioner refused to take the driver's examination because she did nothing wrong to warrant having to take the examination. 11. When Petitioner's attorney contacted PennDOT, he was advised by the Assistant Chief Counsel of the Vehicle and Traffic Law division that PennDOT could not do anything and that Petitioner would either have to take the special exam, or wait until she was suspended and file an appeal with the Court of Common Pleas, in order to obtain a stay of any PennDOT action. 12. During the stay ofthe PennDQT appeal, Petitioner is trying to have the convictions reversed by filing an appeal nunc pro tunc ofthe underlying criminal citations. 13. Petitioner has a statutory right to appeal the suspension of her operating privilege pursuant to Section 1550 of the Vehicle Code and Section 933(a) ofthe Judicial Code, and the filing of the appeal entitles Petitioner to an automatic supersedeas of the suspension of her operating privilege. ,ur- _.; , , WHEREFQRE, Petitioner requests that the suspension imposed be rescinded and removed from her record. ;;;;Fj,t Philip L. In order to comply with this sanction yOU are required to return any current driver's license, learner's permit and/or temporary driver's license (camera card) in your possession no later than the effective date listed. If you cannot comply with the requirements stated above, you are required to submit a DL16LC Form or a sworn affidavit stating that you are aware of the sanction against your driving privi- lege. Failure to comply with this notice shall result in this Bureau referring this matter to the Pennsylvania State Police for prosecution under SECTION 1571(a)(4) of the Ve- hicle Code. WHEN THE DEPARTMENT RECEIVES YOUR LICENSE OR ACKNOWLEDGE- MENT, WE WILL SEND YOU A RECEIPT. IF YOU DO NOT RECEIVE THIS RECEIPT WITHIN 15 DAYS CONTACT THE DEPARTMENT IMMEDIATELY. OTH~~WlSE, YOU WILL NOT BE GIVEN CREDIT TOWARD SERVING THIS SANCTION. The effective date of suspension is 06/19/2000, 12:01 a.m. Please see the enclosed application for restoration fee in- formation. You have the right to appeal the Department's action to the Court of Common Pleas (Civil Division) within 30 days of the mail date (MAY 15, 2000) of this notice.
