WHEREFORE, Defendant respectfully requests this Honorable Court to Dismiss Plaintiff's
Complaint and enter Judgment in favor of the Defendant
NEW MATTER
13. Defendant's avennents 1 through 12 are incorporated herein.
14. Plaintiff supplied defective concrete that was below industry standard and of a quality not
as promised by the Plaintiff.
15. Defendant requested concrete that had a strength of 3,500 P.8.r.. Plaintiff supplied
concrete that when subsequently tested at Defendant's request had an average strength in
excess of 7,260 P.S.L (Exhibit #1).
16. The concrete supplied by the Plaintiff with such an excessive P.S.L can not be finished
properly any causes the top of the concrete to separate when it cures.
17. The estimated cost to repair the faulty and defective concrete areas is $5,000.00 (Exhibit
#2).
WHEREFORE, Defendant demands judgment against Plaintiff in the amount of
$5,000.00, together with interest plus costs of suit

COMPLAINT
AND NOW comes the Plaintiff, Hempt Bros., Inc., by and through its counsel,
Michael L. Bangs, Esquire, and in support thereof files the following Complaint:
I. Plaintiff, Hempt Bros., Inc., is a Pennsylvania corporation with its principal
place of business at 205 Creek Road, Camp Hill, Cumberland County, Pennsylvania.
2. Defendant, ERIC STONE, is a an adult individual who trades or does
business as Four Gables Construction, with an address ofR.D. 4, Box 4815, Duncannon,
Perry County, Pennsylvania
3. Plaintiff is in the business of, among other things, providing various building
materials for highways and other construction projects, said materials including crushed
stone, sand, transit mix concrete, and other asphalt material.
4. Defendant contacted Plaintiff and requested the Plaintiffto provide Defendant
with concrete upon a C.O.D. basis to be delivered at the Capital City Airport project.
5. Defendant agreed to pay Plaintiff for the material it ordered from Plaintiff and
to be delivered by Plaintiff at the Capital City Airport project.

6. On or about November 9,1999, Plaintiff, at the request and insistence of
Defendant, delivered certain materials to Defendant at the Capital City Airport project,
said material and quantities thereof being more particularly described in the invoices
provided to Defendant on that date, which are attached hereto and marked collectively as

7. The total amount of the materials supplied to Defendant by Plaintiff at the
request of Defendant was $5,146.24.
8. After Plaintiff delivered the material to Defendant, Defendant gave Plaintiff's

truck driver a check for the materials in the amount of$5,146.24. Attached hereto and
marked as Exhibit B is a true and correct copy of that check.
9. Defendant then stopped payment on that check and has failed or refused to
make any payment for the materials supplied by Plaintiff to Defendant.
10. The materials supplied by Plaintiff to Defendant were of the type and
quantity ordered by Defendant from Plaintiff.
1 L Defendant breached the oral agreement with Plaintiff whereby he agreed to
pay Plaintifffor the materials delivered by Plaintiffto Defendant on a C.O.D. basis or at
the time that those materials were provided to Defendant.
12. Plaintiff has been damaged in the amount of$5,146.24 as a result of the
breach of the oral agreement between Plaintiff and Defendant by Defendant's failure to
pay for the materials received from Plaintiff.

The following Instructions and Definitions form an integral part of these Interrogatories,
