The Plaintiff is Melissa Moose, an adult individual sui juris with a mailing address of 434 Baltimore Street, Hanover, P A 17331. 2. The Defendant is Thomas Easley, an adult individual with a mailing address of 118 Virginia Ave., Carlisle, PA 17013. 3. The parties are currently involved in litigation regarding the reinstatement of a stricken District Justice appeal. 4. The matter is currently scheduled for a hearing before this Honorable Court on October 18, 2000 at 2:15 p.m. 5. On or about October 10, 2000, Plaintiff Pro Se, Melissa Moose contacted counsel for Defendant, indicating that it is her desire to have the case heard on the merits before a Board of Arbitrators. " .~-\ 6. In accordance with her stated intentions, Plaintiff prepared a statement indicating that she would stipulate to reinstating the stricken appeal to allow the case to proceed to arbitration. A true and correct copy of the statement is attached hereto as Exhibit "A" and incorporated by reference thereto, 7. Defendant, Thomas Easley, by and through his attorney, Lee E. Oesterling, Esquire, concurs with Plaintiff on the issue of reinstating the case to proceed to a Board of Arbitrators. 8. The Parties by the indication of their mutual consent, agree to the entry of an Order of Court reinstating the stricken appeal. Admitted that the Appellant did file a timely appeal on or about June 16, 2000; however, denied that notice was in any way effected as required by the Pennsylvania Rules of Civil Procedure. In fact, Appellee specifically denies that she had ever received any first-class mailing from the Appellant with respect to his appeal. 2. Denied that the Appellee ever was personally handed a copy of the Appeal and Rule to File Complaint on July 3, 2000. Appellee was served by the Sheriff of Cumberland County on July 5, 2000. 3, Denied that the Appellee filed a Praecipe to Strike on July 3, 2000. On or about July 3,2000, the Office of the Prothonotary entered the appeal as stricken under Pa. RC.P.D.J. 1006. 5. Appellant believes and therefore avers that the failure to timely make a return of service has .been cured and that the de minimis delay was of no prejudice to the rights of Appellee.
