COMPLAINT
1. Plaintiff and his attorney in fact are adult individuals who reside, respectively,
in Cumberland County and Dauphin County, Pennsylvania.
2. Defendants are adult individuals and the Defendant Kathryn Hartz, a/kIa
Katherine Hartz, resides at the address set forth above.
3. Defendants are husband and wife but are believed to be in a divorce action
filed in April 1998 with this Court at docket number 1998-01829.
4. Plaintiffs believe that Defendant Rickie Hartz has vacated the marital home at
the address set forth above and his whereabouts are unknown to them.

5. On February 1, 1994, Defendants entered into a Sales Agreement with Plaintiff
Frederick T. Spackman and his wife Patricia Spackman, now deceased. A copy of the Sales
Agreement is marked Exhibit A and attached hereto.
6. The Sales Agreement was for the purchase by Defendants of the real property
owned by Plaintiff and his Wife located at the address 3439 Hawthorne Drive, Borough of Camp
Hill, Pennsylvania. A copy of the Deed, with legal description of the property, dated June 18,
1992 in which Plaintiff and his deceased Wife are Grantees to the subject property is marked
Exhibit B and attached hereto.
7. A Memorandum of Sales Agreement was entered into between Plaintiffs and
Defendants and duly recorded in the Office of the Recorder of Deeds for Cumberland County,
Pennsylvania. A copy of said Memorandum is marked Exhibit C and attached hereto.
8. Pursuant to the Sales Agreement Defendants were required, inter alia, to make
timely monthly installment payments and tax escrow installment payments to Plaintiffs.
9. Pursuant to the Sales Agreement Defendants were required, inter alia, to
obtain the prior written consent of Plaintiffs before making any substantial alterations or repairs
were done to the property.
10. Defendants have breached the Sales Agreement on multiple occasions in that
they have:
a. Failed completely to make certain monthly installment payments and tax
escrow payments;
b. Submitted payments by check which subsequently were returned to Plaintiffs
noting insufficient funds available to cash the check;

c. Failed to submit any payment to cure payments by check deemed to have
insufficient funds available in the account upon which the check was drawn;
d. Failed to make certain installment payments in a timely manner;
e. Failed to maintain the required insurance coverage upon the property; and,
f. Failed to obtain the prior written consent of Plaintiffs prior to making
substantial alterations or repairs upon the property which alterations or repairs
were done and not paid for by Defendants resulting in civil actions filed against
them and reduced to judgments against them.
11. Notwithstanding the multiple breaches of the Sales Agreement, Defendants
remain in possession of the subject property to the detriment of Plaintiff.
WHEREFORE, Plaintiff prays the Court enter ajudgment for possession of3439
Hawthorne Drive, Camp Hill, Pennsylvania in favor of Plaintiff.

SALES AGREEMENT
ARTICLES OF AGREEMENT made thi s 1st day of February, 1994,
by and between Frederi ck T. Spackman and Patri ci a SpacKman, husband
and wife, of Cumberland County, Pennsylvania ("SELLER"),
- AND -
Rickie Hartz and Katherine Hartz, husband and wife, of
Cumberland County, Pennsylvania, ("BUYER"), and ,jointly (:;ol1ectively)
hereinafter referred to as the Parties.
WITNESSETH
In consi derati on of the covenants, promi ses and condi ti ons
contained herein the Parties agree as follows:
1. Seller agrees to sell and convey unto Buyer the land and
improvements thereon located at and known as. 3439 Hawthorne Dr; ve,
Camp Hill, Pennsylvania, {"THE PREMISES").
2. Buyer agrees to purchase from Seller and accept The
Premises for T.he sum of Eighty-eight Thousand Four Hundred Fifty and
NO/100 Dollars ($88,450.00), to be paid as follows:
A. On February 1, 1994, ("SETTLEMENT") Buyer silall
remit to Seller Five Thousand and NO/lOD Dollars ($5,ODO.OO) as a down
payment.
B. The balance of E'j ghty-thl"ee Thousand Four Hundred
Fifty NO/100 Dollars ($83,450.00) together with interest thereon at a
rate of 8.25 percent per annum, amorti zed over twenty-fi ve (25) years
shall be paid in regular monthly insta'llments of Six 1!undred.

4. All payments received by Seller shali be applied in
following priority: late charges, lienable utilities, insurance paid
by Seller on behalf of Buyer, interest, principal.
5. In addi ti on to the above payments Buyer agrees to pay
the following expenses beginning at Settlement: all utilities,
including but not limited to, electric, gas, oil, water, sewer, trash
and homeowne.r dues, and all taxes relating to The Premises. Buyer to
pay additional $108.00 per month for tax escrow - Seller to pay taxes.
6. Buyer agrees to maintain fire, hazard, and extended
coverage insurance on The Premi ses for at 1 east the sum of
Eighty-eight Thousand Four Hundred Fifty and NO/100 Oollars
($88,450.00) and shall name Seller as loss payee. Said insurance
sha 11 be procured through a reputable insurance company, subject to
the approval of Sell er. The cost of insurance shall be borne by
Buyer. In the event insurance is not maintained, Seller shall insure
The Premises and shall be reimbursed by Buyer for the cost. Copies of
all insurance policies shall be delivered to Seller.
7. Buyer agrees to keep The Premi ses in good repair and be
responsibl e for all maintenance therefore. No substanti a 1 alterati ons
or repairs may be done to The Premises \~ithout the prior written
consent of Seller which consent shall not be unreasonably withheld.
8. Se 11 er or Sell er' s agent retains the ri ght to inspect
The Premises during the term of this Agreement.
9. Buyer agrees to comply with applicable housing code
standards, and fi re, safety, and other governmental requi rements and
shall be responsible for all municipal assessments.
10. Seller has not received written notice of any violation
of any governmental regu1 ati on ana has not recei ved noti ce of any
actual or potential assessment.
11. This Agreement shall be binding upon the Parties hereto
and their respective heirs, successors and assigns.
12. Buyer may not assi gn thi s Agreement wi thout the pri or
written consent of Seller which consent shall not be withheld
unreasonably.
13. In the event of defaul t as aforesai d all sums pai d by
Buyer hereunder shall be forfei ted. However, pri or to forfe; ture,
Seller shall provide Buyer a 30-day period to cure.
14. Ti me sha 11 be of the essence under th i s Agreement and
all condition herein.

15. All notices under this Agreement shall be sufficient if
sent by overnight courier or by certified mail, return receipt
requested, postage prepaid, addressed to the Parties as follows:

the other Party at the address above.
At the end of fi ve (5) years from date of thi s contract,
Buyers agree that, at the option of the Sellers, terms may be
renegotiated if terms of renegotiation are mutually agreeable.
Sellers agree to give six (6) months notice if option is exercised and
the mutually agreeabl e terms wi 11 become effecti ve the 5th
anni versary.
16. Thi s document contai ns the enti re understandi ng between
the Parti es and there are no representati ons, warranti es, covenants,
terms or conditions, except as specifically set forth herein. Seller
shall execute a Special Warranty Deed which shall be held by Seller's
Attorney and presented to Buyer upon Buyer I 5 payment of the purChase
pri ce and all other sums set forth herei n. If any default occurs
hereunder the deed shall be deemed void ab initio at Seller's option.
17. No modifi cati on of thi s Agreement sna 11 be bi ndi ng upon
the Parties unless in writing and signed by all Parties hereto.
18. The failure of Seller to insist upon strict enforcement
of any provi si on of thi s Agreement shall not consti tute a waiver of
the ri ght to enforcement of the provi si on or any other prov i si on of
this Agreement.
NOW BE IT. SAID, if Buyer shall pay the purchase pri ce,
interest, expenses, util i ti eS and taxes and all other charges set
forth in this Agreement as they become due, Seller shall deliver to
Buyer the Special Warranty Deed, for the proper conveying and
assigning of The Premises in fee simple, (*free from all
encumbrances**) title to be insurable reputable title insurance
company at regul ar rates excepti ng objecti ons currently of publ i c
record and excepting encumbrances caused by Buyer's action or inaction
that shall accrue after execution hereof, such conveyance to contain
the usual covenants. Upon delivery of the deed all transfer taxes
shall be borne equally by Seller and Buyer.

lying and being in the Borough of Camp Hill in the County of
Cumberland and Commonwealth of Pennsylvania, more particularly
described as follows:
BEGINNING at a point at the south~ly side of Hawthorne Drive,
which point is 740 feet westwardly from the southwesterly corner
of the intersection of Hawthorne Drive and Thirty-fourth Street,
and which point is also at the dividing line between Lots Nos. 33
and 34 on the hereinafter mentioned Plan of Lots; thence along
