THIS AGREEMENT made the '7°/ day of November, 2002, by and between RINE &
RINE BUILDERS, hereinafter referred to as Contractor, and WADE D. FRAKER and BARBARA
J. FRAKER, husband and wife, of Newville, Cumberland County, Pennsylvania, hereinafter referred
to as Owner, whereby the former undertook and agreed to erect and construct a custom built home
on that certain lot of ground situate on Greenspring Road in Newville, North Newton Township,
Cumberland County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made
a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

ALL that certain lot of ground situate in North Newton Township, Cumberland County,
Pennsylvania, bounded and described as follows:
BEGINNING at an iron pin on the southwestern comer of Tract No. 11 on the hereinafter mentioned
plan of lots, which point is also on the eastern right-of-way line of a proposed 50.00 feet wide private
right-of-way and is the northwestern comer of Lot No. 23 on said plan; thence along the latter and
Tract No. 11 on said plan, South 31 degrees 31 minutes 46 seconds West, a distance of 199.49 feet
to an iron pin on the line of land now or formerly of Wade A. Graham, et ux; thence along the latter,
North 41 degrees 07 minutes 37 seconds West, a distance of 20.94 feet to an iron pin; thence along
the same, South 42 degrees 05 minutes 01 seconds West, a distance of 231.82 feet to an iron pin on
the line of Lot No. 21 on said plan; thence along the latter and through an iron pin, North 31 degrees
44 minutes 17 seconds West, a distance of 52.06 feet to an iron pin; thence along the same, South
55 degrees 16 minutes 00 seconds West, a distance of 947.25 feet to an iron pin on the line of land
now or formerly of Richard A. Junks, et ux; thence along the latter, North 12 degrees 16 minutes 20
seconds West, a distance of 113.94 feet to an iron pin; thence along the same, North 00 degrees 16
minutes 27 seconds West, a distance of 330.86 feet to an iron pin; thence still along the same, North

same and lands now or formerly of Edwin E. Kurtz, et ux, North 27 degrees 19 minutes 03 seconds
West, a distance of 301.95 feet to an iron pin; thence along the latter, North 31 degrees 10 minutes
47 seconds East, a distance of 336.58 feet to an iron pin on the line of Tract No. 19 on said plan;
thence along the latter, South 80 degrees 00 minutes 46 seconds East, a distance of 214.65 feet to
an iron pin on the line of Tract No. 18 on said plan; thence along the latter, South 81 degrees 07
minutes 05 seconds East, a distance of 322.84 feet to an iron pin on the line of Tract No. 15 on said
plan; thence along the latter, South 12 degrees 01 minute 52 seconds West, a distance of 137.54 feet
to an iron pin; thence along the same, and through iron pins set on the western side of the proposed
50.00 feet wide right-of way and the western side of the existing 20.00 feet wide private
right-of-way, respectively, South 80 degrees 43 minutes 37 seconds East, a distance of 620.15 feet
to an iron pin on the eastern side of said proposed 50.00 feet wide right-of-way; the Place of
BEGINNING.
CONTAiNING 16.9158 acres according to a final subdivision of land for Lloyd G. Singer, dated
February 8, 1995, by Matthew H. McAllen, R.S., recorded in the Office of the Recorder of Deeds
for Cumberland County, Pennsylvania, in Plan Book 70, Page 114, and being designated as Lot No.
20 thereon.
