concerning the child pending in a court of this Commonwealth.
Plaintiff knows not of a person not a party to the
proceedings who has physical custody of the child or claims to
have custody or visitation rights with respect to the child.
7. The best interest and permanent welfare of the child
will be served by granting the relief requested because: The
Plaintiff is the mother of the child and can provide a more
stable environment for the child than the Defendant can.
8. Each parent whose parental rights to the child have not
been terminated and the person who has physical custody of the
child have been named as parties to this action. There are no
other persons who are known to have or claim a right to custody
or visitation of the child so as to be given notice of the
pendency of this action and the right to intervene.
WHEREFORE, Plaintiff requests the court to grant custody of
the child.

ORDER OF COURT
AND NOW, this lyp", day of _ _, 2000, upon consideration of the
attached Custody' Conciliation Report, it is ordered and directed as follows:
1. The parties shall have shared legal custody of the minor child, Trisha Kay
Shenck, born November 8, 1992. Each parent shall have an equal right to be exercised
jointly with the other parent, to make all major non-emergency decisions affecting the child's
general well being including, but not limited to, all decisions regarding her health, education
and religion. Pursuant to the terms of this paragraph, each parent shall be entitled to all
records and information pertaining to the child including, but not limited to, school and medical
records and information. To the extent one parent has possession of any such records or
information that parent shall be required to share the same, or copies thereof, with the other
parent within such reasonable time as to make the records and information of a reasonable
use to the other parent. Specifically, the parent shall be required to share with each other
information regarding school activities and extracurricular activities in a prompt fashion so that
each parent may participate in the child's education and activities as fully as possible.
2. Pending further Order of this Court or agreement of the parties, Mother and
Father shall have shared physical custody of the minor child from August 2, 2000, until the
commencement of school on or about August 28, 2000, in a week on-week off fashion.
3. To commence with the beginning of the 2000-2001 school year, on or about
August 28, 2000, Father shall have primary physical custody of the minor child subject to
periods of partial physical custody in the Mother according to the following schedule:
A. Mother shall have alternate weekends from Friday after school through
Monday morning when she delivers the child to school. In the event that
one of mother's weekends coincides with a three-day weekend from
school, such as for Labor Day weekend, Mother's custodial period shall
be extended to Tuesday morning.
B. Christmas break shall be divided evenly between the parties. Other
holidays shall be divided as agreed upon between the parties.
C. Father's Day shall be with Father; Mother's Day shall be with Mother.
Custodial period for Father's Day and Mother's Day shall be from 9:00 AM
until 8:00 PM.
D. Each party shall be entitled to one week of vacation on one of their
alternate weeks during the summer, subject to 30-days notice to the other
party. The parties shall provide each other with as much advanced notice
as possible of their plans so as to avoid causing complications for family
events and sports camps.
E. Mother shall be entitled to additional periods of partial custody with the
exact details to be subject to the agreement and expressed consent of
both parties. In particular, Father shall cooperate with Mother to ensure
that Mother shall have the opportunity to have periods of partial custody
when the child is dismissed from school for various holidays or teacher in-
service days.
The parties shall share transportation equally between themselves.
6. During any period of custody or visitation the parties to this Order shall not
possess or use controlled substances, neither shall they consume alcoholic beverages to the
point of intoxication. The parties shall likewise ensure, to the extent possible, that the other
household members and/or house guests comply with this prohibition. Neither party shall do
or say anything which may estrange the child from the other parent, injure the opinion of the
child as to the other parent, or hamper the free and natural development of the child's love
and respect for the other parent. Each parent shag ensure that third parties also comply with
this provision during his or her periods of custody.
7. The parties shall not discuss their differences regarding custody with, or in the
presence of, the minor child.
This Order is temporary in nature and subject to modification. The parties may
return to conciliation upon proper petition by either to the Court.

Petitioner Lisa K. Shenck, by her attorney Gail Guida Souders, Esquire,
respectfully avers the following counts through Civil Procedure Rule 1915.15 (a):
1. Petitioner is the Mother (hereinafter called "Mother") residing at 37 West 2nd
Street, Hummelstown, Pennsylvania 17036.
2. Respondent is the Father (hereinafter called "Father") residing at 1721 Warren
Street, New Cumberland, Pennsylvania 17070.
3. The parties have a child: Trisha Kay Shenck, d.o.b. November 8, 1992.
4. On August 11, 2000, an Order of Court was entered for where Father has
primary physical custody during the school year and the parties share physical custody
during the summer, a true and correct copy of which is attached.

custodial arrangements concerning their child.

2. Lisa K. Shenck (hereinafter called "Mother") shall
have primary physical custody of Trisha Kay Shenck.

3. Jeffrey A. Shenck (hereinafter called "Father")
shall have alternate weekends from Friday after
school through Monday morning when he delivers the
child to school. In the event that one of the
Father's weekends coincides with a three-day weekend
from school, such as Labor Day weekend, Father's
custodial period shall be extended to Tuesday
morning.
4. Christmas break shall be divided evenly between the
parties. Other holidays shall be divided as agreed
upon between the parties.
5. Father's Day shall be with Father; Mother's Day
shall be with Mother. Custodial period for Father's
Day and Mother's Day shall be from 9:00 A.M. until
8:00 P.M.
6. Each party shall be entitled to one week of vacation
on one of their alternate weeks during the summer,
subject to 30-days notice to the other party. The
'parties shall provide each other as much advanced
notice as possible of their plans so as to avoid
causing complications for family events and sports
camps.
7. Mother shall make all the major decision regarding
the child. Father will have the right to review the
medical and school records.
8. The parties shall share transportation equally
between themselves.
9. The parties will split the expenses for child such
as clothes, activities, unreimbursed medical
expenses and school supplies. Mother will not file
a support order against Father as long as Father
maintains this agreement.
