STIPULATION AGAINST MECHANICS' LIENS ,. I\/VI./'....)
WHEREAS, KEVIN S, CECIL, Owner, of 22 Harni1ton Road, Boiling Springs, Pennsylvania
entered into a contract with SHOVER CONSTRUCTION, Contractor, of 106 Willis Road, Newville,
Cumberland County, Pennsylvania, to provide materials and perform labor necessary for the
construction of a residence, upon the following tract of land located in South Middleton Township,
Cumberland County, Pennsylvania, more specifically described as follows, to wit:
ALL that certain tract ofland situate in South Middleton Township, Cumberland
County, Pennsylvania, and more particularly identified as follows:
LOT NO. 57 ON THE final Subdivision Plan of INDIAN HILLS-SECITION II,
recorded in the Office of the Recorder of Deeds in and for Cumberland County,
Pennsylvania, in Plan Book 77, page 72, et seq" the metes and bounds description for
which lot is attached hereto as Exhibit "N', incorporated herein by reference and made a
part hereof.
UNDER AND SUBJECT, NEVERTHELESS, to the conditions, restrictions and
easements as noted on the hereinabove mentioned Final Subdivision Plan; AND
SUBJECT, FURTHER to the Declaration of Protective Covenants, Conditions,
Restrictions and Reservations for said Final Subdivision Plan dated December 3, 1993,
and recorded in the Office of the Recorder of Deeds, aforesaid, in Misc. Book 460, Page
698, including but not limited to:
(1) When any dwelling is constructed on the herein described lot, prior to
occupancy thereof but no later than three (3) years after the date of settlement
for the within conveyance or October 1, 1997, whichever event shall first
occur, the said Grantee, his heirs, successors and assigns, shall install four
(4') feet wide concrete sidewalks (including handicap access sidewalks at
intersections) in accordance with South Middleton Township regulations and
standards; and
(2) All Drainage Easements and Storm Water Management Requirements
applicable to the herein described lot and detailed on said Final Subdivision
Plan,
NOW, TIffiREFORE, it is hereby stipulated and agreed by and between the said parties as part
of the said contract and for the consideration therein set forth, that neither the undersigned contractor,
any sub-contractor or material man, nor any other person furnishing labor or materials to the said
contractor under this contract shall file a lien, commonly called a mechanics' lien for work done or
materials furnished to the said building or any part thereof.
This stipulation is made and intended to be filed with the Cumberland County Prothonotary
within ten days after date, in accordance with the requirements of Act of Assembly of Pennsylvania, in
such case provided.
