STIPULATION AGAINST LIENS
WHEREAS, TERRY A. BURTON AND SANDRA L. BURTON, ("Owner"), the owner
of the real estate described below, has or is about to execute a Contract with DOUGLAS W.
KETNER, CONTRACTOR, whose place of business is located at R.D. #1, Box 187, Blairs
Mills, Pennsylvania for construction of the site improvements at 258 Steelstown Road, Newville,
Cumberland County, Pennsylvania, and more particularly bounded and described on Exhibit "A"
attached hereto and made a part hereof; and
NOW, THEREFORE, this \ l) day of '0 V1'e. , 2000, before any authority had
been given by Owner to Contractor to commence work on said facilities or purchase materials
for same, in consideration of making of the above-described Contract with Owner, and in further
consideration of One ($1.00) Dollar paid to Contractor by Owner, the receipt whereof is hereby
acknowledged, it is agreed that no liens or claims shall be filed or maintained against the
Owner's facilities and the land above-described by the Contractor or any of its subcontractors, or
by any of the materialmen or workmen, or any other person acting through or under them, for or
on account of any labor or materials purchased for, towards, in or abut the erection, construction,
design and improvement of said facilities, under said contract or otherwise, the right to have, file
and maintain such liens or claims against the facilities and the land above-described, being
hereby expressly waived by the Contractor for itself, its subcontractors, all materialmen, or
workmen and other acting through or under them.
IN WITNESS WHEREOF, each of the parties, by their duly authorized representatives,

ALL THAT CERTAIN two tracts of land situate in North Newton Township, Cumberland
County, Pennsylvania, being for fully shown on a Subdivision Plan for David W. Ketner
and Joseph H. Lehman, prepared by Eric L. Diffenbaugh, P.L.S., dated July 24, 1997
and being recorded in Cumberland County Plan Book 76, Page 14, more fully
described as follows:
Tract #1: BEGINNING at a set iron pin at the corner of Lot #11 A, Lot #9 and land
now or formerly of Frank J. Hoke; thence along said land of Hoke and other, North 84
degrees 1 minutes 30 seconds East, 1205.77 feet to a set concrete monument at
corner of land now or formerly of Joseph H. Lehman and Lot #9A; thence along Lot
#9A, North 84 degrees 01 minutes 30 seconds East, 51.33 feet to an existing iron pin at
corner of Lot #9A and land now or formerly of the Commonwealth of PA., Department of
Transportation; thence along said land, South 58 degrees 50 minutes 21 seconds East,
307.99 feet to a set iron pin; thence continuing by same, South 66 degrees 27 minutes
00 seconds East, 62.00 feet to a set iron pin at corner of land now or formerly of L.
Scott Williams; thence along said land, South 57 degrees 57 minutes 56 seconds
West, 760.20 feet to an existing iron pin at the corner of Lot #11A and Lot #9; thence
along the dividing line of Lot #11A and #9, North 54 degrees 59 minutes 51 seconds
West, 964.79 feet to a set iron pin, the point and place of BEGINNING.
CONTAINING 12.5013 acres and being designed at Lot #9 of the aforementioned
subdivision Plan.
Tract #2: BEGINNING at a set p.k. nail in the centerline of Steelstown Road, (SR
4006) at lands being retained by Joseph H. and Roxann V. Lehman; thence along
Steelstown Road, (SR 4006) South 85 degrees 54 minutes 12 seconds East, 50.07 feet
to a railroad spike in the centerline of Steelstown Road, (SR 4006) at corner of lands
now or formerly of Commonwealth of PA, Department of Transportation; thence along
said lands, South 07 degrees 05 minutes 14 seconds West, 143.92 feet to an existing
iron pin at the corner of said lands of the Commonwealth of P A, Department of
Transportation and Lot #9; thence along Lot No.9, South 84 degrees 01 minutes 30
seconds West, 51.33 feet to a set concrete monument at the aforementioned lands
retained by Lehman; thence along said lands of Lehman, North 7 degrees 5 minutes 14
seconds East, 152.91 feet to a set p.k. nail, the point and place of BEGINNING.
BEING Lot No. 9A of the aforementioned Subdivision Plan and containing .1704 acre.
BEING the same premises which David W. Ketner and Mona S. Ketner, by deed dated
March 14, 2000 and recorded in the Office of the Recorder of Deeds in and for
Cumberland County, in Deed Book 217, Page 668, granted and conveyed unto Terry A.
Burton and Sandra L. Burton, Mortgagors herein.
