COMPLAINT
TO THE HONORABLE JUDGES OF SAID COURT:
COMES NOW, the Plaintiff, Ruth A. Parish, by and through their attorney, Joseph A.
Ratasiewicz, Esquire, and does file the within Complaint and in support thereof, avers as follows:
1. The Plaintiff is Ruth A. Parish, an adult individual who's last known address is 41
Hazel Circle, Mechanicsburg, PA 17055.
2. Defendant, Lydia D. Stauffer (hereinafter Stauffer), is an adult individual who's
last known address is 214 Hummel Ave., Apt 2, Lemoyne, PA 17043.
3. Defendant, American International Group (AIG), is an insurance company
incorporated in Delaware, with its principle office located at One Alico Plaza, 600 King Street,
Wilmington, DE 19801.

4. On or about June 24, 1998, Defendant, Stauffer, was operating one 1985 Ford
Escort, owned by Defendant.
5. At the aforesaid date, the Plaintiff, was operating a 1991 Buick vehicle.
6. Plaintiff was traveling north on St. John's Church Rd. when Defendant pulled out
into the path of Plaintiff.
7. As a result, the Plaintiff s, and Defendant's vehicles collided.
8. As a result of the collision, Plaintiff was injured and her car was damaged..
9. Plaintiff had right of way and Defendant failed to yield right of way.
10. Plaintiff, was unable to avoid the collision and Plaintiff thus suffered serious
personal injuries, emotional distress, pain and suffering.
COUNT I
11. Plaintiff incorporates the factual averments of paragraphs one (1) through ten (10)
by reference as though same were set forth fully at length.
12. The injuries suffered by Plaintiff, were caused by the negligence, carelessness,
and/or recklessness of Defendant, Stauffer, acting as aforesaid and consisting of:
a. failing to have her motor vehicle under proper and adequate control;
b. failing to apply the brakes of her motor vehicle in time to avoid the
collision
c. failing to observe the Plaintiff and yield right of way.
d. failing to operate her motor vehicle in accordance with existing traffic
conditions.
e. failing to keep a lookout for on coming traffic.
f. otherwise operating her vehicle in a negligent, careless, and/or reckless
manner and in a manner violating Sections of the Motor Vehicle Code of the Commonwealth of
Pennsylvania and any applicable ordinances.

13. Solely and as a result of the above alleged acts and/or omissions of the Defendant,
and each of them, the Plaintiff has been caused to sustain serious physical injuries, to her neck,
back, chest, head, and body.
14. As a result of the injuries sustained by the Plaintiff, herein, she will continue to
suffer pain in the future.
15. As a result of the injuries sustained by the Plaintiff, herein, Plaintiff has or may
suffer a permanent disability or permanent impairment of earning power and capacity.
16. As a result of the injuries sustained by the Plaintiff, herein, the Plaintiff has or
may suffer a permanent diminution in the ability to enjoy life and life's pleasures.
17. As a result of the injuries sustained by the Plaintiff, herein, the Plaintiff has or
may incur other medical expenses which exceed sums recoverable under the P A. Financial
Responsibility Act.
18. The injuries to Plaintiff, and the damages suffered by the Plaintiff were caused
solely and exclusively by the negligence and/or carelessness of the Defendant, and were in no
way caused by the Plaintiff.
WHEREFORE, the Plaintiff hereby demands judgment against the Defendant, in an
amount in excess of Fifty Thousand Dollars ($50,000.00), plus interest, costs and damages for
delay and any other relief proved appropriate by the evidence.
COUNT II
19. Plaintiff incorporates the above factual allegations as if the same were set forth at
length.
20. At the time of the above referenced accident, which occurred on 6/24/98, Plaintiff
believed that she was insured by Defendant AlO under policy # 109-53-52 (a copy of the
declaration sheet is attached as Exhibit A).
21. Plaintiff made claim against 1\10 in accordance with the terms of the policy.

22. On or about July 16, 1998, AIG sent a letter to Defendant, and her husband Jon
Parish, informing Plaintiff that there is not coverage for her loss claiming that the policy was
canceled on 6/23/98. (see attached exhibit B).
23. Plaintiff was not aware that policy 109-53-52 was canceled on 6/23/98, in fact, a
notice of cancellation from AIG indicated that the policy would expire 12:01 AM on 7/13/98.
(see exhibit C).
24. Defendant, AIG recognized part of Plaintiff's claim when it paid for Plaintiff's
rental car expenses, incurred via this accident, leading Plaintiff to believe that AIG had accepted
the claim.
25. Defendant's actions, as herein described, were done without justification or
consent of Plaintiff.
26. Defendant's failure to honor the remainder of Plaintiff's claim is a breach of
contract.
27. Defendant's acts were done in bad faith to avoid there legal and contractual
obligations as Defendant's had no basis upon which to deny Plaintiffs claims; Plaintiff had not
consented to any cancellation of the policy on 6/23/98.
WHEREFORE, Plaintiff herein demands judgment against the Defendants in an amount
in excess of$50,000.OO, plus attorney's fees, interest and costs.

PRELIMINARY OBJECTIONS OF DEFENDANT AMERICAN INTERNATIONAL GROUP TO
PLAINTIFF'S COMPLAINT
AND NOW, comes Defendant, American International Group (AIG), by and through its
attorneys, Thomas, Thomas & Hafer, LLP, and brings the following Preliminary Objections to
Plaintiff's Complaint:
1. This is a civil action that arises in part from a motor vehicle accident that occurred
on June 24, 1998, and in part from allegations of contract breach on the part of AIG.
2. At the time of the accident, Mrs. Parish maintains that her automobile was insured
by AIG and that the AIG policy is applicable to the accident. The Plaintiff further claims that AIG
improperly denied coverage for the accident.
3. Mrs. Parish claims that the June 24, 1998 accident was caused by the negligence
of Lydia D. Stauffer and that she sustained personal injuries in the accident.
MOTION TO STRIKE
4. Instead of bringing separate actions against AIG for breach of contract and Lydia
Stauffer for negligence, Mrs. Parish elected to bring both claims in a single civil action.

5. The Plaintiff has improperly joined their negligence/personal injury claim with a
breach of contractlbad faith claim against AIG.
6. The issues as to each Defendant are such that they could not be tried in a single
civil action. Evidentiary restrictions on the introduction of evidence of insurance prohibits this case
from being tried as a single action and, furthermore, the issues, facts and proofs necessary to
sustain the separate claims against the two Defendants are essentially unrelated.
7. Because the Plaintiff has mis-joined negligence/personal injury and breach of
contract/bad faith claims in a single cause of action, the claims against AIG should be stricken.
WHEREFORE, Defendant AIG respectfully requests that the Court strike the allegations
pleaded against it and dismiss the matter as to AIG.

AND NOW, comes the Defendant, Lydia D. Stauffer, by and through his

of travel. To the contrary, Plaintiff left the northbound lane and crossed over the double
yellow lines when she struck Defendant.
7. Denied as stated. To the contrary, Plaintiff struck Defendant's vehicle.
8. Denied. The averments contained in paragraph eight (8) is a conclusion
of law to which no responsive pleading is required.

The allegations in paragraphs twenty (20) through twenty-seven
(27) are directed toward a party other than this answering defendant.
WHEREFORE, Defendant Stauffer respectfully requests that this Honorable
Court enter judgment in her favor and against Plaintiff, together with costs.
NEW MATTER
28. The answers in paragraphs one (1) through twenty-seven (27) are
incorporated herein by reference.
29. Any damages or losses allegedly sustained by the Plaintiff were caused or
contributed to by the contributory or comparative negligence of Plaintiff.
30. Said negligence consisted of, but is not limited to:
(a) failing to keep a proper lookout for motor vehicle traffic on the
roadway;
(b) failing to exercise due care and caution while driving on the
roadway, given the circumstances then and there existing; and
(c) violating the provisions of 75 Pa.C.S.A. g3361 , Driving Vehicle at Safe
Speed.
31. The Plaintiff was comparatively negligent to a degree greater than the
causal negligence, if any, of Defendant Stauffer, the existence of such negligence on
the part of Defendant Stauffer being expressly denied. If it is determined that Defendant
Stauffer is liable to the Plaintiff, Defendant Stauffer avers that the Plaintiff's recovery

32. Plaintiff assumed the risk of their injury.
33. The Plaintiff's actions are barred or limited pursuant to the terms of the
Pennsylvania Motor Vehicle Responsibility Act, 75 Pa.C.S. 91701 et sea., the provisions
of which are incorporated herein by reference.
34. Plaintiff's Complaint fails to state a claim upon which relief can be granted.
WHEREFORE, Defendant Stauffer respectfully requests that this Honorable
Court enter judgment in her favor and against Plaintiff, together with costs.
