GARDNER, Defendants CIVIL ACTION - LAW JURY TRIAL DEMANDED COMPLAINT AND NOW, comes the Plaintiff, by its attorneys, wix, Wenger & Weidner, and sets forth the following: 1. The Plaintiff is a corporation, having its principal address located at P. O. Box 1253, Lansdale, Pennsylvania 19446. 2. Defendant, Transport Corporation of America, is a corporation having offices located at 2000 West 43rd Street, Chicago, Illinois 60609. 3. Defendant, James R. Gardner, is an adul t individual residing at 174 Fisher Avenue, Monongahela, Pennsylvania 15063. 4. The facts and occurrences, hereinafter related, took place on or about December 10, 1998 at or about approximately 5:00 o'clock p.m. at the Shell Service station on U.S. Route 11 near Carlisle, Cumberland County, Pennsylvania. 5. At the time and place aforesaid, the Plaintiff was the owner of a 1992 Oldsmobile Sedan which was then and there being operated by Michael Fisher. 6. At the time and place aforesaid, Defendant, Transport Corporation of America, was the owner of a tractor-trailer that was being operated by Defendant, James R. Gardner. 7. At all times relevant hereto, Defendant, James R. Gardner, was the agent, employee or servant of Defendant, Transport Corporation of America. 8. At the time and place aforesaid, Michael D. Fisher was sitting in the Plaintiff's vehicle waiting to exit the service station onto U.S. Route 11. 9. As the Plaintiff's vehicle was in the stopped position, Defendant Gardner caused, or allowed the tractor-trailer that he was driving, to strike the Plaintiff's vehicle and then proceeded to drag the Plaintiff's vehicle along the highway, resulting in the total loss of the Plaintiff's vehicle. 10. The aforesaid accident and damages resulting therefrom were caused by the negligence of Defendant Gardner in that he: a) failed to keep a proper lookout for other vehicles; b) operated his vehicle in careless disregard of the rights of others; c) attempted to make a turn when it was unsafe to do so; and d) was otherwise negligent in the operation of his vehicle. 11.
