S'TIPULA TION A GAINS'T LIENS
THIS AGREEMENT made the 11th day ofNovember, 2002, by and between RIDGEVIEW
CUSTOM HOMES, LLC, hereinafter referred to as Contractor, and JOSE R. NAPEN and
ESTHER NAPEN, husband and wife, hereinafter collectively referred to as Owner, whereby the
former undertook and agreed to erect and construct a custom built home on that certain lot of ground
situate at Lisburn Meadows Estates North Phase 11, Lot No. 24, Monroe Township, Cumberland
County, Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, WITNESSETH: That the said Contractor, for and in consideration of
the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement aforesaid, for themselves
and their subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any
of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant.

himself to be the sole Member of Ridgeview Custom Homes, LLC., a Pennsylvania limited liability
company, and that he as such Member, being authorized to do so, executed the foregoing statement
for the purposes therein and with the intent to bind said limited liability company.

BEGINNING at a point along the southern right of way line of North Loop Road (50 feet dedicated
right of way) on the dividing line between Lot No. 24 and Lot 25 of the aforementioned Plan; thence
along the said dividing line South 27 degrees 46 minutes 33 seconds East 128.41 feet to a point;
thence by same, South 72 degrees 58 minutes 28 seconds East 229.77 feet to a point at the
intersection of Lot No. 24, Lot No. 25 and Lot No. 31 of the aforementioned Plan; thence along the
dividing line between Lot No. 24 and Lot No. 31 South 17 degrees 01 minutes 32 seconds West
350.00 feet to a point at the intersection of Lot 24, Lot 31 and the eastern edge of Lisburn Road (50
foot right-of-way); thence by the eastern edge of Lisburn Road (50 foot right-of way) North 72
degrees 58 seconds 28 minutes West 265.00 feet to a point on the drainage easement at the
intersection of Lot No. 22, Lot No. 24; thence along said drainage easement North 17 degrees 01
minutes 32 seconds East a distance of 314.52 feet to a point; thence North 27 degrees 46 minutes
33 seconds West 128.76 feet to a point on the southern right of way line of North Loop Road; thence
by a curve to the right having a radius 250.00 feet, an arc distance of 50.08 feet, a chord bearing of
North 62 degrees 13 minutes 27 seconds East and a chord distance of 50.00 feet to a point on the
southern right of way line of North Loop Road, the point and place of BEGINNING.
CONTAINING 98,513 square feet or 2.26 acres.
