AND NOW, this 7th day of July, 2000, the
Defendant, James B. Fetzer, now appearing in court with his
privately retained counsel, Walter Lewis Cressler, Jr.,
Esquire, on a charge of indirect criminal contempt, and
having previously on this date entered a plea of no contest
to the charge, and the Commonwealth in the person of
Mary-Jo Mullen, Esquire, and Defendant and his counsel
having agreed upon the sentence to be imposed in this case,
the sentence of the Court is that the Defendant pay such
fees as are required under the Protection from Abuse Act,
and that he undergo a period of probation without
supervision, except for purposes of collection, of 30 days,
conditioned upon his being and remaining on good behavior,
obeying the interim Protection from Abuse order entered
herein by Judge Rehkamp, and complying with any written
directions of the probation office.

COMMONWEALTH'S PETITION FOR A HEARING ON CHARGES
OF INDIRECT CRIMINAL CONTEMPT
Jonathan R. Birbeck, Chief Deputy District Attorney of Cumberland County,
Pennsylvania, brings the following Petition for a hearing on charges of Indirect Criminal
Contempt:
1. A Protection from Abuse Order was issued by the Court. A true and correct
copy of the Order is attached.
2. The defendant's violation of this Order is averred in the attached criminal
complaint.
3. The victim requests the filing of an Indirect Criminal Contempt Charge.
4. The District Attorney's Office approves the filing of this criminal complaint.
5. The Commonwealth is requesting a hearing on the charges ofIndirect
Criminal Contempt pursuant to 23 Pa.C.S.A. S 6113.
6. The plaintiff and/or the defendant may seek modification ofthe Order based
on the filing of this petition as the Court deems appropriate following the trial
in addition to any other sentence.,23 Pa.C.S.A. S 6113.
WHEREFORE, the Commonwealth requests the defendant be commanded to

Dear Judge Oler:
I am sure that you do not recall; however, at the
contempt hearing on July 7, 2000 I mentioned an Interim Order
filed in Perry County on June 23, 2000 and could not understand
how a Final Order of Court appeared on the PFAD. Attached is a
memorandum trom Judge Keith B. Quigley eXplaining that a final
order had been inadvertently entered into the PFAD. I recently
discovered that a Deputy Prothonotary inadvertently activated the
Final Order entered by legal services when she was processing the
interim order on June 23, 2000. This case has been a major SNAFU
from the very beginning. If you would be so kind as to vacate
the June 27, 2000 bench warrant to allow Mr. Fetzer to be
released from your county jail, I would be most appreciative an
justice wou~d be surely served~ank you.

The Petition for Protection From Abuse was filed with
the undersigned in camera on or about June 15, 2000. The
undersigned refused to issue the temporary Order as requested,
but instead directed that the issue of eliqibility for protection
from abuse be addressed at a hearing SCheduled for June 23.
2000.
The purpose of this Memorandum is to establish that on
the date of the in camera filing of the petition, to wit June
IS, 2000, no temporary Order was signed and the next order
involved was the interim Order of June 23, 2000. The Court
is advised that an instrument entitled "Final Order of Court"
I became entered into the Protection From Abuse Central Registry
but not the aforesaid "Interim Order".
The concern of this Court is that apparently inadvertently
an instrument purporting to be a final order in this case
was prematurely entered and may ~ell have served as the basis
for contempt proceedings in sister counties.
There was, in fact, an Order of June 23, 2000, entered
on an interim basis which does appear to address matters frequent y
