HomeMy WebLinkAbout02-5533WPSS No. 00002819 WAIVER OF LIENS WHEREAS, Randall L. Hock and Loriam~ S. Hock, of Dauphin County, Pennsylvania, entered into a contract with Doug's Custom Built Homes, of Huntingdon County, Pennsylvania, to provide materials and perform labor necessary for completion of a residential dwelling situate upon lot of ground located: 213 Mooredale Road, Carlisle, PA 17013, Dickinson Township, Cumberland County, PENNSYLVANIA, as more particularly set forth in Exhibit "A" attached hereto. NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties, as part of the said contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or material man, nor any other person furnishing labor or materials to the said contractor under this contract shall file a lien for work done or materials furnished to the said building or any part thereof. This stipulation is made and intended to be filed with the County Prothonotary within ten (10) days after date, in accordance with the requirements of the Act of Assembly of Pennsylvania, in such case provided. The General Contractor hereby agrees to waive any defects in the filing and indexing of this Lien Waiver in the Office of the Prothonotary where it is to be filed pursuant to Section 1402 of the Mechanics Lien Law of 1963 and agrees that it will not contest the validity of this Lien Waiver based upon any such defects and hereby agrees to this waiver of defects on behalf of any of the Subcontractors, materialmen or suppliers that may provide any labor or materials under the General Contractors Agreement with the owner and who, but for the same, waiver, would be entitled to assert Mechanics Liens against the owners property under the Mechanics Lien Law of 1963. The General Contractor also hereby agrees to provide actual Notice of the Lien Waiver to all subcontractors, materialman and suppliers prior to providing any labor or material by them to the project and will further provide for a written acknowledgment by each of these persons of the Lien Waiver prior to providing any labor or materials to the project. 1N WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals this 8th day of November, 2002. Ho, ff,~ /~ EXHIBIT "A" ALL THAT CERTAIN piece or parcel of land situate in DICKINSON TOWNSHIp, Cumberland County, Pennsylvania, more particularly bounded and described as follows: BEGINNING at an iron pin at the comer of the eastern line of Township Road T-466, known as the Mooredale Road and the southern line of a fifty (50) foot right-of-way; thence by the southern line of said right-of-way South eighty-four (84) degrees fifty-six (56) minutes forty-six (46) seconds East, two hundred sixty-seven and fifty-six one-hundredths (267.56) feet to an iron pin; thence by Lot NO. 13 of the hereinafter mentioned Subdivision Plan South six (06) degrees twenty-seven (27) minutes five (05) seconds West, one hundred twenty-seven and eighty-six one-hundredths (127.86) feet to an iron pin; thence by land formerly of the Grantors herein, now of John R. McKeshan and wife, South eighty-three (83) degrees forty-nine (49) minutes four (04) seconds West, two hundred seventy-one and forty-six one-hundredths (271.46) feet to an iron pin on the eastern side of said Township Road; thence by eastern side of said Township Road North five (05) degrees thirty-eight (38) minutes seventeen (17) seconds East, one hundred eighty and seventy-three one-hnndredths (180.73) feet to an iron pin, the place of BEGINNING. Containing 0.944 acres, more or less. The above described tract of land being Tract No. 14 on Subdivision Plan No. 6 for Jeanette E. Jones, which Subdivision Plan is recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 40, Page 32. BEING the same premises which R. Wayne Jones and Jeanegte E. Jones, his wife, by Deed dated the 4th day of November, 1982, and recorded at Cumberland County in the Office of the Recorder of Deeds, in and for the County of Cumberland, on the 4th day of November, 1982, in Record Book Y29, Page 562, granted and conveyed unto Randall L.
