WItEREAS, SAMUEL T. BASHORE and BONNEY L. BASHORE of 120 Winding Hill Drive,
Etters, Pennsylvania, is about to execute contemporaneously herewith, a contract, with HAUBERT~
HOMES, INC. of 15 Central Blvd., Camp Hill, Pennsylvania, for the erection of a building upon premises
commonly known as 255 CREEKWOOD DRIVE, LOT 3, Township LOWER ALLEN, CUMBERLAND
County, Pennsylvania, as set forth in the deed dated June 11, 2002, recorded at Deed Book 252, Page 867,
in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in
Exhibit "A" which is incorporated herein and attached hereto.
NOW, November 15, 2002, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN tract of land situate in Lower Allen Township, Cumberland
County, Pennsylvania, being also known as Lot No. 3, (255 Creekwood Drive) on a Plan
entitled Klaiber Subdivision, recorded in Cumberland County Plan Book 83, Page 130, more
particularly bounded and described as follows, to wit:
BEGINNING at the Southwesterly corner of lands now or formerly of Donald and
Jolynn Klaiber as recorded in Deed Book 32W, Page 697, as Parcel 1 of the public records of
Cumberland County, Commonwealth of Pennsylvania; thence North 55 degrees 12 minutes 00
seconds East, along the Southerly property line of said lands, a distance of 172.80 feet; thence
North 38 degrees 47 minutes 22 seconds West a distance of 1.55 feet; thence along a circular
curve to the right on a radius of 5.00 feet an arc length distance of 7.60 feet; thence along a
circular curve to the left on a radius of 50.00 feet an arc length distance of 94.60 feet to the
POINT OF BEGINNING of this description;
Thence continuing along said circular curve to the left on a radius of 50.00 feet an arc
length of 84.44 feet; thence North 38 degrees 00 minutes 28 seconds West a distance of 258.20
feet; thence North 13 degrees 13 minutes 35 seconds West a distance of 291.38 feet; thence
North 72 degrees 37 minutes 32 seconds East a distance of 198.31 feet; thence South 27
degrees 15 minutes 29 seconds East a distance of 248.65 feet; thence South 62 degrees 44
minutes 31 seconds West a distance of 203.52 feet; thence South 38 degrees 50 minutes 43
seconds East a distance of 227.26 feet; thence along a circular curve to the right, having an
initial tangent hearing of North 84 degrees 44 minutes 12 seconds East on a radius of 75.00
feet an arc length of 45.98 feet; thence South 29 degrees 51 minutes 49 seconds West a
distance of 25.00 feet to the Point of BEGINNING.
