The relationship of Petitioner to the child is that of mother. 10. The relationship of Respondent to the child is that of father. 11. Petitioner has not participated as a party or witness, or in another capacity, in other litigation concerning the custody of the child in this or another court. 12. Petitioner has no information of a custody proceeding concerning the child pending in a Court of this Commonwealth. 13. Petitioner does not know of a person not a party to the proceedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 14. The best interest and permanent welfare of the child will be served by granting the relief requested because a) Petitioner is and has been the child's primary care giver; b) Respondent will be returning to Virginia to live with his mother and stepfather in March 2007. Upon return to Virginia, Respondent is demanding that child be present at his place of residence without Petitioner Mother. 15. Each parent whose parental rights to the child have not been terminated and the person who has physical custody of the child have been named as parties to this action. The Mother, Shawna-Lea Houle, and the Father, Scott Arden Houle, shall have shared legal custody of Gemini Alexis Houle, born July 3, 2004. Major decisions concerning the Child including, but not necessarily limited to, her health, welfare, education, religious training and upbringing shall be made jointly by the parties after discussion and consultation with a view toward obtaining and following a harmonious policy in the Child's best interest. Neither party shall impair the other party's rights to shared legal custody of the Child. Neither party shall attempt to alienate the affections of the Child from the other party. Each party shall notify the other of any activity or circumstance concerning the Child that could reasonably be expected to be of concern to the other. Day to day decisions shall be the responsibility of the parent then having physical custody. With regard to any emergency decisions which must be made, the parent having physical custody of the Child at the time of the emergency shall be permitted to make any immediate decisions necessitated thereby. However, that parent shall inform the other of the emergency and consult with him or her as soon as possible. In accordance with 23 Pa.C.S.A. §5309, each party shall be entitled to complete and full information from any doctor, dentist, teacher, professional or authority and to have copies of any reports or information given to either party as a parent as authorized by statute. 2. The parties shall have physical custody of the Child in accordance with the following schedule: A. The Father shall have custody of the Child immediately following the conciliation conference in the local area, with the Mother present initially to ensure a secure adjustment for the Child in getting reacquainted with the Father, until such time as the Father returns to his residence in Alabama. B. The Mother shall accompany the Child to the paternal grandparents' residence in Virginia for the weekend from June 15 through June 17, 2007 to enable the Child to spend additional time with the Father while the Mother is present in the local area to promote the Child's adjustment. The Father shall share the bus fare expenses. Following the Mother's departure from Virginia on June 17, the Father shall have custody of the Child either in Virginia or Alabama at his election, from June 17 through June 30, at which time the Father shall return the Child to the Mother's residence. C. The Mother shall have custody of the Child for vacation from July 1 through July 8. 5 D. The parties shall establish a shared schedule for custody of the Child to be implemented upon the Mother's return from vacation on July 8, 2007 and continuing until such time as the Child begins kindergarten. 3. The parties agree to reevaluate the custodial arrangements in light of the Child's needs sufficiently in advance of the Child's enrollment in kindergarten as to ensure a smooth transition for the Child if adjustments to the shared custodial schedule are necessary at that time. 4. This Order is entered pursuant to an agreement of the parties at a custody conciliation conference. The parties may modify the provisions of this Order by mutual consent. Each party shall notify the other of any activity or circumstance concerning the Child that could reasonably be expected to be of concern to the other. Day to day decisions shall be the responsibility of the parent then having physical custody. With regard to any emergency decisions which must be made, the parent having physical custody of the Child at the time of the emergency shall be permitted to make any immediate decisions necessitated thereby. However, that parent shall inform the other of the emergency and consult with him or her as soon as possible. In accordance with 23 Pa.C.S.A. §5309, each party shall be entitled to complete and full information from any doctor, dentist, teacher, professional or authority and to have copies of any reports or information given to either party as a parent as authorized by statute. 3. The Mother shall have primary physical of the Child. 4. The Father shall have partial physical custody of the Child in accordance with the following schedule: 2008 A. The Father shall have custody of the Child in Georgia from July 2 through July 9, . B. The Father shall have custody of the Child for an additional four (4) week period (including travel days) during the summer 2008 for which the Father shall provide the Mother with the s1-- specific dates by June 16, if possible, and if not possible, the Father shall provide notice of when the dates will be available from the military through counsel. C. The Father shall have custody of the Child for the Christmas holiday in 2008 from December 20 through December 30. D. For the Father's periods of custody under this provision, the Mother shall provide transportation for the Child between Pennsylvania and the Richmond, Virginia area and the Father shall provide transportation (with the assistance of his wife or his mother, if necessary) between the Richmond, Virginia area and the Father's residence. 5. The Father shall have reasonable liberal telephone contact with the Child. 6. Each party shall ensure that the other parent has his or her current address and telephone number on an ongoing basis. 7. The parties agree that in the event the Mother is unable to provide sufficient care to meet the Child's needs, the Mother shall contact the Father to discuss alternative custody arrangements so that the Father can provide the necessary care. The parties agree that the Father will notify the Mother in the event the Child becomes homesick or has other difficulties during the Father's periods of custody so that the parties can make arrangements to meet the Child's needs. 8. The parties and their counsel shall attend a follow-up custody conciliation conference in the office of the conciliator, Dawn S. Sunday, on Tuesday, January 6, 2009 at 10:30 a.m. to review the custody arrangements and establish an ongoing schedule for 2009 and thereafter. 9. This Order is entered pursuant to an agreement of the parties at a custody conciliation conference. The parties may modify the provisions of this Order by mutual consent.
