COMPLAINT
I. Plaintiff, Ronald E. Miller ("Plaintiff'), is an adult individual currently
residing at 30 N. Middlesex Rd., Carlisle, Pennsylvania.
2. Defendant, Brenda L. Madison ("Defendant"), is an adult individual
currently residing at 3141 Spring Rd, Carlisle, Pennsylvania.
3. At all times relevant hereto, Plaintiff was the owner and operator of a
1988 Ford Festiva, bearing Pennsylvania registration AGB-1285.
4. At all times material hereto, Defendant was the owner of a 1988 Ford
Escort.
5. On or about March 22, 1998, at approximately 1:58 P.M., Nichole
Madison was operating her vehicle in a easterly direction of York Rd., in Carlisle, Cumberland
County, Pennsylvania.

6. At the aforesaid time and place, Nichole Madison, negligently, recklessly
and carelessly swerved from her lane of travel and struck Plaintiffs vehicle, as he was traveling
westbound on York Rd.
7. At all times material hereto, Plaintiff, who had the legal right-of-way, was
operating his vehicle in a reasonable, cautious, prudent and safe manner and in accordance with
Pennsylvania law.
8. As a direct and proximate result of the negligent, reckless and careless
conduct of Defendant, Plaintiff suffered the damages hereinafter described.

9. The averments in Paragraphs 1 through 8 are incorporated herein by
reference as if set forth in their entirety.
10. The occurrence of the aforesaid accident and the damages to Plaintiffs
vehicle resulting therefrom were the direct and proximate result of the negligent, reckless, and
careless conduct of Defendant by allowing Nichole Madsion to operate a vehicle when she knew
or had reason to know that Nichole Madison was unfit to do so.
11. As a result of the negligent, reckless and careless conduct of Defendant, as
set forth above, Plaintiffs vehicle was damaged in the amount of$1581.00.

12. As a result of the negligent, reckless and careless conduct of Defendant, as
set forth above, Plaintiff suffered severe injuries, including but not limited to, a chest wall
trauma.
13. As a direct and proximate result of the injuries and the complications
thereof resulting from the accident on March 22, 1998, Plaintiff incurred medical expenses and
will continue to incur medical expenses for treatment and therapy in the future.
14. As a direct and proximate result of the injuries at issue in this case,
Plaintiff has endured pain, suffering, humiliation, mental anguish, emotional distress, and the
loss oflife's pleasures, and will continue to endure pain, suffering, humiliation, mental anguish,
emotional distress, and the loss oflife's pleasures into the future.
15. As a direct and proximate result of the injuries at issue in this case,
Plaintiff has and will continue to be limited in his normal daily activities.
16. As a direct and proximate result of the injuries at issue in this case,
Plaintiff has and will continue to suffer impairment to his general health, strength and vitality.
17. As a direct and proximate result ofthe injuries at issue in this case,
Plaintiff has and will be obligated to receive and undergo medical attention and care, and will he
will incur various expenses for medical treatment and will be obligated to continue to expend
such sums for an indefinite time in the future.
18. As a direct and proximate result of the injuries at issue in this case,
Plaintiff is at risk for developing significant multiple orthopaedic and neurological, and other

complications, which may require aggressive surgical and non-surgical treatment, with residual
permanent pathologic injuries.
19. As a direct and proximate result of the injuries at issue in this case,
Plaintiff has and hereafter may incur other expenses or losses for which he claims to the extent
permitted by applicable law..
WHEREFORE, Plaintiff, Ronald E. Miller, demands judgment in his favor and
against Defendant, Brenda Madison, in an amount in excess of the applicable arbitration limit,
plus interest, costs of suit and any and all other relief which this Court deems proper and just.

ANSWER
AND NOW, comes the Defendant, Brenda L. Madison, by her
attorneys, Addams & Rundle, and makes the following answer to the
Plaintiff's complaint:
1, Admitted.
2. Denied. The Defendant no longer resides at 3141 Spring
Road,

5. After reasonable investigation, the Defendant is without
knowledge sufficient to form a belief as to the truth of the
averment. The same is therefore denied.
6. Denied in accordance with Pa. R.C.P. 1029(e).
7. The answer to Paragraph 5 is incorporated herein by

12. After reasonable investigation, the Defendant is without
knowledge sufficient to form a belief as to the truth of the
averments regarding the Plaintiff's injuries and damages. The
same are therefore denied.

WHEREFORE, the Defendant requests the Complaint be
dismissed.
NEW MATTER
By way of further answer and defense, the Defendant asserts
the following in new matter:
20. This action arises out of an automobile accident that
occurred on March 22, 1998.
21. The Plaintiff commenced this action in Magisterial
District No, 09-2-01 on March 21, 2000 claiming $2,951 for
damages to his vehicle. A copy of the complaint with attachment
is Exhibit 1.
22. On June 5, 2000 the district justice entered judgment
for the Defendant.
23. The Plaintiff filed an appeal to the above captioned
number on July 5, 2000.
24. The Complaint in Paragraph 11 claims damages for the
Plaintiff's vehicle.
25. In Paragraphs 12-19 the Plaintiff, for the first time,
pleads a separate cause of action for personal injuries as a
result of the accident on March 22, 1998.

26. The cause of action for personal injury is barred by the
two year statute of limitation, 75 Pa, C.S.A. s5524.
WHEREFORE, the Defendant demands judgment in her favor on
the cause of action for personal injury and requests that
Paragraphs 12-19 of the complaint be stricken.

ATTACHMENT
On March 22, 1998, Nicole Madison, who was driving the vehicle owned by Defendant,
Brenda L. Madison, was traveling eastbound on York Road, Carlisle, Cumberland
County, Pennsylvania when she negligently, recklessly and carelessly failed to yield to
oncoming traffic and made a left turn at the intersection with Giant Lane, thereby
colliding directly into the vehicle of Plaintiff, Ronald E. Miller, who was traveling
westbound on York Road. As a result of the collision, Plaintiff, Mr. Miller, sustained
damages to his vehicle in the amount of$ 2, 951.00, together with costs, interest, and any
and all other relief this Court deems proper and just.
