WHEREAS, Farmers & Merchants Trust Company of Chambersburg of 20 South Main
Street, Chambersl:lurg, Pennsylvania, is about to enter into a contract with R. S. Mowery &
Sons, Inc., of carlisle, pennsylvania, for the construction of a New Branch Bank located at
1901 Ritner HighWay, in the Borough of Carlisle, Cumberland County, pennsylvania.
NOW, July 5,2000, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Farmers & Merchants Trust
Company of Chambersburg to the said R. S. Mowery &Sons, Inc., to commence work on the
said building, or purchase materialsforthesame in consideration oftM making of the said
contract with R. S. Mowery & sons, mc., and the further consideration of one Dollar to
R. S, Mowery & sons, Inc., paid by Farmers & Merchants Trust Company of chambersburg,
it is agreed that no lien shall be filed against the buildings or property by the contractor,
nor any subcontractor, nor by any of the material men orworkmen nor any other person
for any labor, or materials purchased, or extra labor or materials purchased for the
completion of said buildings, the right to file such liens being expressly waived.
