Whereas, Jason oJ. Groelly and Tammy L. Groelly, his wife, of
Cumberland County, Pennsylvania is about to execute
contemporaneously herewith, a contract, with Wheatland Custom
Homes, of 447 Granite Ru Drix~ Lancaste , ~ennsylvania 1760l for
the erection of Gl2 ~ 'i U in ~ upon the
land situate in Hampden Tow ship of Cumb rland County, Pennsylvania
bounded and described as follows, to wit: .
ALL THAT CERTAIN lot or tract of land situate in Hampden
Township, Cumberland County, Commonwealth of pennsylvania more
particularly bounded and described as follows, to wit:
BEGINNING at a point on the southeastern right-of-way line of
Crofton Court at the common front property corner of Lot 316 and
Lot No. 317 as shown on the hereinafter mentioned plan of lots;
thence along said right -a-way North 36 degrees 47 minutes 22
seconds East, a distance of 102.14 feet to a point as the dividil19
line between Lot No. 317 and Lot No. 318; thence along said
di viding line South 40 degrees 54 minutes 49 seconds East, a
distance of 159.59 feet to a point; thence South 40 degrees 15
.minutes 00 seconds West, a distance of 03.12 feet to a point at the
dividing line between Lot No. 316 and Lot No. 317; thence along
said dividing line North 53 degrees 12 minutes 38 seconds West, .a
. distance of 153.62 feet to a point, said point being the Place of
BEGINNING. .
BEING Lot #317 on the Final Subdivision Plan of Hampden Hearth,
Phase IV-B, recorded in the Cumberland County Courthouse in Plan
Book 79, Page 107. The above described tract containing 15,275.86
square feet, more or less.
BEING the s<<me premises which H S Se:t:'Vice Corporation,
Trustee for Hampden Hearth Joint Venture of H S Service
corporation, a Pennsylv<<nia corporation, and Equico Realty Group,
a Pennsylvani<< general p<<rtnership, by their deed of even date and
about to be recorded in the Cumberland County Recorder of Deeds
Office, has granted and conveyed to Jason J. Groelly and Tammy L.
Groelly, husband and wife.

NOWt July ,2000, at. the time of and immediately before
the execution of the principal contract, and before any authority
has been given by the said OWNER to the said CONTRAc'rOR to commence
work on the said building, or purchase materials for the same in
consideration of the makinq of the said contract with OWNER and the
further consideration of One Dollar, to CONTRACTOR paid by OWNER
it is agreed that no lien shall be filed against the building by
the contractor, or any sub-contractor, nor by any of the material
men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly
waived.
