Whereas, James D. Metcalf and Jeanne M, Metcalf, his wife, of York
County, Pennsylvania is about to execute contemporaneously
herewith, a contract, with Haubert Homes Inc., of 15 CENTRAL BLVD.
CAMP HILL, PA 17011 for the erection of a two story brick and
vinyl frame dwelling upon a lot of land situate in the Fairwinds
Development, Phase 3, Lot 79, known as 1503 Inverness Drive,
Mechanicsburg, Cumberland County, Pennsylvania, bounded and
described as follows, to wit:
Being Lot No. 79 as shown on the Final Subdivision Plan of
Fairwinds, Phase III, recorded in the Office of the Recorder of
Deeds, Cumberland County, in Plan Book 78, Page 90.
BEING the same property which Victoria Glen Associates, a
Pennsylvania General Partnership, by their deed of even date and
about to be recorded in the Cumberland County Recorder of Deeds
office, have granted and conveyed to James D. Metcalf and Jeanne
M, Metcalf, his wife,
NOW, July 12, 2000, at the time of and immediately before the
execution of the principal contract, and before any authority has
been given by the said OWNER to the said CONTRACTOR to commence
work on the said building, or purchase materials for the same in
consideration of the making of the said contract with OWNER and the
further consideration of One Dollar, to CONTRACTOR paid by OWNER
it is agreed that no lien shall be filed against the building by
the contractor, or any sub-contractor, nor by any of the material
men or workmen or any other person for any labor, or materials
purchased, or extra labor or materials purchased for the erection
of said building, the right to file such liens being expressly
waived.
