Plaintiff Erie Insurance Group (hereinafter "Erie") is a corporation with a place of business located at 4901 Louise Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. Defendant Amy S. Hartman (hereinafter "Defendant Hartman") is an adult individual residing at 20 Belmore Road, Camp Hill, Cumberland County, Pennsylvania 17011. -~ .",;:,"",-",,', '2 . . At all times relevant to this cause of action, Erie provided automobile insurance coverage to Donald A Murk. 4. Donald A Murk is an adult individual residing at 110 South Broad Street, Mechanicsburg, Cumberland County, Pennsylvania 17055. 5. On July 23, 1998 at approximately 5:40 p.m. Donald Murk was operating a 1994 Nissan in an easterly direction on Trindle Road in Hampden Township, Cumberland County, Pennsylvania. 6. At or about this time, Defendant Hartman was operating a 1986 Dodge in an easterly direction on Trindle Road in Hampden Township, Cumberland County, Pennsylvania. 7. As Donald Murk prepared to turn north onto Brian Road his vehicle was struck in the rear by the vehicle being driven by Defendant Hartman. 8. Defendant Hartman's operation ofthe vehicle was negligent in that she: a. operated her vehicle at an unsafe speed; b. failed to stop her vehicle within an assured clear distance ahead; c. failed to properly and safely operate her vehicle; 2 ~ "~.- -.- ,- 'e, .-~~_" "", ,_ _ ~ ~, ~-"- '-'"-'-e~"--J-",-~_,-~- -"'''''<: d. failed to avoid striking the rear of the vehicle being operated by Donald Murk. 9. As a direct and proximate result of Defendant Hartman's actions, Erie was forced to settle an uninsured motorist bodily injury claim for $1,500.00. 10. As a direct and proximate result of the actions of Defendant Hartman, Erie was forced to pay $2,869.25 to reimburse Donald Murk for damages to the vehicle.
