That the contents of said safe deposit box or boxes are itemized under Schedules of this return, wi th the exception- of the following, for the reasons hereinafter set forth: That Schedule A attached hereto and made part hereof sets forth fully and in detai I all the real property in the Commonwealth of Pennsylvania of which decedent died having an interest therein. It also sets forth the mortgage encumbrances upon each parcel of real property at the date of death, giving the amount still due at death, name of mortgagee, date, rate of interest, and book and page of record thereof. It also sets forth in the columns provided therefore the assessed valuation of each of said parcels, the estimated market value thereof as of date of death of decedent. That Schedule B attached hereto and made part hereof sets forth fully and in detail all personal property wheresover situated owned by the decedent at the time of death; all moneys left by the decedent at the time of death, whether in decedent's immediate possession, standing to decedent's credit in banks of deposit, savings banks, trust companies, or other institutions, whether individually, or in trust for any other person or persons giving also separately the accrued interest thereon, if any, down to the last interest day prim to decedent's death in the case of savings banks, and to the date of decedent's death in all other cases; all bonds, postal savings, treasury certificates or notes and other evidence of indebtedness of the United States to the de- cedent; all obligations, whether by statute or agreement they are designated as tax free, of the United States, or "nv <:t"tp or nolili",,1 <:nhdivision thereof. or of anv foreil!.n countrv. which are owned at the time of death: .' .,. In the case of securi ties of close or family corporations, the values reported are as far as possible substantiated by financial statements of the corporations, showing the assets and liabilities thereof as of the date of death. The schedule also sets forth the interest of decedent at the time of death in any co-partnership or business, and in support of the value of such interest there is annexed to said schedule, financial statements showing the assets and liabilities of said co-partnership or business. A copy of the co-partnership agreement, (if oral, a statement setting forth the nature of the agreement) together with a statement setting forth the character of the business, its location, and such other facts pertaining to the business as may be pertinent to a fair and just appraisal of the decedent's interest therein must be submitted. It should also set forth in itemized form, together with the fair market value thereof, any other property owned or bequeathed by the decedent at the time of death. The Schedule C attached hereto and made part hereof sets forth a true answer to each inquiry contained therein and in the case of transfers of property, real or personal, within two years of decedent's death, in contemplation of decedent's death, or intended to take effect in possession or enjoyment at or after death, said schedule sets forth the nature and value of such property, to whom transferred, the relationship of the transferees to the decedent, the proportionate share received by each transferee and all other facts of a pertinent nature regarding said transfers. In the case of transfers intended to take effect in posseSSion or enjoyment at or after death, there is also attached to the schedule a cORY of the deed, trust agreement or other instrument creating the trust. Ther'~ is also set forth in said schedule a list of all property, real and personal, with its value, which pa~ses at decedent's death by virtue of the exercise by decedent, either individually, or jointly wi th another, or any power of appoint- ment vested in decedent, either individually or jointly, by the will, deed, or other instrument of another, with a copy of the instrument creating such power attached to the schedule. That Schedule D attached hereto and made part hereof sets forth the names and addresses of all persons beneficially interested in this estate at the time of decedent's death, the nature of their res- pective interests, their relationship, if any, to the decedent, together with the ages at the time of decedent's death of all minors, annuitants and beneficiaries for life under decedent's Will. It also contains a statement showing which of the beneficiaries named in the decedent's will, if any, died prior to decedent, the dates of their death, their issue, and the relationship of such issue to the beneficiary. That Schedule E attached hereto and made a part hereof sets forth all property, real and per- sonal, owned by the decedent jointly with another or others, including intangible, standing in the name of the decedent and others, plus the date and place of record of instruments effecting the vestiture of real estate and the date of acquisition of personalty, plus the name, address and relationship, if any, of co-owners to the decedent. That SChedule F attached hereto and made a part hereof sets forth fully and in detail all debts and deductions claimed for and on behalf of this decedent's estate, including funeral expenses paid; family exemption, where applicable; costs of administration of this estate; counsel fees and fudiciary's commissions paid or to be paid; cost expended for burial trusts, tombstones or gravemarkers, and reli- gious services, in consequence of the death of the decedent; debts and claims owing and unpaid at time of death; taxes accrued chargeable for period prior to decedent's death (except those allowed under Section 651 of the Inheritance and Estate Tax Act); together with a statement of collateral pledged for obliga- tions, if any. It is agreed that the fiduciary will present proof of said claimed obligations upon re- quest, that if the amount actually paid in settlement of any fee, commission or debt is less than the estimated amount claiming and allowed, that the same will be reported to the Register of Wills, and that the amount of tax assessed can be reassessed in accordance therewith. ITEM V: Should BENJAMIN YOWLER, (the widowed husband of my deceased sister-in-law, HELEN YOWLER) now a resident of Stuart, Florida, survive me, I give and bequeath him the sum of Five Thousand Dollars. ITEM VI: Should my present housekeeper, ANNE S. MILLER remain in my employ at the time of my death, I give and bequeath her Two Thousand Dollars. ITEM VII: Should my friend BLAIR CLAYBAUGH, now a resident of R. D. 3, Harrisburg, Pennsylvanii1, survive me, I give and bequeath him Five Thousand Dollars. ITEM VIII: Should my brother-in-law, PAUL R. DRESSLER of 1610 Myrtle Avenue, Camp Hill, Pennsylvania, survive me, I give and bequeath him Five Thousand Dollars. ITEM IX: Should TED WHEELER, son of FLORENCE MAY WHEELER, now residing at R. D. 2, Lewisbury, Pennsylvania, survive me, I give and bequeath him the sum of Four'Thousand Dollars. ITEM X: I hereby name, constitute and appoint THE DAUPHIN DEPOSIT BANK AND TRUST COMPANY of Harrisburg, Pennsylvania, as the Executor and Trustee under this my Last Will and Testament. -----~------- _._._-------_._~--~.---- ITEM XI: I direct that my debts, funeral expenses, adminis- tration costs and expenses, the "gifts and bequests" in cash as set forth in Items II to IX inc., estate and inheritance taxes becoming due by reason of my death, shall be paid out of my General Estate. My Executor shall have the discretion as to whether such estate and inheritance taxes be paid immediately, or postpone the payment of such taxes on future or remainder interests until possession thereof accrues to the beneficiaries of my Trust Estate herein named. ITEM XII: All the rest, residue and remainder of my estate, real, personal or mixed, of whatsoever kind and wheresoever situate, I give, devise and bequeath unto the Trustee herein named, IN TRUST NEVERTHELESS, to hold, manage, invest and re-invest, collect the income, and after paying the costs and expenses incident to management of said Trust Estate, distribute the income and principal of said estate in the manner, for the uses and with the powers herein- after s ta ted. POWERS In addition to, and not as limitations upon any authority and responsibility given to Executors and Trustees, under the law, I expres sly authorize and empower my Executor and my Trustee, named herein - (1) To sell, lease, pledge, transfer, exchange, convert or otherwise dispose of, or grant options with respect to, any and all real estate at any time forming a part of my estate or of this trust estate, in such manner, at such time . (2) To invest, reinvest, retain, vary, change, purchase or otherwise acquire, whether or not the same was originally a part of my estate or subsequently acquired by my TRUSTEE, any and all stocks, bonds, mortgages, notes or other securities, in- cluding stocks or interest in investment trusts and common trust funds, as to said TRUSTEE shall seem advisable, and whether or not such investments be of a character permis sible for investments by Fiduciaries or for Trust funds; Provided nevertheless, that in so doing the TRUSTEE shall exercise due care and prudence I and shall carefully consider and determine which bests serves the interests of my benefici.aries named herein both as to the safety and security of such investment and the probable income to be derived therefrom. (3) To vote, in person or by general or limited proxy, with respect to any shares of stock or other securities held by them; to consent directly or through a committee or other agent, to the reorganization, merger, dis solution or liquida tion of any corp- oration in which my estate or Trust Estate may have any interest, or to the sale, lease, pledge or mortgage of any property by or to any such corporation; and to make any payments and to take any steps necessary or proper for my TRUSTEE to take in order to enable my TRUSTEE to obtain benefit from such transaction. '. (4) All stock dividends which shall be received by my TRUSTEE shall be treated as principal, all cash divideilds shall be treated as income. (5) To execute and deliver any and all instruments in writing which said TRUSTEE may deem advisable to carry out any of the foregoing powers, and no other party to any such instrument in writing, as signed by said TRUSTEE, shall be obliged to in- quire into its va 1i.d ity , or be bound to see to the application by the said TRUSTEE of any money or property paid or delivered to TRUSTEE pursuant to the terms of any such written instrument. (6) Whenever in its sound judgment advisable to borrow money for any purpose connected with the protection, preservation, or improvement of my General Estate, or of my Trust Estate, and whenever as security, mortgage or pledge any real estate, or personal property of which I may die, seized or possessed or forming a part of my Trust Estate, and upon such terms and conditions as it may seem advisable. (7) I direct tha t all shares and interests in this Trus t Esta te, whether principal or income, while in the hands of the Executor or Trustee shall not be subject to attachment, execution or sequestration for any debt, contract, obligation or liability of any beneficiary, and shall not be subject to pledge, assignment, conveyance or anticipation of any such bcncficiar;" and the r ........._ _u.. .~_ personal receipt of such beneficiary shall be sufficient and the only discharge of my Executor or Trustee. B. In the event that either or both of my sisters I EDNA A. HERMAN and DOROTHY HERMAN DRESSLER1 now of Camp Hilll Penn- sylvania I shall survive mel I direct and authorize my Trustee to distribute such income as shall accrue from time to time in my Trust Estate (after payment of the necessary current expenses incident to the management of my said Trust Estate) at the timesl amounts and uses as hereinafter provided; (a) Should both sisters survive mel then in equal shares to each sister I for and during her natural lifetime I providing I nevertheless that should either sister predecease her sister I her share shall revert to my Trustee for distribution to the three beneficiaries named by me in the following Paragraph C of this I my Will and Testament. (b) Should either one of my sisters predecease mel then I direct and authorize my Trustee to distribute fifty percent (50%) of the said income to the surviving sister for and during her natural lifetimel and the other fifty percent (50%) among the beneficiaries named by me in the following Paragraph C of this I my Will and Testament.
