Claimant, ADD Enterprise, Inc., ("ADD"), a Pennsylvania corporation with offices in Harrisburg, Pennsylvania, files this mechanics' lien claim as a contractor pursuant to 49 P.S. § 1503. 2. The improvement and property claimed to be subject to the lien is the residence and property of Mr. Edwin C. Walters located at 1437 Cockleys Meadow Drive, Boiling Springs, Pennsylvania 17007 (the "Property") 3. The fee owner of the Property is Edwin C. Walters ("Owner"). A true and correct copy of the tax assessment database record is attached hereto as Exhibit "A." 4. On or about August 7, 2006 ADD entered into a contract with Owner to perform alterations and repairs to repair damage at the property following a flood, in consideration of the Contract Sum of $4,800, subject to additions and deductions ("Contract"). The Contract sets forth the prices for labor and materials. A true and correct copy of the Contract is attached hereto as Exhibit "B." 5. Subsequent to the commencement of ADD's work, the Contract Sum was increased to $6,083.67 as a result of changes and additional work directed by Owner. True and correct copies of the Change Orders are attached hereto and incorporated herein as Exhibit "C." 6. ADD last performed work at the Property on September 27, 2006. 7. Upon information and belief, the work Defendant seeks to have performed is additional work beyond the scope of the contract with Plaintiff. 16. Denied. The allegations contained in Paragraph 16 refer to a writing which speaks for itself and is therefore deemed denied. To the extent a response is required, the proposal for work is not related to any alleged negligent performance of work by Plaintiff. By way of further answer, this proposal for work is excessive. 17. Denied. Plaintiff specifically denies that any of its work needs correction or completion. To the extent that work does need to be completed or corrected, which Plaintiff specifically denies, the cost for this work is minimal and does not approach the amount of Plaintiff's lien claim. 18. Admitted in part, denied in part. It is admitted that Pennsylvania Rule of Civil Procedure 1658 provides for the assertion of set-off in actions upon mechanics' liens. However, it is specifically denied that Defendant Walters is entitled to a set-off against Plaintiff's claim in this matter.
