The Plaintiff is the New Cumberland Federal Credit Union with a principal place of business located at 345 Lewisberry Road, New Cumberland, York County, Pennsylvania 17070. Plaintiff is a federally chartered non profit credit union. 2. The Defendant David G. Hench is an adult individual residing at 413 Meadowbrook Road, Carlisle, Cumberland County, Pennsylvania 17015-8903. 3. The Defendant is not current member of the Armed Forces COUNT I: VISA CREDIT CARD 4. On June 3, 1993 Defendant executed a credit card application which is attached as Exhibit "A". 5. Defendant's account is subject to the terms and conditions set forth in Exhibit "B" which is a true and correct copy of the Visa Credit Card Agreement. 6. Defendant has been late numerous times in paying his minimum payment due on the credit card with $603.00 past due as of January 12, 2007. 7. Defendant's outstanding balance is $9,876.23 accruing interest at 6.90% annual percentage rate (APR) as of January 12, 2007. 8. Pursuant to the Visa Credit Card Agreement the Defendants agreed to pay "20% collection expenses including court costs and attorney's fees" as set forth in Paragraph 6 of Exhibit "B". This amount totals an additional claim for $1,975.25. WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount of $11,851.48 (principal plus past interest and collection costs) at 6.90% interest from January 12, 2007 and a per diem of $1.87 together with all court costs. COUNT II: UNPAID SERVICE FEES OWED BY DEFENDANT 9. Defendant has negotiated a variety of checks which have resulted in insufficient funds being available in the account. 10. As of January 12, 2007 the unpaid service fees owing the Plaintiff by the Defendant total $391.23. WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount of $391.23 plus 6% interest from entry of judgment at a per diem of $0.06 together with all court costs and an award of reasonable attorneys' fees.
