COMPLAINT
AND NOW, this :)~y of November, 2002, comes the Plaintiff, Presbyterian
Homes, Inc" t!dIb/a Green Ridge Village (hereinafter "PHI"), by and through its attorneys,
Killian & Gephart, LLP, and in support of this Complaint, avers the following:
1, Plaintiff, PHI, is a Pennsylvania non-profit corporation with an address of 121 7
Slate Hill Road, Cumberland County, Pennsylvania 17011.
2. Defendant, Anna M, Conley is a resident of Green Ridge Village with an
address of21 0 Big Spring Road, Newville, Cumberland County, Pennsylvania 17241-9486.
3, Defendant, Harold E, Conley, is an adult individual with an address of 200
Luther Lane, Columbia, Lancaster County, Pennsylvania 17512,
4, Defendant, Anna M, Conley is a resident at Plaintiffs facility, Green Ridge
Village,
5, Ms. Conley was admitted to the facility on January 10,2002,
6, A true and correct copy ofthe Nursing Care Admission Agreement signed by
Harold E. Conley on behalf of his wife, Anna M, Conley, on January 10, 2002, is
incorporated hereby and attached hereto as Exhibit A.
7. Anna M, Conley and Harold E. Conley are husband and wife.
8, At the present time, Mrs. Conley is a private pay resident at Green Ridge
Village,
9. The amount due and owing for services provided by Green Ridge Village to
Mrs. Conley is $39,949,72 and rising.
10. Defendant, Harold E, Conley, both as responsible party for his wife and as
husband of his wife to whom medical necessities are being supplied, has an obligation to pay

PHI for the care provided to his wife,
11, Mr. Conley has refused to pay for the care being provided to his wife.
COUNT I - BREACH OF CONTRACT - ANNA M. CONLEY
12. The averments of paragraphs 1 through 11 are incorporated hereby as if set
forth fully and at length.
13. Anna M. Conley has a contractual obligation to pay PHI for the services
rendered to her.
14. Mrs, Conley's representative has refused to pay for the charges on her behalf.
15. Plaintiff, PHI, has been damaged by that breach in the amount of$39,949.72,
which amount continues to rise,
WHEREFORE, Plaintiff respectfully requests this Honorable Court to grant
judgment in its favor in the amount of$39,949.72, which amount is above the jurisdictional
limit for compulsory arbitration, plus additional charges as they accrue for Mrs. Conley's

care, with interest thereon, costs of suit, reasonable attorneys' fees and whatever other relief
the Court may consider just and equitable.
COUNT II - BREACH OF CONTRACT - HAROLD E. CONLEY
16. The averments of paragraphs 1 through 15 are incorporated hereby as if set
forth full and at length.
17. Harold E, Conley, is responsible party for his wife. As a responsible party for
his wife, he has a contractual obligation to apply her assets toward the costs of her medical
care,
18, Mr. Conley has refused to pay his wife's charges and has breached his
contractual obligation,
19. PHI has been damaged by the breach of contract in the amount of$39,949. 72,
plus increments as Mr. Conley continues to leave his wife's bills unpaid.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to grant

judgment in its favor and against Defendant, Harold E, Conley in the amount of$39,949,72,
which amount is above the jurisdictional limit for compulsory arbitration, plus charges as
they continue to accrue, with interest thereon, costs of suit, reasonable attorneys' fees and
whatever other relief the Court may consider just and equitable.
PROVISION OF NECESSARIES - HAROLD E. CONLEY
20, The averments of paragraphs 1 through 19 are incorporated hereby as if set
forth fully and at length,
21. Pursuant to the doctrine of necessaries, a provider of necessary items to one
spouse has a cause of action against the other spouse for payment.
22, Plaintiff, Pill has provided necessary medical care to Anna M, Conley for
which it remains unpaid.
23, Defendant, Harold E, Conley is obligated to pay for his wife's care at PHI's
facility Green Ridge Village.

2. Denied. It is denied that Anna M. Conley is a resident
of Green Ridge Village with an address of 210 Big Spring Road,
Newville, Cumberland County, Pennsylvania 1724-9486. On the
contrary, Anna M. Conley resides at Luther Acres Manor, 600 East
Main Street, Lititz, Pennsylvania 17543.
3. Admitted.
4. Denied. It is denied that Anna M. Conley is a resident
at Plaintiff's facility, Green Ridge Village. On the contrary,
Defendant Anna M. Conley does not reside at Plaintiff's facility,
Green Ridge Village. Strict proof of the same is demanded.
5. Admitted. It is admitted that Anna M. Conley was
admitted to the Green Ridge facility on January 10, 2002. It is
denied that Anna M. Conley remains a resident at Green Ridge
Village.
6. Admitted in part and denied in part. It is admitted
that a document entitled IIPresbyterian Homes, Inc. Nursing Care
Admission Agreement II , executed by Harold E. Conley, and dated
January 10, 2002 is attached to the Complaint as Exhibit IIAII.
All other allegations with regard to the Exhibit, including but
not limited to, explicit or implicit allegations of amount due
from the Defendants based upon the contents of the Agreement are
strictly denied, and proof of the same is demanded.

present time, a private pay resident at Green Ridge Village.

9. Denied. It is denied that the fair and reasonable
amount due and owing for services provided by Green Ridge Village
to Mrs. Conley is $39,949.72 and rising. On the contrary,
Defendants belief and therefore aver that the $39,949.72 is not a
fair and reasonable charge, or the usual and customary charge in
the industry, for services provided by Green Ridge Village to
Mrs. Conley. By way of further answer, during the course of Mrs.
Conley's residency at Green Ridge Village, Defendant Harold E.
Conley complained on numerous occasions with regard to the lack
of appropriate care received by Anna M. Conley. Despite the
repeated requests of Harold E. Conley, Green Ridge Village failed
and/or refused to address the complaints, or provide the level of
care requested by the Defendants. Strict proof of the same is
demanded.
10. Denied as stated. The allegations set forth in
Paragraph 10 of the Complaint state a legal conclusion to which
no responsive pleading is required.
11. Denied, for the reasons as set forth in Paragraph 9

COUNT I - BREACH OF CONTRACT - ANNA M. CONLEY

a contractual obligation to pay PHI for the services rendered to
her. By way of further answer, the allegations set forth in
Paragraph 13 state a legal conclusion, to which no responsive

14. Denied as stated. It is denied that Mrs. Conley's
representative has refused to pay for the charges on her behalf.
On the contrary, Defendant Harold E. Conley has, on numerous
occasions, made complaints to Green Ridge Village with regard to
the level of care received by Mrs. Conley, and his
dissatisfaction therewith. Despite repeated complaints and
requests for increased levels of care, Green Ridge Village failed
andlor refused to respond to the complaints. Strict proof of the
allegations set forth in Paragraph 14 are demanded.
15. Denied. It is denied that Plaintiff PHI has been
damaged in the amount of $39,949.72, which amount continues to
rise. By way of further answer, the allegations set forth in
Paragraph 15 state a legal conclusion to which no responsive

2, On July 22, 2003, Plaintiff filed a Motion to Compel Answers to Interrogatories
and Request for Production of Documents,
3, On July 24,2003, this Court issued a Rule upon Defendants to show cause why
they should not be compelled to answer the Interrogatories and Request for Production of
Documents.
4, By certified mail dated July 29, 2003, Plaintiff sl:rved this Court's Rule to Show
Cause upon attorney for Defendants, A true and correct copy of the Certified Mail receipt is
incorporated hereby and attached hereto as Exhibit "A."
5, Defendants have failed to respond to the Rule,
6, Pursuant to Pennsylvania Rule of Civil Procedure 40l9(c), Plaintiff respectfully
requests this Court to issue an Order in the form attached prohibiting Defendants from offering
any defense as t:1 matters covered in the Interrogatories and Requests for Production of
Documents, to deny Defendants an opportunity to oppose any of the claims in the Complaint and
to grant attorneys' fees to Plaintiff in the amount of$I,500,OO fix having to resort to Court

dilatory fashion, but rather, have been legitimately hampered in
the gathering of discovery information by their age and Mrs,
Conley's residency in a nursing home facility.
WHEREFORE, Defendants request this Honorable Court to Make
the Rule of July 24, 2003 absolute, and issue the proposed Order
submitted with Plaintiff's Motion to Compel Answers to
Interrogatories, requiring the Defendants to answer the
Interrogatories and Request for Production of Documents within
ten (10) days of the service of said Order.

Present at a pretrial conference held June 2, 2004, were Paul J, McDermott, Esquire,
attorney for the plaintiff, and Michael S. Grab, Esquire, attorney for the defendant.
This case arises out of the residency of Anna M, Conley at the Green Ridge Village
Nursing Home, The plaintiff alleges that there is an amount due and owing of$41,735,05, Ms,
Conley was a resident at Green Ridge Village from January 10,2002, through December 10,
2002, where she received nursing care, Some amounts were paid on account of her residency but
there remains unpaid the amount aforesaid, The defendants deny that there are amounts due and
owing and have filed an answer alleging negligence in the care of Anna Conley by the plaintiff.
The plaintiff has indicated in its pretrial memorandum that it intends to file a motion in
limine seeking to preclude the testimony of Harold Conley because Mr. Conley has refused to
produce himself for deposition, Mr. Grab indicated, however, that it was extremely unlikely that
Mr, Conley would appear for the trial of this case, Accordingly, the motion in limine will, in all
likelihood, be moot, Mr. Grab indicated that he would appear for the trial of the case but could
not state the degree to which he will now be able to defend against the claim,
A nonjury trial has been scheduled in this matter for Wednesday, June 30, 2004, at 9:30

AND NOW COMES Plaintiff Presbyterian Homes, 1m:" t/d/bla Green Ridge Village
(hereinafter "PHI") by and through its attorneys, Duane Morris LLP, and files this Motion to
Amend Order Dated June 30, 2004, averring as follows:
1. This Honorable Court issued an Order dated JUGe 30, 2004 in the above-captioned
action, the text of which was as follows:
AND NOW, this 30th day of June, 2004, upon consideration of Plaintiff' s
complaint in the above-captioned matter, and following a nonjury trial held on
this date, the Court finds in favor of Plaintiff, Presbyterian Homes, Inc., t/d/bla
Green Ridge Village, and against Defendants, Anna M, Conley and Harold E,
Conley, jointly and severally, in the amount of$41,735,05, plus interest at lhe
legal rate from January 9,2003, and costs of suit.

A true and correct copy ofthe June 30, 2004 Order of Court is attached hereto as Exhibit "A."
2, In order to transfer post-judgment interest on the judgment, along with the
judgment itself to the State of Florida, the rate of interest accming or accrued on said judgment
must be expressly stated on the Order of Judgment.
3, The legal post-judgment rate of interest in the Commonwealth of Pennsylvania is
six percent (6%) per annum, 41 P,S, S 202 (2004),
WHEREFORE, Plaintiff Presbyterian Homes, Inc, t/dlbla Green Ridge Village
respectfully requests this Honorable Court to direct the Prothonotary (a) to remove the language

"plus interest at the legal rate from January 9, 2003,"; (b) to substitute "plus interest at the rate of
six percent (6%) per annum from January 9,2003,"; and (c) to re-issue the Non-Jury Trial
Verdict Order, as amended,
