HomeMy WebLinkAbout07-0559 - 67-sS'9 (Y}L.O '-rE~ STIPULATION AGAINST LIENS THIS AGREEMENT made the I)/p day of January, 2007, between Strickland ~low~ Brothers Construction, LLC (Builder), of623 Creek Road, Carlisle, Cumberland County, Pennsylvania, a limited liability company organized and existing under the laws of the Commonwealth of Pennsylvania, hereinafter referred to as Contractor, and Farmers & Merchants Trust Company of Chambersburg (Lender) of Chambersburg, Pennsylvania. WHEREAS, Lender has loaned money and holds a first priority security interest in a certain lot of ground known as Lot # 22 Bell Aire Avenue of the Hill Top Manor Subdivision situate in Cumberland County, Pennsylvania, more particularly described in the Final Subdivision Plan for Hill Top Manor dated November 9, 1959 and recorded in Cumberland County Plan Book 11 Page 39 and known as 8 Bell Aire Avenue, Carlisle, Pennsylvania. WHEREAS, Contractor has undertaken and agreed to erect and construct a building, addition and/or do certain home improvements on that certain above-described lot of ground as a spec home with the funding received by Lender. NOW THEREFORE THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar in hand paid to it by Farmers & Merchants Trust Company of Chambersburg, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself and its subcontractors, and all parties acting through or under it or them, covenant and agree that no liens, mechanic's liens or other claims shall be filed or maintained by Contractor or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by it or any of them under said contract or otherwise, for, towards, in or about the erected and construction of the said buildings on the lot above described, and the said Contractor, for itself, its subcontractors and others under it hereby expressly waives and relinquishes the right to have, file, and maintain any mechanic's liens or claims against the said -, buildings or any of the improvements, and agrees that this instrument, waiving the right of lien, shall be an independent covenant. IN WITNESS WHEREOF, the parties hereto intending to be legally bound have hereunto set their hands and seals the day and year first above written.
